Terms Used In New Hampshire Revised Statutes 551:2-a

  • justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • Probate: Proving a will
  • sworn: when applied to public officers required by the constitution to take oaths therein prescribed, shall refer to those oaths; when applied to other officers it shall mean sworn to the faithful discharge of the duties of their offices before a justice of the peace, or other person authorized to administer official oaths in such cases. See New Hampshire Revised Statutes 21:25
  • Testator: A male person who leaves a will at death.

1. The testator signed the instrument as the testator’s will or expressly directed another to sign for the testator.
2. This was the testator’s free and voluntary act for the purposes expressed in the will.
3. Each witness signed at the request of the testator, in the testator’s presence, and in the presence of the other witness.
4. To the best of my knowledge, at the time of the signing the testator was at least 18 years of age, or if under 18 years was a married person, and was of sane mind and under no constraint or undue influence.

II. Any will meeting the requirements of N.H. Rev. Stat. Chapter 551-A shall also qualify as self-proved and shall be allowed as such by the probate court.
