Terms Used In Kansas Statutes 40-3829
- Person: means an individual or a business entity. See Kansas Statutes 40-3801
- Pharmacy benefits manager: includes any person or entity acting in a contractual or employment relationship for a pharmacy benefits manager in the performance of pharmacy benefits management for a covered entity. See Kansas Statutes 40-3822
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Kansas Statutes 77-201
As used in Kan. Stat. Ann. §§ 40-3829 and 40-3830, and amendments thereto:
(a) “List” means the list of drugs for which maximum allowable costs have been established;
(b) “maximum allowable cost” or “MAC” means the same as defined in Kan. Stat. Ann. § 40-3822, and amendments thereto;
(c) “network pharmacy” means a pharmacy that contracts with a pharmacy benefits manager;
(d) “pharmacy benefits manager” means the same as defined in Kan. Stat. Ann. § 40-3822, and amendments thereto;
(e) “pharmacy benefits plan or pharmacy benefits program” means a plan or program that pays for, reimburses, covers the cost of or otherwise provides for pharmacist services to individuals who reside in or are employed in this state; and
(f) “wholesaler” means a person or entity that sells and distributes prescription pharmaceutical products, including, but not limited to, a full line of brand name, generic and over-the-counter pharmaceuticals and that offers regular and private delivery to a pharmacy.
