(a) If a victim, close relative of a deceased victim, or guardian of a victim is required by a subpoena issued under § 508.048 to appear at a hearing, the victim, relative, or guardian is entitled to representation by counsel at the hearing.
(b) This section does not require the state to provide representation by counsel to a victim, close relative of a deceased victim, or guardian of a victim.

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Subpoena: A command to a witness to appear and give testimony.

(c) In this section, “victim,” “close relative of a deceased victim,” and “guardian of a victim” have the meanings assigned by § 508.117.
