Terms Used In Utah Code > Title 4 > Chapter 41

  • Agricultural crops: means any product of cultivation;
    (2) "Board" means the Agricultural and Wildlife Damage Prevention Board;
    (3) "Bounty" means the monetary compensation paid to persons for the harvest of predatory or depredating animals;
    (4) "Damage" means any injury or loss to livestock, poultry, agricultural crops, or wildlife inflicted by predatory or depredating animals or depredating birds;
    (5) "Depredating animal" means a field mouse, gopher, ground squirrel, jack rabbit, raccoon, or prairie dog;
    (6) "Depredating bird" means a Brewer's blackbird or starling;
    (7) "Livestock" means cattle, horses, mules, sheep, goats, and swine;
    (8) "Predatory animal" means any coyote; and
    (9) "Wildlife" means any form of animal life generally living in a state of nature, except a predatory animal or a depredating animal or bird. See Utah Code 4-41-104
  • Agriculture: means the science and art of the production of plants and animals useful to man, including the preparation of plants and animals for human use and disposal by marketing or otherwise. See Utah Code 4-7-110
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appropriation: means an allocation of money by the board of trustees for a specific purpose. See Utah Code 17B-1-601
  • Bond: means :
    (a) a written obligation to repay borrowed money, whether denominated a bond, note, warrant, certificate of indebtedness, or otherwise; and
    (b) a lease agreement, installment purchase agreement, or other agreement that:
    (i) includes an obligation by the district to pay money; and
    (ii) the district's board of trustees, in its discretion, treats as a bond for purposes of Title 11, Chapter 14, Local Government Bonding Act, or Title 11, Chapter 27, Utah Refunding Bond Act. See Utah Code 17B-1-102
  • Branch: means a place of business of a financial institution, other than its main office, at which deposits are received and paid. See Utah Code 7-1-103
  • Budget: means a plan of financial operations for a fiscal year which embodies estimates of proposed expenditures for given purposes and the proposed means of financing them, and may refer to the budget of a particular fund for which a budget is required by law or it may refer collectively to the budgets for all such funds. See Utah Code 17B-1-601
  • Budget officer: means the person appointed by the local district board of trustees to prepare the budget for the district. See Utah Code 17B-1-601
  • Budget year: means the fiscal year for which a budget is prepared. See Utah Code 17B-1-601
  • Cannabidiol product: means a chemical compound extracted from a hemp product that:
    (a) is processed into a medicinal dosage form; and
    (b) contains less than 0. See Utah Code 4-41-102
  • Commission: means the Utah Dairy Commission. See Utah Code 4-22-102
  • Commissioner: means the commissioner of agriculture and food. See Utah Code 4-7-110
  • Commissioner: means the Commissioner of Financial Institutions. See Utah Code 7-1-103
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Dealer: means any person who buys and processes raw milk or milk fat, or who acts as agent in the sale or purchase of raw milk or milk fat, or who acts as a broker or factor with respect to raw milk or milk fat or any product derived from either. See Utah Code 4-22-102
  • Department: means the Department of Agriculture and Food created in Chapter 2, Administration. See Utah Code 4-7-110
  • Department: means the Department of Financial Institutions. See Utah Code 7-1-103
  • Department: means the Department of Health created in Section 26-1-4. See Utah Code 17-27a-509
  • Depository institution: means a bank, savings and loan association, savings bank, industrial bank, credit union, or other institution that:
    (a) holds or receives deposits, savings, or share accounts;
    (b) issues certificates of deposit; or
    (c) provides to its customers other depository accounts that are subject to withdrawal by checks, drafts, or other instruments or by electronic means to effect third party payments. See Utah Code 7-1-103
  • Depository institution holding company: means :
    (i) a person other than an individual that:
    (A) has control over a depository institution; or
    (B) becomes a holding company of a depository institution under Section 7-1-703; or
    (ii) a person other than an individual that the commissioner finds, after considering the specific circumstances, is exercising or is capable of exercising a controlling influence over a depository institution by means other than those specifically described in this section. See Utah Code 7-1-103
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Financial officer: means the official under Section 17B-1-642. See Utah Code 17B-1-601
  • Fiscal year: means the annual period for accounting for fiscal operations in each district. See Utah Code 17B-1-601
  • Fund: has the meaning given under generally accepted accounting principles as reflected in the Uniform Accounting Manual for Local Districts. See Utah Code 17B-1-601
  • Fund balance: has the meaning given under generally accepted accounting principles as reflected in the Uniform Accounting Manual for Local Districts. See Utah Code 17B-1-601
  • General fund: is a s defined by the Governmental Accounting Standards Board as reflected in the Uniform Accounting Manual for All Local Governments prepared by the Office of the Utah State Auditor. See Utah Code 17B-1-601
  • Governmental funds: means the general fund, special revenue fund, debt service fund, and capital projects fund of a local district. See Utah Code 17B-1-601
  • Home state: means :
    (a) for a state chartered depository institution, the state that charters the institution;
    (b) for a federally chartered depository institution, the state where the institution's main office is located; and
    (c) for a depository institution holding company, the state in which the total deposits of all depository institution subsidiaries are the largest. See Utah Code 7-1-103
  • Industrial hemp: means any part of a cannabis plant, whether growing or not, with a concentration of less than 0. See Utah Code 4-41-102
  • Industrial hemp certificate: means a certificate issued by the department to a higher education institution to grow or cultivate industrial hemp under Subsection 4-41-103(1). See Utah Code 4-41-102
  • Industrial hemp license: means a license issued by the department to a person for the purpose of participating in a research pilot program. See Utah Code 4-41-102
  • Industrial hemp product: means a product derived from, or made by, processing industrial hemp plants or industrial hemp parts. See Utah Code 4-41-102
  • Institution: means :
    (a) a corporation;
    (b) a limited liability company;
    (c) a partnership;
    (d) a trust;
    (e) an association;
    (f) a joint venture;
    (g) a pool;
    (h) a syndicate;
    (i) an unincorporated organization; or
    (j) any form of business entity. See Utah Code 7-1-103
  • Intellectual disability: means a significant, subaverage general intellectual functioning that:Utah Code 48-2e-1156
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Interfund loan: means a loan of cash from one fund to another, subject to future repayment. See Utah Code 17B-1-601
  • Intermediate care facility for people with an intellectual disability: means an intermediate care facility for the mentally retarded, as defined in Title XIX of the Social Security Act. See Utah Code 48-2e-1156
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Land: includes :Utah Code 48-2e-1156
  • Licensee: means an individual or business entity possessing a license issued by the department under this chapter to grow, cultivate, process, or market industrial hemp or an industrial hemp product. See Utah Code 4-41-102
  • Livestock: means cattle, sheep, goats, swine, horses, mules, poultry, domesticated elk as defined in Section 4-39-102, or any other domestic animal or domestic furbearer raised or kept for profit. See Utah Code 4-7-110
  • Local district: means a limited purpose local government entity, as described in Section 17B-1-103, that operates under, is subject to, and has the powers set forth in:
    (a) this chapter; or
    (i) this chapter; and
    (A) Chapter 2a, Part 1, Cemetery Maintenance District Act;
    (B) Chapter 2a, Part 2, Drainage District Act;
    (C) Chapter 2a, Part 3, Fire Protection District Act;
    (D) Chapter 2a, Part 4, Improvement District Act;
    (E) Chapter 2a, Part 5, Irrigation District Act;
    (F) Chapter 2a, Part 6, Metropolitan Water District Act;
    (G) Chapter 2a, Part 7, Mosquito Abatement District Act;
    (H) Chapter 2a, Part 8, Public Transit District Act;
    (I) Chapter 2a, Part 9, Service Area Act;
    (J) Chapter 2a, Part 10, Water Conservancy District Act; or
    (K) Chapter 2a, Part 11, Municipal Services District Act. See Utah Code 17B-1-102
  • Local district general fund: means the general fund used by a local district. See Utah Code 17B-1-601
  • Medicinal dosage form: means :
    (a) a tablet;
    (b) a capsule;
    (c) a concentrated oil;
    (d) a sublingual preparation;
    (e) a topical preparation;
    (f) a transdermal preparation;
    (g) a gelatinous cube, gelatinous rectangular cuboid, or lozenge in a cube or rectangular cuboid shape; or
    (h) other preparations that the department approves. See Utah Code 4-41-102
  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
  • Month: means a calendar month, unless otherwise expressed. See Utah Code 48-2e-1156
  • Nursing care facility: means :
    (i) a nursing care facility described in Subsection 26-21-2(17);
    (ii) beginning January 1, 2006, a designated swing bed in:
    (A) a general acute hospital as defined in Subsection 26-21-2(11); and
    (B) a critical access hospital which meets the criteria of 42 U. See Utah Code 17B-1-626
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Organization: means a corporation, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, two or more persons having a joint or common interest, or any other legal entity. See Utah Code 4-7-110
  • Outlays: Outlays are payments made (generally through the issuance of checks or disbursement of cash) to liquidate obligations. Outlays during a fiscal year may be for payment of obligations incurred in prior years or in the same year.
  • Package: means a commodity put up or packaged before sale in either wholesale or retail saleunits. See Utah Code 4-22-101
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Patient day: means each calendar day in which an individual patient is admitted to the nursing care facility during a calendar month, even if on a temporary leave of absence from the facility. See Utah Code 17B-1-626
  • Person: means a natural person or individual, corporation, organization, or other legal entity. See Utah Code 4-7-110
  • Person: means :
    (a) an individual, partnership, association, firm, trust, limited liability company, or corporation; and
    (b) an agent or employee of an individual, partnership, association, firm, trust, limited liability company, or corporation. See Utah Code 4-41-102
  • Person: means :
    (a) an individual;
    (b) a corporation;
    (c) a limited liability company;
    (d) a partnership;
    (e) a trust;
    (f) an association;
    (g) a joint venture;
    (h) a pool;
    (i) a syndicate;
    (j) a sole proprietorship;
    (k) an unincorporated organization; or
    (l) any form of business entity. See Utah Code 7-1-103
  • Person: means an individual, corporation, partnership, organization, association, trust, governmental agency, or other legal entity. See Utah Code 17B-1-102
  • Personal property: includes :Utah Code 48-2e-1156
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 48-2e-1156
  • Producer: means a person who produces milk or milk fat from cows and who sells it for human or animal consumption, or for medicinal or industrial uses. See Utah Code 4-22-102
  • Producer-handler: means any producer who processes raw milk or milk fat. See Utah Code 4-22-102
  • Property: includes both real and personal property. See Utah Code 48-2e-1156
  • Proprietary funds: means enterprise funds and the internal service funds of a local district. See Utah Code 17B-1-601
  • Public funds: means any money or payment collected or received by an officer or employee of a local district acting in an official capacity and includes money or payment to the officer or employee for services or goods provided by the district, or the officer or employee while acting within the scope of employment or duty. See Utah Code 17B-1-601
  • Quorum: The number of legislators that must be present to do business.
  • Research pilot program: means a program conducted by the department in collaboration with at least one licensee to study methods of cultivating, processing, or marketing industrial hemp. See Utah Code 4-41-102
  • Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 48-2e-1156
  • Special assessment: means an assessment levied against property to pay all or a portion of the costs of making improvements that benefit the property. See Utah Code 17B-1-102
  • Special fund: means any local district fund other than the local district's general fund. See Utah Code 17B-1-601
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 48-2e-1156
  • State: means , unless the context demands otherwise:
    (a) a state;
    (b) the District of Columbia; or
    (c) the territories of the United States. See Utah Code 7-1-103
  • Subsidiary: means a business entity under the control of an institution. See Utah Code 7-1-103
  • Technology service provider: means a person that provides a data processing service or activity that supports the financial services or Internet related services of a depository institution subject to the jurisdiction of the department, including supporting:
    (a) lending;
    (b) money transfers;
    (c) fiduciary activities;
    (d) trading activities;
    (e) deposit taking;
    (f) web services and electronic bill payments;
    (g) mobile applications;
    (h) system and software development and maintenance; and
    (i) security monitoring. See Utah Code 7-1-103
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 48-2e-1156
  • Weight: means net weight, unless the label declares that the product is sold by drained weight, in which case "weight" means net drained weight. See Utah Code 4-22-101
