(a) The department shall revoke, modify, or suspend the certificate of authority of a public weigher, assess an administrative penalty, place on probation the public weigher whose certificate has been suspended, or reprimand a public weigher for a violation of this subchapter or a rule adopted by the department under this subchapter.
(b) If a certificate suspension is probated, the department may require the public weigher to:
(1) report regularly to the department on matters that are the basis of the probation;
(2) limit practice to the areas prescribed by the department; or
(3) continue or renew professional education until the public weigher attains a degree of skill satisfactory to the department in those areas that are the basis of the probation.

  • Department: means the Department of Agriculture. See Texas Agriculture Code 1.003
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Rule: includes regulation. See Texas Government Code 311.005

(c) If the department proposes to revoke, modify, or suspend a public weigher’s certificate, the public weigher is entitled to a hearing conducted under § 12.032. The decision of the department is appealable in the same manner as provided for contested cases under Chapter 2001, Government Code.
