Terms Used In Utah Code > Title 31A > Chapter 43 > Part 1 - General Provisions
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
- Contract: A legal written agreement that becomes binding when signed.
- Division: means the Division of Forestry, Fire, and State Lands. See Utah Code 65A-1-1
- Individual: means a natural person. See Utah Code 31A-1-301
- Insurance: includes :
(i) a risk distributing arrangement providing for compensation or replacement for damages or loss through the provision of a service or a benefit in kind; (ii) a contract of guaranty or suretyship entered into by the guarantor or surety as a business and not as merely incidental to a business transaction; and (iii) a plan in which the risk does not rest upon the person who makes an arrangement, but with a class of persons who have agreed to share the risk. - Member: means a person having membership rights in an insurance corporation. See Utah Code 31A-1-301
- Person: means :Utah Code 68-3-12.5
- Plan year: means :
(a) the year that is designated as the plan year in: (i) the plan document of a group health plan; or (ii) a summary plan description of a group health plan; (c) in a case not described in Subsection (144)(a) or (b), the calendar year. See Utah Code 31A-1-301 - Policy: includes a service contract issued by:
(i) a motor club under Chapter 11, Motor Clubs; (ii) a service contract provided under Chapter 6a, Service Contracts; and (iii) a corporation licensed under: (A) Chapter 7, Nonprofit Health Service Insurance Corporations; or (B) Chapter 8, Health Maintenance Organizations and Limited Health Plans. See Utah Code 31A-1-301 - Premium: includes , however designated:
(i) an assessment; (ii) a membership fee; (iii) a required contribution; or (iv) monetary consideration. See Utah Code 31A-1-301 - Property: includes both real and personal property. See Utah Code 68-3-12.5
- Restoration project: means a project for the comprehensive restoration of Utah Lake, as provided in this chapter. See Utah Code 65A-15-102
- Restoration proposal: means a proposal submitted to the division for a restoration project. See Utah Code 65A-15-102
- Small employer: means , in connection with a health benefit plan and with respect to a calendar year and to a plan year, an employer who:
(i) (A) employed at least one but not more than 50 eligible employees on business days during the preceding calendar year; or (B) if the employer did not exist for the entirety of the preceding calendar year, reasonably expects to employ an average of at least one but not more than 50 eligible employees on business days during the current calendar year; (ii) employs at least one employee on the first day of the plan year; and (iii) for an employer who has common ownership with one or more other employers, is treated as a single employer under 26 U. - State lands: means all lands administered by the division. See Utah Code 65A-1-1
