Terms Used In Vermont Statutes Title 19 Sec. 1604

  • Department: means the Department of Motor Vehicles. See
  • highway: includes rights-of-way, bridges, drainage structures, signs, guardrails, areas to accommodate utilities authorized by law to locate within highway limits, areas used to mitigate the environmental impacts of highway construction, vegetation, scenic enhancements, and structures. See
  • Relocation: means required adjustments of utility facilities necessitated by planned highway maintenance or construction activities. See
  • Utility: means a privately, publicly, or cooperatively owned line, facility, or system for producing, transmitting, or distributing communications, cable television, power electricity, light, heat, gas, oil, crude products, water, steam, waste, stormwater not connected with the highway drainage, or any other similar commodity, including any fire or police signal system or highway lighting system, which directly or indirectly serves the public. § 1604. Applicability

(a) Eligibility for reimbursement of utility relocation costs incurred for highway projects that advance to the construction phase after April 25, 1995 shall be determined in accordance with the standards provided in this chapter.

(b) The reimbursement provisions of this chapter only apply to “utilities,” as defined in section 1602 of this title.

(c) Unless the context clearly indicates otherwise, this chapter shall be applied in conjunction with regulations of the U.S. Department of Transportation, Federal Highway Administration, 23 C.F.R. part 645-Utilities, as may be amended.
