Terms Used In New Hampshire Revised Statutes > Chapter 485 - New Hampshire Safe Drinking Water Act

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Brackish: means a concentration in water of dissolved solids that is between 1,000 and 10,000 milligrams per liter. See New Hampshire Revised Statutes 485:1-a
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • Commissioner: means the commissioner of the department of environmental services. See New Hampshire Revised Statutes 485:1-a
  • Community water system: means a public water system which serves at least 15 service connections used by year-round residents or regularly serves at least 25 year-round residents. See New Hampshire Revised Statutes 485:1-a
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contaminant: means any physical, chemical, biological or radiological substance or matter in the water. See New Hampshire Revised Statutes 485:1-a
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the department of environmental services. See New Hampshire Revised Statutes 485:1-a
  • farm: means any land, buildings, or structures on or in which agriculture and farming operations or activities are carried out or conducted and shall include the residence or residences of owners, occupants, or employees located on such land. See New Hampshire Revised Statutes 21:34-a
  • Feasible: means capable of being done with the use of the best technology, treatment techniques, and other means which the department finds, after examination for efficacy under field as well as laboratory conditions, is available at reasonable cost. See New Hampshire Revised Statutes 485:1-a
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
  • Freshwater: means water with a concentration of total dissolved solids that is less than 1,000 milligrams per liter. See New Hampshire Revised Statutes 485:1-a
  • governor and council: shall mean the governor with the advice and consent of the council. See New Hampshire Revised Statutes 21:31-a
  • Household equivalent: means water usage equal to 300 gallons per day. See New Hampshire Revised Statutes 485:1-a
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
  • legislative body: shall mean a town meeting, school district meeting, village district meeting, city or town council, mayor and council, mayor and board of aldermen, or, when used to refer to unincorporated towns or unorganized places, or both, the county convention. See New Hampshire Revised Statutes 21:47
  • Maximum contaminant level: means the maximum permissible level of a contaminant in water which is delivered to the free flowing outlet of the ultimate user of a public water system, except in the case of turbidity where the maximum permissible level is measured at the point of entry to the distribution system. See New Hampshire Revised Statutes 485:1-a
  • Operator: means the individual who has direct management responsibility for the routine supervision and operation of a public water system or of a water treatment plant or collection, treatment, storage, or distribution facility or structure that is a part of a system. See New Hampshire Revised Statutes 485:1-a
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means any individual, partnership, company, public or private corporation, political subdivision or agency of the state, department, agency or instrumentality of the United States, or any other legal entity. See New Hampshire Revised Statutes 485:1-a
  • petition: when used in connection with the equity jurisdiction of the superior court, and referring to a document filed with the court, shall mean complaint, and "petitioner" shall mean plaintiff. See New Hampshire Revised Statutes 21:51
  • petitioner: shall mean plaintiff. See New Hampshire Revised Statutes 21:51
  • Political subdivision: means any municipality, county, district, or any portion or combination of 2 or more thereof. See New Hampshire Revised Statutes 485:1-a
  • Privately owned redistribution system: means a system for the provision of piped water for human consumption which does not meet the definition of public water system under paragraph XV, and meets all the following criteria: (1) obtains all of its water from, but is not owned or operated by, a public water system; (2) serves a population of at least 25 people, 10 household units, or 15 service connections, whichever is fewest, for at least 60 days per year; and (3) has exterior pumping facilities, not including facilities used to reduce pressure, or exterior storage facilities which are not part of building plumbing.   • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Public water system: means a system for the provision to the public of piped water for human consumption, if such system has at least 15 service connections or regularly serves an average of at least 25 individuals daily at least 60 days out of the year. See New Hampshire Revised Statutes 485:1-a
  • seal: shall include an impression of the official seal made upon the paper alone, as well as an impression thereof made by means of wax, or a wafer, affixed thereto. See New Hampshire Revised Statutes 21:11
  • Source of water: means a spring, artesian well, spa, geyser, drilled well, public water supply, or other source, of any water used in the manufacture of bottled water, which has been inspected and approved by the department. See New Hampshire Revised Statutes 485:1-a
  • state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4
  • Supplier of water: means any person who controls, owns or generally manages a public water system. See New Hampshire Revised Statutes 485:1-a
  • United States: shall include said district and territories. See New Hampshire Revised Statutes 21:4
  • Water conservation: means any beneficial reduction in water losses, waste, or use. See New Hampshire Revised Statutes 485:1-a
  • Water treatment plant: means that portion of the public water system which is designed to alter the physical, chemical, biological or radiological quality of the water or to remove any contaminants. See New Hampshire Revised Statutes 485:1-a
  • Wellhead protection area: means the surface and subsurface area surrounding a water well or wellfield, supplying a public water system, through which contaminants are reasonably likely to move toward and reach such water well or wellfield. See New Hampshire Revised Statutes 485:1-a
