- State: extends to and includes any State, territory or possession of the United States, the District of Columbia and the Canal Zone. See New Jersey Statutes 1:1-2
8. The Department of the Treasury shall not expose the State as an employer or through administration of the marketplace to any liability under the federal “Employee Retirement Income Security Act of 1974” (29 U.S.C. § 1001 et seq.). The Department of the Treasury is specifically prohibited from offering and operating a State-sponsored retirement plan for businesses for individuals who are not employed by the State, or any political subdivision thereof.
