Terms Used In Texas Election Code 31.121
- Law: means a constitution, statute, city charter, or city ordinance. See Texas Election Code 1.005
- Political subdivision: means a county, city, or school district or any other governmental entity that:
(A) embraces a geographic area with a defined boundary;
(B) exists for the purpose of discharging functions of government; and
(C) possesses authority for subordinate self-government through officers selected by it. See Texas Election Code 1.005 - Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
Two or more members of the governing body of a political subdivision may perform a duty placed by this code on the presiding officer of the governing body if the office is vacant or the presiding officer fails to perform the duty unless:
(1) a single member of the governing body designated by law to act in place of the presiding officer performs the duty; or
(2) this code specifies that the duty is to be performed by another authority acting in place of the presiding officer.
