(a) A person commits an offense if the person sells, transfers, furnishes, or receives a chemical laboratory apparatus subject to § 481.080(a) and the person:
(1) does not comply with § 481.080;
(2) knowingly makes a false statement in a report or record required by § 481.080; or
(3) knowingly violates a rule adopted under § 481.080.

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
  • Rule: includes regulation. See Texas Government Code 311.005
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

(b) An offense under this section is a state jail felony, unless it is shown on the trial of the offense that the defendant has been previously convicted of an offense under this section, in which event the offense is a felony of the third degree.
