(1)  There is created within the department the Main Street Program Advisory Committee.

Terms Used In Utah Code 9-24-103

  • Advisory committee: means the Utah Main Street Advisory Committee created in Section 9-24-103. See Utah Code 9-24-101
  • Department: means the Department of Cultural and Community Engagement. See Utah Code 9-1-102
  • Executive director: means the executive director of the Department of Cultural and Community Engagement. See Utah Code 9-1-102
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Program: means the Utah Main Street Program created in Section 9-24-102. See Utah Code 9-24-101
  • Quorum: The number of legislators that must be present to do business.
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2)  The advisory committee is composed of the following members appointed by the executive director:

(a)  a representative of the department who provides administrative oversight of the program;

(b)  two representatives of the Governor’s Office of Economic Opportunity, one of whom is involved in tourism development;

(c)  a representative of the State Historic Preservation Office;

(d)  a representative of the Department of Transportation;

(e)  a representative of the Housing and Community Development Division within the Department of Workforce Services;

(f)  a representative from a local association of governments;

(g)  a representative from the private sector involved in a local main street program;

(h)  a representative of a local main street program; and

(i)  three representatives from various entities that have an interest or expertise in assisting local main street programs.

(3)  The advisory committee shall advise and make recommendations to the department regarding:

(a)  the eligibility of applicants for designation as a local main street program;

(b)  financial assistance requests from designated local main street programs; and

(c)  improving the effectiveness of the program.

(4) 

(a)  Except as provided under Subsection (4)(b), each member of the advisory committee appointed under Subsections (2)(f) through (i) shall be appointed for a four-year term.

(b)  The executive director, at the time of appointment or reappointment, may adjust the length of terms to ensure that the terms of approximately half of the members of the advisory committee appointed under Subsections (2)(f) through (i) end every two years.

(5)  The representative of the department appointed under Subsection (2)(a) shall serve as chair of the advisory committee.

(6)  When a vacancy occurs in the membership for any reason, the executive director shall appoint a replacement member.

(7)  A majority of the advisory committee constitutes a quorum for the purpose of conducting advisory committee business and the action of a majority of a quorum constitutes the action of the advisory committee.

(8)  A member may not receive compensation or benefits for the member’s service, but a member may receive per diem and travel expenses in accordance with:

(a)  Section 63A-3-106;

(b)  Section 63A-3-107; and

(c)  rules made by the Division of Finance pursuant to Sections 63A-3-106 and 63A-3-107.
