Terms Used In Nevada Revised Statutes > Chapter 369

  • Adult: means a person who has attained the age of 18 years. See Nevada Revised Statutes 125A.145
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • beer: means any beverage obtained by the alcoholic fermentation of any infusion or decoction of barley, malt, hops, or any other similar product, or any combination thereof, in water. See Nevada Revised Statutes 369.010
  • brew pub: has the meaning ascribed to it in NRS 597. See Nevada Revised Statutes 369.011
  • brewery: means an establishment which manufactures malt beverages but does not sell those malt beverages at retail. See Nevada Revised Statutes 369.013
  • case of wine: means 12 bottles each containing 750 milliliters of wine or an amount equal to that volume of wine. See Nevada Revised Statutes 369.015
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Conservator: means a person appointed or qualified by a court to act as general, limited or temporary guardian of a minor"s property or any other person legally authorized to perform substantially the same functions. See Nevada Revised Statutes 125A.145
  • Conviction: A judgement of guilt against a criminal defendant.
  • Court: means the district court. See Nevada Revised Statutes 125A.145
  • craft distillery: has the meaning ascribed to it in NRS 597. See Nevada Revised Statutes 369.019
  • Cross examine: Questioning of a witness by the attorney for the other side.
  • Custodial property: means :

    (a) Any interest in property transferred to a custodian in a manner prescribed in this chapter; and

    (b) The income from and the proceeds of that interest in property. See Nevada Revised Statutes 125A.145

  • Custodian: means a person so designated in a manner prescribed in this chapter. See Nevada Revised Statutes 125A.145
  • Decedent: A deceased person.
  • Department: means the Department of Taxation. See Nevada Revised Statutes 360.001
  • Dependent: A person dependent for support upon another.
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • importer: means any person who, in the case of liquors which are brewed, fermented or produced outside the State, is first in possession thereof within the State after completion of the act of importation. See Nevada Revised Statutes 369.030
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • instructional wine-making facility: means an instructional wine-making facility operated pursuant to NRS 597. See Nevada Revised Statutes 369.035
  • Juror: A person who is on the jury.
  • Legal representative: means a personal representative or conservator. See Nevada Revised Statutes 125A.145
  • liquor: means beer, wine, gin, whiskey, cordials, ethyl alcohol or rum, and every liquid containing one-half of 1 percent or more of alcohol by volume and which is used for beverage purposes. See Nevada Revised Statutes 369.040
  • malt beverage: has the meaning ascribed to it in NRS 597. See Nevada Revised Statutes 369.045
  • Minor: means a person who has not attained the age of 18 years. See Nevada Revised Statutes 125A.145
  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
  • original package: means any container or receptacle first used for holding liquor, which container or receptacle is sealed. See Nevada Revised Statutes 369.050
  • Outlays: Outlays are payments made (generally through the issuance of checks or disbursement of cash) to liquidate obligations. Outlays during a fiscal year may be for payment of obligations incurred in prior years or in the same year.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • permissible person: means any duly ordained minister who uses liquor for sacramental purposes, any doctor, apothecary or pharmaceutist who uses alcohol for or in compounding medicine, or the representative of any school, university, hospital, clinic or industrial concern where liquor is used and needed for industrial purposes and not for concocting beverages for drink.   • Person: means any natural person, corporation, organization or other legal entity. See Nevada Revised Statutes 125A.145
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • population: means the number of people in a specified area as determined by the last preceding national decennial census conducted by the Bureau of the Census of the United States Department of Commerce pursuant to Section 2 of Article I of the Constitution of the United States and reported by the Secretary of Commerce to the Governor pursuant to 13 U. See Nevada Revised Statutes 104.4202
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Probation officers: Screen applicants for pretrial release and monitor convicted offenders released under court supervision.
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • retail liquor store: means an establishment where beers, wines and liquors, in original packages or by the drink, are sold to a consumer. See Nevada Revised Statutes 369.090
  • s family: means a minor"s parent, stepparent, spouse, grandparent, brother, sister, uncle or aunt, whether of the whole blood or the half blood, or by or through legal adoption. See Nevada Revised Statutes 125A.145
  • substantial bodily harm: means :

  • supplier: means , with respect to liquor which is brewed, distilled, fermented, manufactured, rectified, produced or bottled:

  • Testify: Answer questions in court.
  • to sell: means and includes any of the following:

  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Transfer: means a transaction which creates custodial property in a manner prescribed in this chapter. See Nevada Revised Statutes 125A.145
  • Transferor: means a person who makes a transfer in a manner prescribed in this chapter. See Nevada Revised Statutes 125A.145
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trust company: means a financial institution, corporation or other legal entity authorized to exercise general trust powers. See Nevada Revised Statutes 125A.145
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • wholesaler: means a person licensed to sell liquor as it is originally packaged to retail liquor stores or to another licensed wholesaler, but not to sell to the consumer or general public. See Nevada Revised Statutes 369.130
  • wine: means any alcoholic beverage obtained by the fermentation of the natural content of fruits or other agricultural products containing sugar. See Nevada Revised Statutes 369.140
