The Department of Transportation may exercise the power of eminent domain to acquire property, rights of way or other rights in property for transportation projects that are part of the program established under ORS § 367.804, regardless of whether the property will be owned in fee simple by the department. Terms Used In Oregon Statutes 367.818

  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
