(1) For all proceedings authorized by this chapter, the commission may issue a subpoena to:

Terms Used In Utah Code 63A-14-704

  • Commission: means the Independent Executive Branch Ethics Commission, created in Section 63A-14-202. See Utah Code 63A-14-102
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Subpoena: A command to a witness to appear and give testimony.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
     (1)(a) require the attendance of a witness; or
     (1)(b) direct the production of evidence.
(2) The commission shall issue a subpoena under this section:

     (2)(a) as required under Section 63A-14-706;
     (2)(b) at the direction of the chair, if the chair determines that the testimony or evidence is relevant to the review of a complaint; or
     (2)(c) upon a vote of a majority of the commission members.
