1. It is a discriminatory practice for a person engaged in the provision of public services to fail to provide to an individual access to the use of and benefit thereof, or to give adverse or unequal treatment to an individual in connection therewith because of the individual’s race, color, religion, sex, national origin, age, physical or mental disability, or status with respect to marriage or public assistance.
Terms Used In North Dakota Code 14-02.4-15
- Individual: means a human being. See North Dakota Code 1-01-49
- Person: means an individual, organization, government, political subdivision, or government agency or instrumentality. See North Dakota Code 1-01-49
- Sex: means the biological state of being male or female, based on the individual's nonambiguous sex organs, chromosomes, or endogenous hormone profiles at birth. See North Dakota Code 1-01-49
2. Subsection 1 does not apply to:
a. An individual committed to the legal and physical custody of the department of corrections and rehabilitation; or
b. An individual confined in a correctional facility, as defined in section 12-44.1-01.
