A person whose participation in the illegal drug market constitutes the following level offense shall be considered to have the following illegal drug market target community:
I. For a level 1 offense, the New Hampshire house of representatives’ legislative district in which the defendant‘s place of participation is situated.

Terms Used In New Hampshire Revised Statutes 318-C:9

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
  • Illegal drug: means any drug which is a schedule I-IV drug under RSA 318-B. See New Hampshire Revised Statutes 318-C:4
  • Illegal drug market: means the support system of illegal drug related operations, from production to retail sales, through which an illegal drug reaches the user. See New Hampshire Revised Statutes 318-C:4
  • Person: means an individual, governmental entity, corporation, firm, trust, partnership, or incorporated or unincorporated association, existing under or authorized by the laws of this state, another state, or foreign country. See New Hampshire Revised Statutes 318-C:4
  • Place of participation: means , in relation to a defendant in an action brought under this chapter, each house of representatives' legislative district in which the person participates in the illegal drug market or in which the person resides, attends school, or is employed during the period of the person's participation in the illegal drug market. See New Hampshire Revised Statutes 318-C:4
  • state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4

II. For a level 2 offense, the target community described in paragraph I plus all New Hampshire house of representative’s legislative districts with a border contiguous to that target community.
III. For a level 3 offense, the target community described in paragraph II plus all New Hampshire house of representatives’ legislative districts with a border contiguous to that target community.
IV. For a level 4 offense, the state.
