Terms Used In New Hampshire Revised Statutes 498:21

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
Any lien acquired by proceedings in equity may be released, discharged or modified by the court in such manner and upon such terms as justice may require. When any such lien is dissolved or released, by judgment or otherwise, the plaintiff or the plaintiff’s attorney, upon request, shall give to the defendant or owner of the property attached one or more discharges thereof, which may be filed or recorded in the office or offices where the lien was filed or recorded. The fees payable for filing or recording such discharges shall be in accordance with N.H. Rev. Stat. § 478:17-g.
