(1) The department may bring a civil action to enjoin a person subject to this title from:

Terms Used In Utah Code 70C-8-107

  • department: means the Department of Financial Institutions. See Utah Code 70C-8-101
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
     (1)(a) making or enforcing a term of consumer credit transactions that is unconscionable;
     (1)(b) engaging in fraudulent conduct in inducing consumers to enter into a consumer credit transaction; or
     (1)(c) engaging in conduct of the type specified in Subsection (1)(a) or (b) with respect to a transaction that gives rise to or leads a person to believe will give rise to a consumer credit transaction.
(2) An action brought pursuant to this section is subject to the requirements of Utah Rules of Civil Procedure, Rule 65A.
