Terms Used In Nevada Revised Statutes > Chapter 211 - Local Facilities for Detention

  • Aquatic invasive species: means an aquatic species which is exotic or not native to this State and which the Commission has determined to be detrimental to aquatic life, water resources or infrastructure for providing water in this State. See Nevada Revised Statutes 488.035
  • Aquatic plant material: means aquatic plants or parts of plants that are dependent on an aquatic environment to survive. See Nevada Revised Statutes 488.035
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • basic demographics: includes , without limitation:

  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Commission: means the Board of Wildlife Commissioners. See Nevada Revised Statutes 488.035
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • controlled substance: means a drug, immediate precursor or other substance which is listed in schedule I, II, III, IV or V for control by the State Board of Pharmacy pursuant to NRS 453. See Nevada Revised Statutes 0.031
  • Conveyance: means a motor vehicle, trailer or any other equipment used to transport a vessel or containers or devices used to haul water on a vessel that may contain or carry an aquatic invasive species or aquatic plant material. See Nevada Revised Statutes 488.035
  • Decedent: A deceased person.
  • Decontaminate: means eliminate any aquatic invasive species on a vessel or conveyance in a manner specified by the Commission which may include, without limitation, washing the vessel or conveyance, draining the water in the vessel or conveyance, drying the vessel or conveyance or chemically, thermally or otherwise treating the vessel or conveyance.   • Department: means the Department of Motor Vehicles. See Nevada Revised Statutes 481.015
  • Department: means the Department of Wildlife. See Nevada Revised Statutes 488.035
  • Director: means the Director of the Department. See Nevada Revised Statutes 481.015
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Executor: A male person named in a will to carry out the decedent
  • Flat wake: means the condition of the water close astern a moving vessel that results in a flat wave disturbance. See Nevada Revised Statutes 488.035
  • Motorboat: means any vessel propelled by machinery, whether or not the machinery is the principal source of propulsion. See Nevada Revised Statutes 488.035
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Operate: means to navigate or otherwise use a motorboat or a vessel. See Nevada Revised Statutes 488.035
  • Owner: means :

    (a) A person having all the incidents of ownership, including the legal title of a vessel, whether or not he or she lends, rents or pledges the vessel; and

    (b) A debtor under a security agreement relating to a vessel. See Nevada Revised Statutes 488.035

  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Prohibited substance: has the meaning ascribed to it in NRS 484C. See Nevada Revised Statutes 488.035
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • substantial bodily harm: means :

    1. See Nevada Revised Statutes 0.060

  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Under the influence: means impaired to a degree that renders a person incapable of safely operating or exercising actual physical control of a vessel. See Nevada Revised Statutes 488.035
  • Vessel: means every description of watercraft, other than a seaplane on the water, used or capable of being used as a means of transportation on water. See Nevada Revised Statutes 488.035
  • Waters of this State: means any waters within the territorial limits of this State. See Nevada Revised Statutes 488.035
