(1) The department may bring a civil action to enjoin a person subject to this title from:
Terms Used In Utah Code 70C-8-107
- department: means the Department of Financial Institutions. See Utah Code 70C-8-101
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5(1)(a) making or enforcing a term of consumer credit transactions that is unconscionable;(1)(b) engaging in fraudulent conduct in inducing consumers to enter into a consumer credit transaction; or(1)(c) engaging in conduct of the type specified in Subsection
(1)(a) or(b) with respect to a transaction that gives rise to or leads a person to believe will give rise to a consumer credit transaction.
(2) An action brought pursuant to this section is subject to the requirements of Utah Rules of Civil Procedure, Rule 65A.
