(a) The commission may undertake monitoring, maintenance, and emergency measures in connection with by-product material and property for which it has assumed custody under § 401.267 that are necessary to protect the public health and safety and the environment.
(b) The commission shall maintain the by-product material and property transferred to it in a manner that will protect the public health and safety and the environment.
