The provisions of this code shall be construed in accordance with these general purposes.

Terms Used In Utah Code 76-1-104
- Conduct: means an act or omission. See Utah Code 76-1-101.5
- Offense: means a violation of any penal statute of this state. See Utah Code 76-1-101.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5

Define adequately the conduct and mental state which constitute each offense and safeguard conduct that is without fault from condemnation as criminal. |

Prescribe penalties which are proportionate to the seriousness of offenses and which permit recognition or differences in rehabilitation possibilities among individual offenders. |

Prevent arbitrary or oppressive treatment of persons accused or convicted of offenses. |
