(1) The commissioner may require an applicant for a license to pass an examination and complete a training program as a requirement for a license.
Terms Used In Utah Code 31A-23b-205
- Application: means a document:(10)(a)(10)(a)(i) completed by an applicant to provide information about the risk to be insured; and(10)(a)(ii) that contains information that is used by the insurer to evaluate risk and decide whether to:(10)(a)(ii)(A) insure the risk under:(10)(a)(ii)(A)(I) the coverage as originally offered; or(10)(a)(ii)(A)(II) a modification of the coverage as originally offered; or(10)(a)(ii)(B) decline to insure the risk; or(10)(b) used by the insurer to gather information from the applicant before issuance of an annuity contract. - Insurance: includes :
(96)(b)(i) a risk distributing arrangement providing for compensation or replacement for damages or loss through the provision of a service or a benefit in kind;(96)(b)(ii) a contract of guaranty or suretyship entered into by the guarantor or surety as a business and not as merely incidental to a business transaction; and(96)(b)(iii) a plan in which the risk does not rest upon the person who makes an arrangement, but with a class of persons who have agreed to share the risk. - Medicare: means the "Health Insurance for the Aged Act" Title XVIII of the federal Social Security Act, as then constituted or later amended. See Utah Code 31A-1-301
- Person: includes :
(146)(a) an individual;(146)(b) a partnership;(146)(c) a corporation;(146)(d) an incorporated or unincorporated association;(146)(e) a joint stock company;(146)(f) a trust;(146)(g) a limited liability company;(146)(h) a reciprocal;(146)(i) a syndicate; or(146)(j) another similar entity or combination of entities acting in concert. - Premium: includes , however designated:
(156)(b)(i) an assessment;(156)(b)(ii) a membership fee;(156)(b)(iii) a required contribution; or(156)(b)(iv) monetary consideration. See Utah Code 31A-1-301- Public programs: means the state Medicaid program in Title 26B, Chapter 3, Health Care - Administration and Assistance, and Title 26B, Chapter 3, Part 9, Utah Children's Health Insurance Program. (2) The examination described in Subsection (1) shall reasonably relate to:(2)(a) the duties and functions of a navigator;(2)(b) requirements for navigators as established by federal regulation under PPACA; and(2)(c) other requirements that may be established by the commissioner by administrative rule.(3) The examination may be administered by the commissioner or as otherwise specified by administrative rule.(4) The training required by Subsection (1) shall be approved by the commissioner and shall include:(4)(a) accident and health insurance plans;(4)(b) qualifications for and enrollment in public programs;(4)(c) qualifications for and enrollment in premium subsidies;(4)(d) cultural and linguistic competence;(4)(e) conflict of interest standards;(4)(f) exchange functions; and(4)(g) other requirements that may be adopted by the commissioner by administrative rule.(5)(5)(a) For the navigator line of authority, the training required by Subsection (1) shall consist of at least 21 credit hours of training before obtaining the license, which shall include the navigator training and certification program developed by the Centers for Medicare and Medicaid Services.(5)(b) For the certified application counselor line of authority, the training required by Subsection (1) shall consist of at least six hours of training before obtaining a license, which shall include the certified application counselor training and certification program developed by the Centers for Medicare and Medicaid Services.(6) This section applies only to an applicant who is a natural person. - Insurance: includes :
