Terms Used In Kansas Statutes 40-3422

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Board: means the board of governors created by Kan. See Kansas Statutes 40-3401
  • Fund: means the healthcare stabilization fund established pursuant to Kan. See Kansas Statutes 40-3401

In any medical malpractice liability action, as defined by Kan. Stat. Ann. § 60-3401, and amendments thereto, the proceedings shall be stayed on appeal by the filing of a supersedeas bond in the amount of the judgment for which the fund is liable. Such supersedeas bond shall be signed by the chairperson of the board of governors, or the chairperson’s designee, as administrator of the health care stabilization fund without surety or other security.
