Terms Used In Tennessee Code > Title 13 > Chapter 21 > Part 3 - Residential Rental Inspections

  • Agriculture: means :
    (i) The land, buildings and machinery used in the commercial production of farm products and nursery stock. See Tennessee Code 1-3-105
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Apiary: means a collection of one (1) or more colonies of bees in beehives at a location. See Tennessee Code 44-15-102
  • Appliances: means any apparatus, tools, machines or other devices used in handling and manipulating bees, honey, and wax that may be used in an apiary, or in transporting bees and their products and apiary supplies. See Tennessee Code 44-15-102
  • Baby chicks: means all domestic fowl six (6) weeks of age or under. See Tennessee Code 44-16-205
  • beehive: means that container or structure used by a beekeeper to provide a cavity in which a colony of bees is expected to establish a permanent nest. See Tennessee Code 44-15-102
  • Cat: means any live cat of the species Felis catus. See Tennessee Code 44-17-102
  • chemical capture: means the capture of a dog or cat by means of sedation using approved drugs as provided in this part and appropriate drug administering equipment. See Tennessee Code 44-17-601
  • Commerce: means buying or selling or transporting from one (1) place to another in this state. See Tennessee Code 44-17-102
  • Commissioner: means the commissioner of agriculture. See Tennessee Code 44-17-102
  • Commissioner: means the commissioner of agriculture or the commissioner's designated agent. See Tennessee Code 44-15-102
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dealer: means any person who, for compensation or profit, buys, sells, transports (except as a common carrier), delivers for transportation, or boards dogs or cats for research purposes, or any person who buys or sells twenty-five (25) or more dogs or cats in any one (1) calendar year for resale within the state or for transportation out of the state. See Tennessee Code 44-17-102
  • Department: means department of agriculture. See Tennessee Code 44-16-205
  • Department: means the Tennessee department of agriculture. See Tennessee Code 44-15-102
  • Deteriorated: means any structure or vacant or unimproved lot or parcel in a predominantly built-up neighborhood:
    (A) That, because of physical condition or use, is regarded as a public nuisance at common law or has been declared a public nuisance in accordance with local housing, building, plumbing, electrical, fire, health or related codes. See Tennessee Code 13-21-301
  • Dog: means any live dog of the species Canis familiaris. See Tennessee Code 44-17-102
  • Dwelling: means any building or structure, or part thereof, used and occupied for human occupation or use or intended to be so used, and includes any outhouses and appurtenances belonging thereto or usually enjoyed therewith. See Tennessee Code 13-21-301
  • Dwelling unit: means a building or structure or part thereof that is used for a home or residence by one (1) or more persons who maintain a household. See Tennessee Code 13-21-301
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Flea market: means any assemblage of twenty (20) or more persons gathered together at regular or irregular intervals, whether in open air or under cover, for the purpose of buying, selling, or trading merchandise to and from the general public, when this buying, selling, or trading is outside of the regular business or occupation of the majority of persons so gathered, and when the majority of the persons so gathered do not pay a business privilege tax for their activities at the flea market.   • Governing body: means the council, commission, or board, or other legislative body, charged with governing a municipality. See Tennessee Code 13-21-301
  • honeybees: means any developmental stage of any sub- species of the species Apis mellifem. See Tennessee Code 44-15-102
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Livestock: means all equine as well as animals that are being raised primarily for use as food or fiber for human utilization or consumption including, but not limited to, cattle, sheep, swine, goats, and poultry. See Tennessee Code 1-3-105
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Municipality: means any county, including any county having a metropolitan form of government, or incorporated city or town in this state. See Tennessee Code 13-21-301
  • Owner: means the holder of the title to real property and every mortgagee of record. See Tennessee Code 13-21-301
  • Parties in interest: means all individuals, associations, corporations and others who have interests of record in a structure and any who are in possession thereof. See Tennessee Code 13-21-301
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: includes every person, partnership, firm, company, association, society, public auction, community sale, sale pavilion, syndicate, and corporation. See Tennessee Code 44-16-205
  • Person: means any individual, firm, corporation, partnership, association, or other legal entity. See Tennessee Code 44-17-102
  • Person: includes a corporation, firm, company or association. See Tennessee Code 1-3-105
  • Property: includes both personal and real property. See Tennessee Code 1-3-105
  • Public authority: means any department, agency or branch of the government of the municipality or state relating to health, fire, building regulations, or other activities concerning structures in the municipality. See Tennessee Code 13-21-301
  • Public officer: means any officer or officers of a municipality or the executive director or other chief executive officer of any commission or authority established by the municipality or jointly with any other municipality who are authorized by ordinance adopted hereunder to exercise the power prescribed by the ordinances and by this part. See Tennessee Code 13-21-301
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in a perceivable form. See Tennessee Code 1-3-105
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Representative: when applied to those who represent a decedent, includes executors and administrators, unless the context implies heirs and distributees. See Tennessee Code 1-3-105
  • Research facility: means any school, hospital, laboratory, institution, organization or person that uses or intends to use dogs or cats in research, tests, or experiments and that purchases or transports dogs or cats in commerce. See Tennessee Code 44-17-102
  • Residential rental dwelling unit: means a dwelling unit that is leased or rented to one (1) or more tenants. See Tennessee Code 13-21-301
  • signed: includes a mark, the name being written near the mark and witnessed, or any other symbol or methodology executed or adopted by a party with intention to authenticate a writing or record, regardless of being witnessed. See Tennessee Code 1-3-105
  • State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
  • Structure: means any dwelling or place of public accommodation or vacant building or structure suitable as a dwelling or place of public accommodation. See Tennessee Code 13-21-301
  • written: includes printing, typewriting, engraving, lithography, and any other mode of representing words and letters. See Tennessee Code 1-3-105
  • Year: means a calendar year, unless otherwise expressed. See Tennessee Code 1-3-105
