A. An act, done with specific intent to commit an offense under N.M. Stat. Ann. Chapter 20, amounting to more than mere preparation and tending, even though failing, to effect its commission, is an attempt to commit that offense.

Terms Used In New Mexico Statutes 20-12-15

  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

B. Any person subject to N.M. Stat. Ann. Chapter 20 who attempts to commit any offense punishable by that chapter shall be punished as a court-martial may direct, unless otherwise specifically prescribed.

C. Any person subject to N.M. Stat. Ann. Chapter 20 may be convicted of an attempt to commit an offense although it appears on the trial that the offense was consummated.
