Terms Used In Utah Code > Title 26A > Chapter 1 - Local Health Departments

  • absent: means the failure of a school-age child assigned to a class or class period to attend a class or class period. See Utah Code 53G-6-201
  • Address: includes :
    (i) a post office box number;
    (ii) a rural free delivery route number; and
    (iii) a street name and number. See Utah Code 16-10a-102
  • Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Allegation: something that someone says happened.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appeals panel: means the appeals panel created in Section 53G-7-1106. See Utah Code 53G-7-1101
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Armed forces: means the United States Army, Navy, Air Force, Marine Corps, Space Force, and Coast Guard. See Utah Code 68-3-12.5
  • Association: means an organization that governs or regulates a student's participation in an athletic interscholastic activity. See Utah Code 53G-7-1101
  • Association: means an organization that governs or regulates a student's participation in an athletic activity. See Utah Code 53G-7-801 v2
  • Athletic activity: means physical education instruction or a sports event that is:
    (a) sponsored or regulated by an association or educational organization; or
    (b) authorized to take place in an association's or educational organization's facilities. See Utah Code 53G-7-801 v2
  • Athletic association: means an association, as that term is defined in Section 53G-7-1101. See Utah Code 53G-6-1001
  • Athletic uniform: means clothing, headwear, shoes, or other items worn for participation in an athletic activity that are required to be:
    (a) a specified style, length, material, or color;
    (b) worn in a specified manner; or
    (c) worn with or without other items of clothing or headwear. See Utah Code 53G-7-801 v2
  • Audit committee: means a standing committee:
    (a) appointed by the local school board or charter school governing board with the following number of members as applicable to the local school board or charter school governing board:
    (i) for a board of a local education agency that consists of seven or more members, three members of that board; or
    (ii) for a board of a local education agency that consists of six or fewer members, two members of that board; and
    (b) composed of people who are not administrators or employees of the local education agency. See Utah Code 53G-7-401
  • Audit director: means the person who directs the internal audit program. See Utah Code 53G-7-401
  • Authority: means the Utah Charter School Finance Authority created by this part. See Utah Code 53G-5-601
  • authorizer: means an entity listed in Section 53G-5-205 that authorizes a charter school. See Utah Code 53G-5-102
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Bigotry: means action or advocacy of imminent action involving:
    (a) the harassment or denigration of a person or entity; or
    (b) any intent to cause a person not to freely enjoy or exercise any right secured by the constitution or laws of the United States or the state, except that an evaluation or prohibition may not be made of the truth or falsity of any religious belief or expression of conscience unless the means of expression or conduct arising therefrom violates the standards of conduct outlined in this section, Section 53G-10-203, or 20 U. See Utah Code 53G-7-701
  • Birth certificate: means an official record of an individual's date of birth, place of birth, sex, and parentage, including a supplementary certificate of birth or birth certificate amendment and amendment history as provided in Sections 26-2-10 and 26-2-11. See Utah Code 53G-6-1001
  • Board: means the governing board of the authority described in Section 53G-5-602. See Utah Code 53G-5-601
  • Board: means a local board of health established under Section 26A-1-109. See Utah Code 26A-1-102
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Charter school: means a school created under this chapter. See Utah Code 53G-5-601
  • City: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Classification: means the designation of a school based on the size of the school's student enrollment population for purposes of interscholastic activities. See Utah Code 53G-7-1101
  • Club: means any student organization that meets during noninstructional time. See Utah Code 53G-7-701
  • Co-curricular activity: means an activity, a course, or a program that:
    (a) is an extension of a curricular activity;
    (b) is included in an instructional plan and supervised or conducted by a teacher or education professional;
    (c) is conducted outside of regular school hours;
    (d) is provided, sponsored, or supported by an LEA; and
    (e) includes a required regular school day activity, course, or program. See Utah Code 53G-7-501
  • Commission: means the School Activity Eligibility Commission created in Section 53G-6-1003. See Utah Code 53G-6-1001
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Conscience: means a standard based upon learned experiences, a personal philosophy or system of belief, religious teachings or doctrine, an absolute or external sense of right and wrong which is felt on an individual basis, a belief in an external absolute, or any combination of the foregoing. See Utah Code 53G-7-701
  • Contract: A legal written agreement that becomes binding when signed.
  • Cooperating employer: means a public or private entity which, as part of a work experience or career exploration program offered through a school, provides interns with educational resources, training, and work experience in activities related to the entity's ongoing business activities. See Utah Code 53G-7-901
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • County executive: means :Utah Code 68-3-12.5
  • County governing body: means one of the types of county government provided for in 2. See Utah Code 26A-1-102
  • County health department: means a local health department that serves a county and municipalities located within that county. See Utah Code 26A-1-102
  • County legislative body: means :Utah Code 68-3-12.5
  • Credit enhancement program: means the Charter School Credit Enhancement Program established in Section 53G-5-606. See Utah Code 53G-5-601
  • Curricular activity: means an activity, a course, or a program that is:
    (a) intended to deliver instruction;
    (b) provided, sponsored, or supported by an LEA; and
    (c) conducted only during school hours. See Utah Code 53G-7-501
  • Curricular club: means a club that is school sponsored and that may receive leadership, direction, and support from the school or school district beyond providing a meeting place during noninstructional time. See Utah Code 53G-7-701
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Debt service reserve fund: means the reserve fund created or established by, or for the benefit of, a qualifying charter school for the purpose of paying principal of and interest on bonds issued under the credit enhancement program as the payments become due and other money of the qualifying charter school is not available to make the payments. See Utah Code 53G-5-601
  • Debt service reserve fund requirement: means , as of a particular date of computation, and with respect to a particular issue of bonds, the amount required to be on deposit in the debt service reserve fund, which amount:
    (a) may be a sum certain or as set forth in a formula; and
    (b) may not be less than the maximum annual debt service requirement for the related bonds. See Utah Code 53G-5-601
  • Deliver: includes delivery by mail or another means of transmission authorized by Section 16-10a-103, except that delivery to the division means actual receipt by the division. See Utah Code 16-10a-102
  • Department: means the Department of Health and Human Services created in Section 26B-1-201. See Utah Code 26A-1-102
  • Dependent: A person dependent for support upon another.
  • Discretionary time: includes free time before and after school, during lunch and between classes or on buses, and private time before athletic and other events or activities. See Utah Code 53G-7-701
  • Division: means the Criminal Investigations and Technical Services Division of the Department of Public Safety, established in Section 53-10-103. See Utah Code 53G-6-601
  • Does not correspond with the sex designation: means that a student's sex designation for an interscholastic activity in which a student seeks participation does not correspond with the sex designation on the student's birth certificate or an amendment, including the amendment history, to the student's birth certificate that the Division of Vital Records and Statistics provides. See Utah Code 53G-6-1001
  • Educational neglect: means the same as that term is defined in Section 80-1-102. See Utah Code 53G-6-201
  • Educational organization: means :
    (a) the state board;
    (b) an LEA; or
    (c) a school sports team. See Utah Code 53G-7-801 v2
  • Elementary school: means a school that provides instruction to students in grades kindergarten, 1, 2, 3, 4, 5, or 6. See Utah Code 53G-7-501
  • Eligibility: means eligibility to participate in an interscholastic activity regulated or governed by an association. See Utah Code 53G-7-1101
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Extracurricular activity: means an activity, a course, or a program that is:
    (i) not directly related to delivering instruction;
    (ii) not a curricular activity or co-curricular activity; and
    (iii) provided, sponsored, or supported by an LEA. See Utah Code 53G-7-501
  • Federal law: means :
    (a) a statute passed by the Congress of the United States; or
    (b) a final regulation:
    (i) adopted by an administrative agency of the United States government; and
    (ii) published in the code of federal regulations or the federal register. See Utah Code 53G-6-801
  • Fee: includes :
    (i) money or something of monetary value raised by a student or the student's family through fundraising;
    (ii) charges or expenditures for a school field trip or activity trip, including related transportation, food, lodging, and admission charges;
    (iii) payments made to a third party that provides a part of a school activity, class, or program;
    (iv) charges or expenditures for classroom:
    (A) textbooks;
    (B) supplies; or
    (C) materials;
    (v) charges or expenditures for school activity clothing; and
    (vi) a fine other than a fine described in Subsection (6)(c)(i). See Utah Code 53G-7-501
  • Fee: means the same as that term is defined in Section 53G-7-501. See Utah Code 53G-7-601
  • Fiduciary: A trustee, executor, or administrator.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fundraising: means an activity or event provided, sponsored, or supported by an LEA that uses students to generate funds or raise money to:
    (i) provide financial support to a school or a school's class, group, team, or program; or
    (ii) benefit a particular charity or for other charitable purposes. See Utah Code 53G-7-501
  • Gender identity: means the same as that term is defined in Section 34A-5-102. See Utah Code 53G-6-1001
  • Gender-designated: means that an interscholastic activity or facility is designated specifically for female or male students. See Utah Code 53G-6-1001
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Governing body: means a body within an association that:
    (a) is responsible for:
    (i) adopting standards or policies that govern interscholastic activities or the administration of the association;
    (ii) adopting or amending the association's governing document or bylaws;
    (iii) enforcing the standards and policies of the association; and
    (iv) adopting the association's budget; and
    (b) has oversight of other boards, committees, councils, or bodies within the association. See Utah Code 53G-7-1101
  • Grantor: The person who establishes a trust and places property into it.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guardian: includes a person who:Utah Code 68-3-12.5
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Instructional equipment: includes :
    (i) shears or styling tools;
    (ii) a band instrument;
    (iii) a camera;
    (iv) a stethoscope; or
    (v) sports equipment, including a bat, mitt, or tennis racquet. See Utah Code 53G-7-601
  • Instructional time: includes instructional activities in the classroom or study hall during regularly scheduled hours, required activities outside the classroom, and counseling, private conferences, or tutoring provided by school employees or volunteers acting in their official capacities during or outside of regular school hours. See Utah Code 53G-7-701
  • Intern: means a student enrolled in a school-sponsored work experience and career exploration program under Section 53G-7-902 involving both classroom instruction and work experience with a cooperating employer, regardless of whether the student receives compensation. See Utah Code 53G-7-901
  • Internal audit: means an independent appraisal activity established within a local education agency as a control system to examine and evaluate the adequacy and effectiveness of other internal control systems within the local education agency. See Utah Code 53G-7-401
  • Internal audit program: means an audit function that:
    (a) is conducted by a local school board or charter school governing board independent of the local education agency offices or other operations;
    (b) objectively evaluates the effectiveness of the local education agency governance, risk management, internal controls, and the efficiency of operations; and
    (c) is conducted in accordance with the current:
    (i) International Standards for the Professional Practice of Internal Auditing; or
    (ii) The Government Auditing Standards, issued by the Comptroller General of the United States. See Utah Code 53G-7-401
  • Internship: means the work experience segment of an intern's school-sponsored work experience and career exploration program, performed under the direct supervision of a cooperating employer. See Utah Code 53G-7-901
  • Internship safety agreement: means the agreement between a public or private school and a cooperating employer in accordance with Section 53G-7-904. See Utah Code 53G-7-901
  • Interscholastic activity: means an activity within the state in which:
    (a) a student that participates represents the student's school in the activity; and
    (b) the participating student is enrolled in grade 9, 10, 11, or 12. See Utah Code 53G-7-1101
  • Interscholastic activity: means an activity in which a student represents the student's school in the activity in competition against another school. See Utah Code 53G-6-1001
  • Interscholastic athletic activity: means that a student represents the student's school or LEA in competition against another school or LEA in an athletic or sporting activity. See Utah Code 53G-6-901
  • Joint resolution: A legislative measure which requires the approval of both chambers.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Land: includes :Utah Code 68-3-12.5
  • LEA distribution: means the money distributed by the state board to an LEA as described in Section 53G-7-1303. See Utah Code 53G-7-1301
  • LEA governing board: means a local school board or charter school governing board. See Utah Code 53G-7-701
  • LEA governing board student success framework: means an LEA governing board student success framework described in Section 53G-7-1304. See Utah Code 53G-7-1301
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Limited open forum: means a forum created by a school district or charter school for student expression within the constraints of Subsection 53G-10-203(2)(b). See Utah Code 53G-7-701
  • Local education agency: means a school district or charter school. See Utah Code 53G-7-401
  • Local health department: means :
    (a) a single county local health department;
    (b) a multicounty local health department;
    (c) a united local health department; or
    (d) a multicounty united local health department. See Utah Code 26A-1-102
  • Mental health authority: means a local mental health authority created in Section 17-43-301. See Utah Code 26A-1-102
  • Minor: means an individual who is under 18 years old. See Utah Code 53G-6-201
  • Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
  • Multicounty local health department: means a local health department that is formed under Section 26A-1-105 and that serves two or more contiguous counties and municipalities within those counties. See Utah Code 26A-1-102
  • Multicounty united local health department: means a united local health department that is formed under Section 26A-1-105. See Utah Code 26A-1-102
  • Noncurricular club: is a student initiated group that may be authorized and allowed school facilities use during noninstructional time in secondary schools by a school and LEA governing board in accordance with the provisions of this part. See Utah Code 53G-7-701
  • Noninstructional time: means time set aside by a school before instructional time begins or after instructional time ends, including discretionary time. See Utah Code 53G-7-701
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Order of constraint: includes a stay-at-home order. See Utah Code 26A-1-102
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Parent: includes :
    (a) a custodial parent of the minor;
    (b) a legally appointed guardian of a minor; or
    (c) any other person purporting to exercise any authority over the minor which could be exercised by a person described in Subsection (4)(a) or (b). See Utah Code 53G-6-201
  • Person: means :Utah Code 68-3-12.5
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Principal: means the chief administrator at a school, including:
    (a) a school principal;
    (b) a charter school director; or
    (c) the superintendent of the Utah Schools for the Deaf and the Blind. See Utah Code 53G-7-1301
  • Principal: includes the chief administrator of a school that does not have a principal. See Utah Code 53G-7-801
  • Private school: means a school serving any of grades 7 through 12 which is not part of the public education system. See Utah Code 53G-7-901
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • program: means the Teacher and Student Success Program described in this part. See Utah Code 53G-7-1301
  • Project: means :
    (a) any building, structure, or property owned, to be acquired, or used by a charter school for any of its educational purposes and the related appurtenances, easements, rights-of-way, improvements, paving, utilities, landscaping, parking facilities, and lands; or
    (b) any capital equipment owned, to be acquired, or used by a charter school for any of its educational purposes, interests in land, and grounds, together with the personal property necessary, convenient, or appurtenant to them. See Utah Code 53G-5-601
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Public health emergency: means the same as that term is defined in Section 26B-7-301. See Utah Code 26A-1-102
  • Public hearing: means a hearing at which members of the public are provided a reasonable opportunity to comment on the subject of the hearing. See Utah Code 53G-7-1101
  • Public school: means :
    (a) a public school district;
    (b) an applied technology center or applied technology service region;
    (c) the Schools for the Deaf and the Blind; or
    (d) other components of the public education system authorized by the state board to offer internships. See Utah Code 53G-7-901
  • Qualifying charter school: means a charter school that:
    (a) meets standards adopted by the authority for participation in the credit enhancement program; and
    (b) is designated by the authority as a qualifying charter school for purposes of participation in the credit enhancement program. See Utah Code 53G-5-601
  • Quorum: The number of legislators that must be present to do business.
  • realignment: means the initial or subsequent act, respectively, of assigning a public school a classification or region. See Utah Code 53G-7-1101
  • Reasonably accommodate: means an LEA shall make its best effort to enable a parent to exercise a parental right specified in Section 53G-6-803:
    (a) without substantial impact to staff and resources, including employee working conditions, safety and supervision on school premises and for school activities, and the efficient allocation of expenditures; and
    (b) while balancing:
    (i) the parental rights of parents;
    (ii) the educational needs of other students;
    (iii) the academic and behavioral impacts to a classroom;
    (iv) a teacher's workload; and
    (v) the assurance of the safe and efficient operation of a school. See Utah Code 53G-6-801
  • Region: means a grouping of schools of the same classification for purposes of interscholastic activities. See Utah Code 53G-7-1101
  • Religious club: means a noncurricular club designated in its application as either being religiously based or based on expression or conduct mandated by conscience. See Utah Code 53G-7-701
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Reserve account: means the Charter School Reserve Account created in Section 53F-9-303. See Utah Code 53G-5-601
  • School: means a public school, including a charter school. See Utah Code 53G-7-701
  • School: means a public school, including a charter school. See Utah Code 53G-7-801
  • School activity clothing: means special shoes or items of clothing:
    (i) 
    (A) that meet specific requirements, including requesting a specific brand, fabric, or imprint; and
    (B) that a school requires a student to provide; and
    (ii) that is worn by a student for a co-curricular or extracurricular activity. See Utah Code 53G-7-501
  • School allocation: means the amount of money allocated to a school or the Utah Schools for the Deaf and the Blind by an LEA governing board, as described in Section 53G-7-1304. See Utah Code 53G-7-1301
  • School day: means the portion of a day that school is in session in which a school-age child is required to be in school for purposes of receiving instruction. See Utah Code 53G-6-201
  • School equipment: includes a saw or 3D printer. See Utah Code 53G-7-601
  • School facilities use: includes access to a limited open forum. See Utah Code 53G-7-701
  • School personnel: means an individual who:
    (a) is employed by an LEA; and
    (b) in an academic role, works directly with and supports students in a school. See Utah Code 53G-7-1301
  • School uniform: means special shoes or an item of clothing:
    (i) 
    (A) that meet specific requirements, including a requested specific color, style, fabric, or imprint; and
    (B) that a school requires a student to provide; and
    (ii) that is worn by a student for a curricular activity. See Utah Code 53G-7-501
  • School uniform: means the same as that term is defined in Section 53G-7-501. See Utah Code 53G-7-801
  • School year: means the period of time designated by a local school board or charter school governing board as the school year for the school where the school-age child:
    (a) is enrolled; or
    (b) should be enrolled, if the school-age child is not enrolled in school. See Utah Code 53G-6-201
  • School-age child: means a minor who:
    (a) is at least six years old but younger than 18 years old; and
    (b) is not emancipated. See Utah Code 53G-6-201
  • Secondary school: means a school that provides instruction to students in grades 7, 8, 9, 10, 11, or 12. See Utah Code 53G-7-501
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sex: means the biological, physical condition of being male or female, determined by an individual's genetics and anatomy at birth. See Utah Code 53G-6-901
  • Shareholder: means :
    (i) the person in whose name a share is registered in the records of a corporation; or
    (ii) the beneficial owner of a share to the extent recognized pursuant to Section 16-10a-723. See Utah Code 16-10a-102
  • Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
  • Single county local health department: means a local health department that is created by the governing body of one county to provide services to the county and the municipalities within that county. See Utah Code 26A-1-102
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • State registrar: means the State Registrar of Vital Statistics within the Department of Health and Human Services. See Utah Code 53G-6-601
  • Statute: A law passed by a legislature.
  • Stay-at-home order: means an order of constraint that:
    (a) restricts movement of the general population to suppress or mitigate an epidemic or pandemic disease by directing individuals within a defined geographic area to remain in their respective residences; and
    (b) may include exceptions for certain essential tasks. See Utah Code 26A-1-102
  • Student: means a student who is enrolled in a public school that participates in interscholastic activities. See Utah Code 53G-6-1001
  • Substance abuse authority: means a local substance abuse authority created in Section 17-43-201. See Utah Code 26A-1-102
  • success plan: means a school performance and student academic achievement improvement plan described in Section 53G-7-1305. See Utah Code 53G-7-1301
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Textbook: includes :
    (i) a hardcopy book or printed pages of instructional material, including a consumable workbook; or
    (ii) computer hardware, software, or digital content. See Utah Code 53G-7-601
  • Town: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Truant: means a condition in which a school-age child, without a valid excuse, and subject to Subsection (8)(b), is absent for at least:
    (i) half of the school day; or
    (ii) if the school-age child is enrolled in a learner verified program, as that term is defined by the state board, the relevant amount of time under the LEA's policy regarding the LEA's continuing enrollment measure as it relates to truancy. See Utah Code 53G-6-201
  • Truant minor: means a school-age child who:
    (a) is subject to the requirements of Section 53G-6-202 or 53G-6-203; and
    (b) is truant. See Utah Code 53G-6-201
  • Uniformed services: means :Utah Code 68-3-12.5
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • Utah Code: means the 1953 recodification of the Utah Code, as amended, unless the text expressly references a portion of the 1953 recodification of the Utah Code as it existed:Utah Code 68-3-12.5
  • Valid excuse: means :
    (i) an illness, which may be either mental or physical, regardless of whether the school-age child or parent provides documentation from a medical professional;
    (ii) mental or behavioral health of the school-age child;
    (iii) a family death;
    (iv) an approved school activity;
    (v) an absence permitted by a school-age child's:
    (A) individualized education program; or
    (B) Section 504 accommodation plan;
    (vi) an absence permitted in accordance with Subsection 53G-6-803(5); or
    (vii) any other excuse established as valid by a local school board, charter school governing board, or school district. See Utah Code 53G-6-201
  • Veteran: means an individual who:Utah Code 68-3-12.5
  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
  • Waiver: means a full or partial release from a requirement to pay a fee and from any provision in lieu of fee payment. See Utah Code 53G-7-501
