access line: means the medium over which a telecommunication user connects into the local exchange. See Michigan Laws 484.2102
Access service: means access to a local exchange network for the purpose of enabling a provider to originate or terminate telecommunication services within the local exchange. See Michigan Laws 484.2102
Accredited association: means an association accredited in accordance with this act. See Michigan Laws 290.702
Active duty: means active duty pursuant to an executive order of the president of the United States, an act of congress, or an order of the governor. See Michigan Laws 484.1902
Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
Agricultural commodity: means all agricultural, aquacultural, silvicultural, horticultural, floricultural, or viticultural products, livestock or livestock products, Christmas trees, bees, maple syrup, honey, commercial fish or fish products, and seeds produced in this state, either in their natural state or as processed by the producer of the commodity. Agricultural commodity: means all perishable fruits and vegetables as defined by the department. See Michigan Laws 290.702
Agricultural commodity input: means an item used in the production, processing, or packaging of an agricultural commodity that is assessed by a specific marketing agreement. See Michigan Laws 290.652
ALI: means a 9-1-1 service feature provided by the service supplier that automatically provides the name and service address or, for a CMRS service supplier, the location associated with the calling party's telephone number as identified by automatic number identification to a 9-1-1 public safety answering point. See Michigan Laws 484.1102
Allegation: something that someone says happened.
Amortization: Paying off a loan by regular installments.
ANI: means a 9-1-1 service feature provided by the service supplier that automatically provides the calling party's telephone number to a 9-1-1 public safety answering point. See Michigan Laws 484.1102
Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
Applicant: means an internet service provider that submits an application for a grant after collaborating with the community in the unserved area. See Michigan Laws 484.3252
Armed forces: means that term as defined in section 2 of the veteran right to employment services act, 1994 PA 39, MCL 35. See Michigan Laws 484.1902
Arrest: Taking physical custody of a person by lawful authority.
Association: means a cooperative association of producers or a division thereof, or a federation of cooperative associations of producers, engaged in the marketing, bargaining, shipping, or processing of an agricultural commodity on behalf of its members who are producers of the agricultural commodity. Authority: means the metropolitan authority created under the local community stabilization authority act. See Michigan Laws 484.3102
Authority: means the Michigan broadband development authority created under section 4. See Michigan Laws 484.3203
bargaining: means the mutual obligation of a handler and an accredited association or their designated representatives to meet at reasonable times and confer and negotiate in good faith. See Michigan Laws 290.713
Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
Bequest: Property gifted by will.
Biodiesel: means a fuel composed of mono-alkyl esters of long chain fatty acids derived from vegetable oils or animal fats, and, in accordance with standards specified by the American society for testing and materials, designated B100, and meeting the requirements of D-6751, as approved by the department. Biodiesel blend: means a fuel comprised of a blend of biodiesel fuel with petroleum-based diesel fuel, suitable for use as a fuel in a compression-ignition internal combustion diesel engine. See Michigan Laws 290.642
Blender: means a person who as an individual or through his or her agent adds an oxygenate to a gasoline. See Michigan Laws 290.642
Board: means the board of directors of the authority. See Michigan Laws 484.3203
Broadband developer: means a person selected by the authority to acquire, construct, develop, and create any part of the broadband infrastructure. See Michigan Laws 484.3203
Broadband infrastructure: means all facilities, hardware, and software and other intellectual property necessary to provide broadband services in this state, including, but not limited to, voice, video, and data. See Michigan Laws 484.3203
Broadband operator: means a person selected by the authority to operate any part of the broadband infrastructure. See Michigan Laws 484.3203
Broadband service: means a retail service, not including a satellite service, capable of delivering high-speed internet access at speeds of at least 25 megabits per second downstream and 3 megabits per second upstream. See Michigan Laws 484.3252
Broadband service: means a retail service capable of transmitting data over an access line at a rate greater than 200 kilobits per second. See Michigan Laws 484.2102
Broadband services: means those services, including, but not limited to, voice, video, and data, that provide capacity for transmission in excess of 200 kilobits per second in at least 1 direction regardless of the technology or medium used, including, but not limited to, wireless, copper wire, fiber optic cable, or coaxial cable. See Michigan Laws 484.3203
Bulk purchaser-end user: means a person who is an ultimate consumer of gasoline and receives delivery of gasoline into a storage tank of at least 550-gallon capacity substantially under his or her control. See Michigan Laws 290.642
Buy: means to purchase, trade, or barter, or to offer to purchase, trade, or barter. See Michigan Laws 290.753
Cable operator: means that term as defined in 47 USC 522(5). See Michigan Laws 484.3301
Cable service: means that term as defined in 47 USC 522(6). See Michigan Laws 484.3301
Cable service: means 1-way transmission to subscribers of video programming or other programming services and subscriber interaction for the selection of video programming or other programming services. See Michigan Laws 484.2102
Cable system: means that term as defined in 47 USC 522(7). See Michigan Laws 484.3301
Capital reserve fund requirement: means the fund amount requirement that may be established in the resolution authorizing notes or bonds for which a capital reserve fund has been established under section 8. See Michigan Laws 484.3203
case: means a proceeding as defined in section 3 of the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 484.2102
CMRS: means commercial mobile radio service regulated under section 3 of title I and section 332 of title III of the communications act of 1934, chapter 652, 48 Stat 1064, 47 USC 153 and 332, and the rules of the Federal Communications Commission or provided under the wireless emergency service order. See Michigan Laws 484.1102
Collect: means the harvest of wild ginseng. See Michigan Laws 290.753
Collector: means a person who collects wild ginseng. See Michigan Laws 290.753
Commission: means the Michigan public service commission in the department of licensing and regulatory affairs. See Michigan Laws 484.3102
Commission: means the Michigan public service commission. See Michigan Laws 484.3301

Committee: means the commodity committee or advisory board established under a marketing program. See Michigan Laws 290.652

Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
Confinement sanction: means a violation sanction resulting in confinement in a departmental facility or local county jail for not more than 60 days. See Michigan Laws 791.258a
Consolidated dispatch: means a countywide or regional emergency dispatch service that provides dispatch service for 75% or more of the law enforcement, fire fighting, emergency medical service, and other emergency service agencies within the geographical area of a 9-1-1 service district or serves 75% or more of the population within a 9-1-1 service district. Continuance: Putting off of a hearing ot trial until a later time.
Controlled substance: means that term as defined under section 7104 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 791.258a
Conviction: A judgement of guilt against a criminal defendant.
correctional facility: means a facility or institution which is maintained and operated by the department. See Michigan Laws 791.215
Cultivated ginseng: means ginseng growing or grown in managed beds under artificial or natural shade and cultivated according to recognized ginseng horticultural practices. See Michigan Laws 290.753
Database service provider: means a service supplier who maintains and supplies or contracts to maintain and supply an ALI database or an MSAG. See Michigan Laws 484.1102
Dealer: means a person who buys, collects, or otherwise acquires ginseng roots in this state for resale or trade. See Michigan Laws 290.753
Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
Delivery vessel: means a tank truck, tank equipped trailer, or a similar vessel used for the delivery of gasoline to a dispensing facility. See Michigan Laws 290.642
Department: means the department of technology, management, and budget. See Michigan Laws 484.3252
Department: means the department of agriculture. See Michigan Laws 290.642
Department: means the department of agriculture and rural development. See Michigan Laws 290.652

Dependent: A person dependent for support upon another.
Deployed: means that a provider meets either of the following:

(i) Currently provides broadband service of at least 25 megabits per second download and 3 megabits per second upload in the specific geographic area of the proposed project of the applicant. See Michigan Laws 484.3252

Development costs: means the costs associated with the broadband infrastructure that have been approved by the authority and include, but are not limited to, all of the following:

(i) The costs for the planning, acquiring, leasing, constructing, maintaining, and operating of the broadband infrastructure. See Michigan Laws 484.3203

Devise: To gift property by will.

Diesel fuel: means any liquid other than gasoline that is suitable for use as a fuel or a component of a fuel in a compression-ignition internal combustion diesel engine. See Michigan Laws 290.642

Director: means the director of the department of agriculture or his or her authorized representative. See Michigan Laws 290.642

Director: means the director of the department. See Michigan Laws 290.652

Director: means the director of the department of agriculture or an authorized representative of the director. See Michigan Laws 290.753

Dispensing facility: means a site used for gasoline refueling. See Michigan Laws 290.642

Dispensing unit: means a device designed for the delivery of gasoline in which 1 nozzle equates to 1 dispensing unit. See Michigan Laws 290.642

Distributor: means a person who purchases, transports, or stores or causes the transportation or storage of gasoline at any point between a gasoline refinery and a retail outlet or bulk purchaser-end user facility. See Michigan Laws 290.642

Distributor: means a person engaged in selling, offering for sale, marketing, or distributing an agricultural commodity or agricultural commodity input that he or she has purchased or acquired from a producer or that the person is marketing on behalf of a producer, whether as owner, agent, employee, broker, or otherwise. See Michigan Laws 290.652

Dry weight: means the weight in pounds and ounces of harvested or collected ginseng root that is dried and is no longer viable. See Michigan Laws 290.753

Educational institution: means a public educational institution or a private non-profit educational institution approved by the department of education to provide a program of primary, secondary, or higher education, a public library, or a nonprofit association or consortium whose primary purpose is education. See Michigan Laws 484.2102

Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) ^{Source: OCC}

Emergency telephone operational charge: means a charge allowed under section 401 for nonnetwork technical equipment and other costs directly related to the dispatch facility and the operation of 1 or more PSAPs including, but not limited to, the costs of dispatch personnel and radio equipment necessary to provide 2-way communication between PSAPs and a public safety agency. Emergency telephone technical charge: means a charge as allowed under section 401 or 401d for costs directly related to 9-1-1 service including plant-related costs associated with the use of the public switched telephone network or IP-based 9-1-1 transport network from the end user to the selective router or emergency services routing proxy, the network start-up costs, customer notification costs, common network costs, administrative costs, database management costs, and network nonrecurring and recurring installation, maintenance, service, and equipment charges of a service supplier providing 9-1-1 service under this act. End user: means the retail subscriber of a telecommunication service. See Michigan Laws 484.2102

Energy management services: means a service of a public utility providing electric power, heat, or light for energy use management, energy use control, energy use information, and energy use communication. See Michigan Laws 484.2102

enhanced services: means the offering of a capability for generating, acquiring, storing, transforming, processing, retrieving, utilizing, or making available information, including energy management services, that is conveyed by telecommunications. See Michigan Laws 484.2102

Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.

Escrow: Money given to a third party to be held for payment until certain conditions are met.

Ex officio: Literally, by virtue of one's office.

Exchange: means that term as defined under section 102 of the Michigan telecommunications act, 1991 PA 179, MCL 484. See Michigan Laws 484.3102

Exchange: means 1 or more contiguous central offices and all associated facilities within a geographical area in which basic local exchange service is offered by a provider. See Michigan Laws 484.2102

Exchange access facility: means the access from a particular service user's premises to the communication service. See Michigan Laws 484.1102

facilities: means the equipment or personal property, such as copper and fiber cables, lines, wires, switches, conduits, pipes, and sheaths, which are used to or can generate, receive, transmit, carry, amplify, or provide telecommunication services or signals. See Michigan Laws 484.3102

Financial institution: means a state or nationally chartered bank, member of the farm credit system, savings and loan association, savings bank, and credit union, whose deposits are insured by an agency of the United States government and that maintains a principal or branch office located in this state under the laws of this state or the United States. See Michigan Laws 290.652

firearm: except as otherwise specifically defined in statute, includes any weapon which will, is designed to, or may readily be converted to expel a projectile by action of an explosive. See Michigan Laws 8.3t

franchise agreement: means the franchise agreement required under this act to be the operating agreement between each franchising entity and video provider in this state. See Michigan Laws 484.3301

Franchising entity: means the local unit of government in which a provider offers video services through a franchise. See Michigan Laws 484.3301

Fraud: Intentional deception resulting in injury to another.

Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. ^{Source: OCC}

Gasoline: means a volatile mixture of liquid hydrocarbons generally containing small amounts of additives suitable for use in spark-ignition internal combustion engines, and commonly or commercially known or sold as gasoline. See Michigan Laws 290.642

Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.

Ginseng: means Panaxquinquefolius L. See Michigan Laws 290.753

Ginseng certificate: means a document issued by the department or other official agency authorized by the director that verifies the origin, quantity by weight, type, and condition of ginseng offered for inspection. See Michigan Laws 290.753

Graduated sanction: means any of a wide range of offender accountability measures and programs, including, but not limited to, electronic supervision tools, drug and alcohol testing and monitoring, day or evening reporting centers, community service or work crew, rehabilitative interventions such as substance abuse or mental health treatment, reporting requirements, residential treatment, counseling, confinement, and incarceration. See Michigan Laws 791.258a

Green weight: means the weight in pounds and ounces of freshly harvested or collected ginseng root that is not dried and is still viable. See Michigan Laws 290.753

Grower: means a person who grows cultivated ginseng. See Michigan Laws 290.753

Handler: means a person that takes title to and is engaged in the operation of packing, cleaning, drying, packaging, sizing, hauling, grading, selling, offering for sale, or marketing a marketable agricultural commodity or an agricultural commodity input in commercial quantities as defined in a marketing program, that as owner, agent, or otherwise, ships or causes an agricultural commodity or agricultural commodity input to be shipped. Handler: means a person other than an association engaged in the business or practice of any of the following:

(i) Acquiring agricultural commodities from producers or associations for processing or sale. See Michigan Laws 290.702

Harvest: means to cut, pick, dig, root up, or gather ginseng. See Michigan Laws 290.753

Household: means a house, an apartment, a mobile home, or any other structure or part of a structure intended for residential occupancy as separate living quarters. See Michigan Laws 484.3301

Hydrogen fuel: means a substance containing the chemical formula H2 that exists as a colorless, odorless, and highly flammable gas except at low cryogenic temperatures or when highly compressed that is gaseous or liquefied and suitable for use in a fuel cell or hydrogen fuel vehicle. See Michigan Laws 290.642

Incumbent local exchange carrier: means that term as defined under section 251(h) of title II of the communications act of 1934, chapter 652, 110 Stat. See Michigan Laws 484.3102

Incumbent video provider: means a cable operator serving cable subscribers or a telecommunication provider providing video services through the provider's existing telephone exchange boundaries in a particular franchise area within a local unit of government on the effective date of this act. See Michigan Laws 484.3301

Interconnection: means the technical arrangements and other elements necessary to permit the connection between the switched networks of 2 or more providers to enable a telecommunication service originating on the network of 1 provider to terminate on the network of another provider. See Michigan Laws 484.2102

Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. ^{Source: OCC}

Internet service provider: means any of the following:

(i) An entity holding a license under the Michigan telecommunications act, 1991 PA 179, MCL 484. See Michigan Laws 484.3252

IPTV: means internet protocol television. See Michigan Laws 484.3301

Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.

Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.

License: means a license issued under this act. See Michigan Laws 484.2102

Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.

Livestock: means that term as defined in section 3 of the animal industry act, 1988 PA 466, MCL 287. See Michigan Laws 290.652

Local calling area: means a geographic area encompassing 1 or more local communities as described in maps, tariffs, or rate schedules filed with and approved by the commission. See Michigan Laws 484.2102

local exchange service: means the provision of an access line and usage within a local calling area for the transmission of high-quality 2-way interactive switched voice or data communication. See Michigan Laws 484.2102

Local unit of government: means a city, village, or township. See Michigan Laws 484.3301

Loop: means the transmission facility between the network interface on a subscriber's premises and the main distribution frame in the servicing central office. See Michigan Laws 484.2102

Majority leader: see Floor Leaders

Marketing agreement: means an agreement entered into, with the director, by producers, distributors, processors, or handlers under this act and binding only on those signing the agreement. See Michigan Laws 290.652

Marketing program: means a program established by order of the director under this act prescribing rules and regulations governing the marketing for processing, distributing, selling, or handling an agricultural commodity produced in this state or agricultural commodity input during a specified period and that the director determines would be in the public interest. See Michigan Laws 290.652

Member: means a producer who has entered into a contract with an association appointing the association as his or her exclusive agent in negotiations with handlers with respect to the marketing of an agricultural commodity. See Michigan Laws 290.702

Metropolitan area: means 1 or more municipalities within this state located, in whole or in part, within a county having a population of 10,000 or more or a municipality within this state that enacts an ordinance or resolution electing to be classified as part of a metropolitan area under this act. See Michigan Laws 484.3102

Michigan national guard: means that term as defined in section 105 of the Michigan military act, 1967 PA 150, MCL 32. See Michigan Laws 484.1902

Modification: means any change, removal, or addition, other than an identical replacement, of any component contained within a stage I vapor-recovery system. See Michigan Laws 290.642

Mortgage: The written agreement pledging property to a creditor as collateral for a loan.

Municipality: means a township, city, or village. See Michigan Laws 484.3102

Natural habitat: means the environment where a species exists as a natural population. See Michigan Laws 290.753

Nonconfinement sanction: means a violation sanction that does not result in imprisonment in the custody of the department or the county jail, including, but not limited to, any of the following:

(i) Extension of the period of supervision with the time period provided by law. See Michigan Laws 791.258a

Obligations: means bonds, notes, installment purchase contracts, or lease purchase agreements to be issued by a public agency under a law of this state. See Michigan Laws 484.1102

Operator: means a person who owns, leases, operates, manages, supervises, or controls, directly or indirectly, a gasoline-dispensing facility. See Michigan Laws 290.642

Operator service: means a telecommunication service that includes automatic or live assistance to a person to arrange for completion and billing of a telephone call originating within this state that is specified by the caller through a method other than 1 of the following:

(i) Automatic completion with billing to the telephone from which the call originated. See Michigan Laws 484.2102

Oversight: Committee review of the activities of a Federal agency or program.

OVS: means that term as defined in 47 USC 573. See Michigan Laws 484.3301

Parole sanction certainty program: means the program created under this chapter that utilizes a set of established graduated sanctions to supervise eligible offenders that have been placed on parole sanction certainty supervision. See Michigan Laws 791.258a

Parole sanction certainty supervision: means being placed on parole subject to conditions and sanctions as set forth in the parole sanction certainty program created under this chapter. See Michigan Laws 791.258a

Person: means an individual, corporation, partnership, association, governmental entity, or any other legal entity. See Michigan Laws 484.2102

Person: means an individual, corporation, partnership, limited partnership, association, limited liability company, governmental entity, or any other legal entity. See Michigan Laws 484.3102

Person: means an individual, corporation, limited or general partnership, joint venture, or limited liability company or a governmental entity, including state authorities, municipalities, counties, and townships, police, fire and other public safety organizations, judicial entities, medical entities, schools, colleges, universities, hospitals, libraries, community centers, and local economic development entities. See Michigan Laws 484.3203

Person: includes an individual, community organization, cooperative association, corporation, federally recognized Indian tribe, limited liability company, nonprofit corporation, partnership, or political subdivision of this state. See Michigan Laws 484.3252

Person: means an individual, corporation, association, partnership, governmental entity, or any other legal entity. See Michigan Laws 484.3301

Person: means an individual, sole proprietorship, partnership, corporation, association, or other legal entity. See Michigan Laws 290.642

Person: means an individual, partnership, corporation, or association. See Michigan Laws 290.702

Person: means an individual, sole proprietorship, partnership, corporation, limited liability company, association, governmental entity, or other legal entity. See Michigan Laws 290.753

Person: means an individual, corporation, partnership, association, governmental entity, or any other legal entity. See Michigan Laws 484.1102

Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.

Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.

Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.

Prepaid wireless telecommunications service: means a commercial mobile radio service that allows a caller to dial 9-1-1 to access the 9-1-1 system and is paid for in advance and sold in predetermined units or dollars of which the number declines with use in a known amount. See Michigan Laws 484.1102

Presentence report: A report prepared by a court's probation officer, after a person has been convicted of an offense, summarizing for the court the background information needed to determine the appropriate sentence. ^{Source: U.S. Courts}

primary PSAP: means a communications facility operated or answered on a 24-hour basis assigned responsibility by a public agency or county to receive 9-1-1 calls and to dispatch public safety response services, as appropriate, by the direct dispatch method, relay method, or transfer method. See Michigan Laws 484.1102

Prime rate: means the average predominant prime rate quoted by not less than 3 commercial financial institutions as determined by the department of treasury. See Michigan Laws 484.1102

prisoner subject to disciplinary time: means that term as defined in section 34 of Act No. See Michigan Laws 791.233c

Probable cause: A reasonable ground for belief that the offender violated a specific law.

Probate: Proving a will

Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.

Probation officers: Screen applicants for pretrial release and monitor convicted offenders released under court supervision.

Processor: means a person engaged in canning, freezing, dehydrating, drying, fermenting, distilling, extracting, preserving, grinding, crushing, milling, or otherwise preserving or changing the form of an agricultural commodity for the purpose of marketing it. See Michigan Laws 290.652

Producer: means a person engaged in the business of producing, or causing to be produced for any market, an agricultural commodity or agricultural commodity input in quantity beyond that person's own family use, and having a value at first point of sale of more than $800. See Michigan Laws 290.652

Producer: means any person who produces or causes to be produced in any 1 marketing period within the previous 2 marketing periods any agricultural commodity in a quantity beyond his or her own family use and having a minimum value at first point of sale as determined by the department for that agricultural commodity, and who is able, during the marketing period, to transfer to a handler or an association a merchantable title to the agricultural commodity or provide management, labor, machinery, facilities, or any other production input, with the assumption of risk, for the production of the agricultural commodity under a written or oral contract. See Michigan Laws 290.702

Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.

provider: means a person that for compensation provides 1 or more telecommunication services. See Michigan Laws 484.2102

provider: means a person authorized under this act to provide video service. See Michigan Laws 484.3301

Public agency: means a village, township, charter township, or city within the state and any special purpose district located in whole or in part within the state. See Michigan Laws 484.1102

Public right-of-way: means the area on, below, or above a public roadway, highway, street, alley, easement, or waterway. See Michigan Laws 484.3102

Public rights-of-way: means the area on, below, or above a public roadway, highway, street, public sidewalk, alley, waterway, or utility easements dedicated for compatible uses. See Michigan Laws 484.3301

Public safety agency: means a functional division of a public agency, county, or the state that provides fire fighting, law enforcement, ambulance, medical, or other emergency services. See Michigan Laws 484.1102

Public safety system: means a communication system operated by a public entity to provide emergency police, fire, medical, and other first responder services. See Michigan Laws 484.2102

Purchaser: means a person who buys or otherwise acquires ginseng from a grower, collector, or other purchaser for resale or trade. See Michigan Laws 290.753

Qualified obligations: means obligations that meet 1 or more of the following:

(i) The proceeds of the obligations benefit the 9-1-1 district, and for which all of the following conditions are met:

(A) The proceeds of the obligations are used for capital expenditures, costs of a reserve fund securing the obligations, and costs of issuing the obligations. See Michigan Laws 484.1102

Recidivism: means any rearrest, reconviction, or reincarceration in prison or jail for a felony or misdemeanor offense or a probation or parole violation of an individual as measured first after 3 years and again after 5 years from the date of his or her release from incarceration, placement on probation, or conviction, whichever is later. See Michigan Laws 791.208a

Refiner: means a person who owns, leases, operates, controls, or supervises a refinery. See Michigan Laws 290.642

Remand: When an appellate court sends a case back to a lower court for further proceedings.

Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.

Retail dealer: means a person who owns, leases, operates, controls, or supervises a retail outlet. See Michigan Laws 290.642

Retail outlet: means an establishment at which motor fuel is sold or offered for sale to the public. See Michigan Laws 290.642

Rule: means a rule promulgated pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 290.642

secondary PSAP: means a communications facility of a public safety agency or private safety entity that receives 9-1-1 calls by the transfer method only and generally serves as a centralized location for a particular type of emergency call. See Michigan Laws 484.1102

Sell: means to sell, trade, or barter, or to offer to sell, trade, or barter. See Michigan Laws 290.753

Service member: means a member of the armed forces, a reserve branch of the armed forces, or the Michigan national guard. See Michigan Laws 484.1902

Service supplier: means a person providing a communication service to a service user in this state. See Michigan Laws 484.1102

Service user: means a person receiving a communication service. See Michigan Laws 484.1102

services: includes regulated and unregulated services offered to customers for the transmission of 2-way interactive communication and associated usage. See Michigan Laws 484.2102

Supervised individual: means an individual who is placed on parole subject to parole sanction certainty supervision under this chapter. See Michigan Laws 791.258a

Supervising agent: means the parole agent assigned to directly supervise an individual on parole sanction certainty supervision. See Michigan Laws 791.258a

Toll service: means the transmission of 2-way interactive switched communication between local calling areas. See Michigan Laws 484.2102

Total service long run incremental cost: means , given current service demand, including associated costs of every component necessary to provide the service, 1 of the following:

(i) The total forward-looking cost of a telecommunication service, relevant group of services, or basic network component, using current least cost technology that would be required if the provider had never offered the service. See Michigan Laws 484.2102

Trade secrets: means trade secret as that term is defined in section 2 of the uniform trade secrets act, 1998 PA 448, MCL 445. See Michigan Laws 484.3252

Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.

underserved areas: means geographical areas of this state identified by the authority as having the greatest need for broadband development. See Michigan Laws 484.3207

Unfair practices: means those practices prohibited under section 4. See Michigan Laws 290.702

Unserved area: means any of the following:

(i) A census block lacking access to broadband service from at least 1 internet service provider. See Michigan Laws 484.3252

Validated risk and needs assessment: means a tool or tools adopted by the department that have been validated as to the effectiveness of the tool in determining a supervised individual's likely risk of reoffense, violent reoffense, or both, as well as the offender's criminogenic needs. See Michigan Laws 791.258a

vapor pressure: means the vapor pressure of gasoline or gasoline oxygenate blend as determined by ASTM test method D6378 or D5191 or an ASTM method approved by the department. See Michigan Laws 290.643

Video programming: means that term as defined in 47 USC 522(20). See Michigan Laws 484.3301

Video service: means video programming, cable services, IPTV, or OVS provided through facilities located at least in part in the public rights-of-way without regard to delivery technology, including internet protocol technology. See Michigan Laws 484.3301

Video service provider fee: means the amount paid by a video service provider or incumbent video provider under section 6. See Michigan Laws 484.3301

WATS: means the transmission of 2-way interactive switched communication over a dedicated access line. See Michigan Laws 484.2102

Wild ginseng: means ginseng growing or grown in an uncultivated state or harvested from its natural habitat. See Michigan Laws 290.753

Wireless emergency service order: means the order of the Federal Communications Commission, FCC docket No. See Michigan Laws 484.1102

Woodsgrown ginseng: means ginseng growing or grown in managed beds under natural shade. See Michigan Laws 290.753
