Terms Used In Virginia Code > Title 16.1 > Chapter 4.1

  • Abolished system: means the Virginia Retirement Act, §§ 51-30 through 51-111, repealed by Chapter 1 of the Acts of Assembly of 1952. See Virginia Code 51.1-124.3
  • Accumulated contributions: means the sum of all amounts deducted from the compensation of a member and credited to his individual account in the member's contribution account, all amounts the member may contribute to purchase creditable service, all member contributions contributed by the employer on behalf of the employee, on or after July 1, 1980, except those amounts contributed on behalf of members of the General Assembly who are otherwise retired under the provisions of this chapter, and all interest accruing to these funds. See Virginia Code 51.1-124.3
  • Act: means the Virginia Workers' Compensation Act (§ Virginia Code 51.5-178
  • Associated facilities: means any facility utilized for gas or oil operations in the Commonwealth, other than a well or a well site. See Virginia Code 45.1-361.1
  • Average final compensation: means the average annual creditable compensation of a member during his 60 highest consecutive months of creditable service or during the entire period of his creditable service if less than 60 months. See Virginia Code 51.1-124.3
  • Bank: means the Virginia Transportation Infrastructure Bank created in § Virginia Code 33.2-1000
  • Certificate of limited partnership: means the certificate referred to in § Virginia Code 64.2-2741
  • City: means an independent incorporated community which became a city as provided by law before noon on July 1, 1971, or which has within defined boundaries a population of 5,000 or more and which has become a city as provided by law. See Virginia Code 2.2-815
  • Client: means any person receiving a service provided by the personnel or facilities of a public or private agency, whether referred to as a client, participant, patient, resident, or other term. See Virginia Code 51.5-116
  • Coal claimant: means a person identified as possessing an interest in production royalties when a drilling unit is force-pooled or who asserts or possesses a claim to funds that are held in escrow, for a force-pooled coalbed methane gas well, or in suspense, for a voluntarily pooled coalbed methane gas well, by virtue of owning an interest in the coal estate contained within the drilling unit subject to the pooling order or agreement. See Virginia Code 45.1-361.1
  • Coal operator: means any person who has the right to operate or does operate a coal mine. See Virginia Code 45.1-361.1
  • Coal owner: means any person who owns, leases, mines and produces, or has the right to mine and produce, a coal seam. See Virginia Code 45.1-361.1
  • Coal seam: means any stratum of coal twenty inches or more in thickness, unless a stratum of less thickness is being commercially worked, or can in the judgment of the Department foreseeably be commercially worked and will require protection if wells are drilled through it. See Virginia Code 45.1-361.1
  • Coal surface mining operations: means the following:

  • Coalbed methane gas: means occluded natural gas produced from coalbeds and rock strata associated therewith. See Virginia Code 45.1-361.1
  • Coalbed methane gas well: means a well capable of producing coalbed methane gas. See Virginia Code 45.1-361.1
  • Coalbed methane gas well operator: means any person who has been designated to operate or does operate a coalbed methane gas well. See Virginia Code 45.1-361.1
  • Commission: means the State Corporation Commission. See Virginia Code 50-73.1
  • Commissioner: means the Commissioner of the Department for the Blind and Vision Impaired. See Virginia Code 51.5-60
  • Commissioner: means the Commissioner for Aging and Rehabilitative Services. See Virginia Code 51.5-116
  • Commissioner: means the Commissioner of Agriculture and Consumer Services. See Virginia Code 3.2-100
  • Commissioner of Highways: means the individual who serves as the chief executive officer of the Department of Transportation. See Virginia Code 64.2-2741
  • Community correctional facility: means any group home, halfway house or other physically unrestricting facility used for the housing, treatment or care of adult offenders established or operated with funds appropriated to the Department of Corrections from the state treasury and maintained or operated by any political subdivision, combination of political subdivisions or privately operated agency within the Commonwealth. See Virginia Code 53.1-1
  • Community respite care organization: means a local subdivision of the Commonwealth, a combination of political subdivisions, a separate public agency, or a private nonprofit agency exempt under § 501(c)(3) of the Internal Revenue Code, which has the authority under its applicable charter, laws, or articles of organization to receive funds to support respite care activities. See Virginia Code 51.5-155
  • Company: means an insurance company issuing a long-term disability insurance policy purchased by the Board pursuant to this chapter. See Virginia Code 51.1-1100
  • Company: means an insurance company issuing a long-term disability insurance policy purchased by the Board pursuant to this chapter. See Virginia Code 51.1-1150
  • Consumer: means , with respect to case management services, a person with a disability or his designee, guardian, conservator, or committee. See Virginia Code 51.5-116
  • Continuous service: means an uninterrupted period of service as a participating employee with the same employer. See Virginia Code 51.1-1150
  • Contribution: means any cash, property, services rendered, or a promissory note or other binding obligation to contribute cash or property or to perform services, which a partner contributes to a limited partnership in his capacity as a partner. See Virginia Code 50-73.1
  • Correctional officer: means a duly sworn employee of the Department of Corrections whose normal duties relate to maintaining immediate control, supervision and custody of prisoners confined in any state correctional facility. See Virginia Code 53.1-1
  • Correlative rights: means the right of each gas or oil owner having an interest in a single pool to have a fair and reasonable opportunity to obtain and produce his just and equitable share of production of the gas or oil in such pool or its equivalent without being required to drill unnecessary wells or incur other unnecessary expenses to recover or receive the gas or oil or its equivalent. See Virginia Code 45.1-361.1
  • Court records: shall include case records, financial records and administrative records as defined in this section. See Virginia Code 33.2-1518
  • Credit enhancements: means surety bonds, insurance policies, letters of credit, guarantees, and other forms of collateral or security. See Virginia Code 33.2-1501
  • Creditable compensation: means the full compensation payable annually to an employee working full time in his covered position. See Virginia Code 51.1-124.3
  • Creditable service: means prior service as set forth in § Virginia Code 50-73.1
  • Drilling unit: means the acreage on which one gas or oil well may be drilled. See Virginia Code 45.1-361.1
  • Eligible borrower: means any (i) private entity; (ii) governmental entity; (iii) instrumentality, corporation, or entity established by any of the foregoing pursuant to § Virginia Code 51.1-1100
  • Employee: means any teacher, state employee, officer, or employee of a locality participating in the Retirement System. See Virginia Code 51.1-124.3
  • Employer: means the Commonwealth in the case of a state employee, the local public school board in the case of a teacher, or the political subdivision participating in the Retirement System. See Virginia Code 51.1-124.3
  • Enhanced recovery: means (i) any activity involving injection of any air, gas, water or other fluid into the productive strata, (ii) the application of pressure, heat or other means for the reduction of viscosity of the hydrocarbons, or (iii) the supplying of additional motive force other than normal pumping to increase the production of gas or oil from any well, wells or pool. See Virginia Code 45.1-361.1
  • Event of withdrawal of a general partner: means an event that causes a person to cease to be a general partner as provided in § Virginia Code 2.2-1106
  • Exploratory well: means any well drilled (i) to find and produce gas or oil in an unproven area, (ii) to find a new reservoir in a field previously found to be productive of gas or oil in another reservoir, or (iii) to extend the limits of a known gas or oil reservoir. See Virginia Code 45.1-361.1
  • farm: means any person that obtains at least 51 percent of its annual gross income from agricultural operations and produces the agricultural waste used as feedstock for the waste-to-energy technology, (ii) "agricultural waste" means biomass waste materials capable of decomposition that are produced from the raising of plants and animals during agricultural operations, including animal manures, bedding, plant stalks, hulls, and vegetable matter, and (iii) "waste-to-energy technology" means any technology, including but not limited to a methane digester, that converts agricultural waste into gas, steam, or heat that is used to generate electricity on-site.   • Federal act: means the federal Surface Mining Control and Reclamation Act of 1977, Public Law 95-87, 91 U. See Virginia Code 45.1-229
  • federal acts: means these two federal laws. See Virginia Code 64.2-2111
  • Federal highway reimbursements: means all federal-aid highway construction reimbursements and any other federal highway assistance received from time to time by the Commonwealth under or in accordance with Title 23 of the United States Code or any successor program established under federal law from the Federal Highway Administration and any successor or additional federal agencies. See Virginia Code 33.2-1511
  • Federal Meat Inspection Act: means the act so entitled approved March 4, 1907 (34 Stat. See Virginia Code 64.2-2111
  • Federal Poultry Products Inspection Act: means the act so entitled approved August 28, 1957 (71 Stat. See Virginia Code 64.2-2111
  • Federal-aid primary highway: means any highway within that portion of the primary state highway system as established and maintained under Article 2 (§ Virginia Code 51.5-155
  • Fund: means the Commonwealth Neurotrauma Initiative Trust Fund established pursuant to § Virginia Code 45.1-361.1
  • Interstate System: means the same as that term is defined in 23 U. See Virginia Code 64.2-2741
  • Joint Rules Committee: means those members of the House of Delegates and the Senate designated by the Speaker of the House and the Chairman of the Senate Committee on Rules, respectively, to meet with each other and to act jointly on behalf of the Committee on Rules for each house. See Virginia Code 51.1-124.3
  • Label: means a display of written, printed, or graphic matter upon any article or the immediate container (not including package liners) of any article. See Virginia Code 64.2-2111
  • Lawfully erected: means any sign that was erected pursuant to the issuance of a permit from the Commissioner of Highways under § Virginia Code 2.2-2528
  • Loan: means an obligation subject to repayment that is provided by the Bank to an eligible borrower to finance all or a part of the eligible cost of a project incurred by the eligible borrower or other project sponsor. See Virginia Code 33.2-1501
  • Local board: means a local board of social services established pursuant to Article 1 (§ Virginia Code 51.5-116
  • Local director: means a local director of social services appointed pursuant to § Virginia Code 64.2-2741
  • Lock-up: means a facility whose primary use is to detain persons for a short period of time as determined by the Board. See Virginia Code 53.1-1
  • Log: means the written record progressively describing all strata, water, oil or gas encountered in drilling, depth and thickness of each bed or seam of coal drilled through, quantity of oil, volume of gas, pressures, rate of fill-up, fresh and salt water-bearing horizons and depths, cavings strata, casing records and such other information as is usually recorded in the normal procedure of drilling. See Virginia Code 45.1-361.1
  • Long-term care services: means socialization services, health care services, nutrition services, daily living services, educational services, housing services, transportation services, and supportive services that include (i) a balanced range of health, social, and supportive services to deliver long-term care services to older persons with chronic illnesses or functional impairments; (ii) meaningful choice, increased functional ability, and affordability as determining factors in defining long-term care service needs, which needs shall be determined by a uniform system for comprehensively assessing the needs and preferences of individuals requiring such services; (iii) service delivery, consistent with the needs and preferences of individuals requiring such services, that occurs in the most independent, least restrictive, and most appropriate living situation possible; and (iv) opportunities for self-care and independent living, as appropriate, by encouraging all long-term care programs to maximize self-care and independent living within the mainstream of life in the community. See Virginia Code 51.5-134
  • Main traveled way: means the traveled way of a highway on which through traffic is carried. See Virginia Code 33.2-1200
  • Maintain: means to allow to exist. See Virginia Code 33.2-1200
  • Maintenance: means (i) ordinary maintenance; (ii) maintenance replacement; (iii) operations that include traffic signal synchronization, incident management, and other intelligent transportation system functions; and (iv) any other categories of maintenance that may be designated by the Commissioner of Highways. See Virginia Code 64.2-2741
  • Management agreement: means the memorandum of understanding or interagency agreement among the manager, the Secretary of Finance, and the Board as authorized under subsection B of § Virginia Code 64.2-2741
  • National Highway System: means the same as that term is defined in 23 U. See Virginia Code 64.2-2741
  • National Highway System: means the federal-aid highway system referenced in 23 U. See Virginia Code 33.2-1200
  • Neurotrauma: means an injury to the central nervous system, that is, a traumatic spinal cord or brain injury which results in loss of physical and cognitive functions. See Virginia Code 51.5-178
  • Nominee: means any nonprofit corporation familiar with work for the blind and in the placement of the blind. See Virginia Code 51.5-60
  • Nonlegislative citizen member: means any natural person who is not a member of the General Assembly of Virginia. See Virginia Code 2.2-1117
  • Nonparticipating operator: means a gas or oil owner of a tract included in a drilling unit who elects to share in the operation of the well on a carried basis by agreeing to have his proportionate share of the costs allocable to his interest charged against his share of production from the well. See Virginia Code 45.1-361.1
  • Normal retirement date: means a member's sixty-fifth birthday. See Virginia Code 51.1-124.3
  • Notary: means notary public. See Virginia Code 2.2-1118
  • Notes: means those notes authorized and issued pursuant to § Virginia Code 45.1-361.1
  • Other financial assistance: includes capital or debt reserves for bonds or debt instrument financing, provision of letters of credit and other forms of credit enhancement, and other lawful forms of financing and methods of leveraging funds that are approved by the manager. See Virginia Code 33.2-1501
  • owner: includes persons owning structures or improvements for which an outdoor advertising permit has been issued by the Commissioner of Highways pursuant to § Virginia Code 50-73.1
  • permanent state regulatory program: means the program established by this chapter meeting the requirements of the federal act for the regulation of coal surface mining and reclamation operations within the Commonwealth, submitted to the Secretary pursuant to § 503 of the federal act. See Virginia Code 45.1-229
  • Permit: means a permit issued by the Director pursuant to the approved state regulatory program. See Virginia Code 45.1-229
  • Permittee: means a person holding a permit issued by the Director for coal surface mining pursuant to § Virginia Code 50-73.1
  • Rehabilitation technology: means the systematic application of technologies, engineering methodologies, or scientific principles to meet the needs of and address the barriers confronted by individuals with disabilities in areas that include education, rehabilitation, employment, transportation, independent living, and recreation. See Virginia Code 51.5-116
  • Respite care: means the provision of supplementary care and protection for older, infirm, or disabled adults. See Virginia Code 51.5-155
  • Restoration: means all activity required to return a permitted site to other use after gas, oil, or geophysical operations have ended, as approved in the operations plan for the permitted site. See Virginia Code 45.1-361.1
  • Retirement allowance: means the retirement payments to which a member is entitled. See Virginia Code 51.1-124.3
  • Retirement plan administered by the Virginia Retirement System: means a retirement plan established under this title administered by the Virginia Retirement System, or by an agency that has been delegated administrative responsibility by the Virginia Retirement System, but such term shall exclude any plan established under Chapter 6 (§ Virginia Code 33.2-1200
  • Secondary state highway system: consists of all public highways, causeways, bridges, landings, and wharves in the counties of the Commonwealth not included in the primary state highway system and that have been accepted by the Department of Transportation for supervision and maintenance. See Virginia Code 64.2-2741
  • Secretary: means the Secretary of Transportation. See Virginia Code 64.2-2741
  • Secretary: means the Secretary of the Interior of the United States. See Virginia Code 45.1-229
  • Series: means any grouping of Notes issued as designated as such by the Board as necessary or desirable for administrative convenience, satisfaction of federal tax or securities law requirements, or any similar purpose. See Virginia Code 33.2-1511
  • Service: means service as an employee. See Virginia Code 51.1-124.3
  • Service: means a period of service as a participating employee. See Virginia Code 51.1-1150
  • Sign: means any outdoor sign, display, device, figure, painting, drawing, message, placard, poster, billboard, or other thing that is designed, intended, or used to advertise or inform, any part of the advertising or informative contents of which is visible from any highway. See Virginia Code 33.2-1200
  • State: means a state, territory, or possession of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. See Virginia Code 50-73.1
  • State: includes District of Columbia;

    (f) "Transit facilities" means all real and personal property located in the Zone, necessary or useful in rendering transit service between points within the Zone, by means of rail, bus, water or air and any other mode of travel, including, without limitation, tracks, rights-of-way, bridges, tunnels, subways, rolling stock for rail, motor vehicle, marine and air transportation, stations, terminals and ports, areas for parking and all equipment, fixtures, buildings and structures and services incidental to or required in connection with the performance of transit service;

    (g) "Transit services" means the transportation of persons and their packages and baggage by means of transit facilities between points within the Zone including the transportation of newspapers, express and mail between such points, and charter service which originates within the Zone but does not include taxicab service or individual-ticket-sales sightseeing operations;

    (h) "Transit Zone" or "Zone" means the Washington Metropolitan Area Transit Zone created and described in Section 3 as well as any additional area that may be added pursuant to Section 83(a) of this Compact; and

    (i) "WMATC" means Washington Metropolitan Area Transit Commission. See Virginia Code 33.2-3100

  • state agency: means the same as that term is defined in § Virginia Code 53.1-1
  • State employee: means any person who is regularly employed full time on a salaried basis, whose tenure is not restricted as to temporary or provisional appointment, in the service of, and whose compensation is payable, no more often than biweekly, in whole or in part, by the Commonwealth or any department, institution, or agency thereof. See Virginia Code 51.1-124.3
  • State service: means the employee's total period of state service as an eligible employee, including all periods of classified full-time and classified part-time service and periods of leave without pay, but not including periods during which the employee did not meet the definition of an eligible employee. See Virginia Code 51.1-1100
  • State Veterinarian: means the veterinarian employed by the Commissioner as provided in § Virginia Code 51.1-1100
  • Work-related injury: means an injury, as such term is defined in §
