(a) A person who violates this chapter following the cure period described by § 541.154 or who breaches a written statement provided to the attorney general under that section is liable for a civil penalty in an amount not to exceed $7,500 for each violation.
(b) The attorney general may bring an action in the name of this state to:
(1) recover a civil penalty under this section;
(2) restrain or enjoin the person from violating this chapter; or
(3) recover the civil penalty and seek injunctive relief.

- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Written: includes any representation of words, letters, symbols, or figures. See Texas Government Code 311.005
(c) The attorney general may recover reasonable attorney’s fees and other reasonable expenses incurred in investigating and bringing an action under this section.
(d) The attorney general shall deposit a civil penalty collected under this section in accordance with § 402.007, Government Code.
