(a)        When a defendant has given notice of appeal:

(1)        Payment of costs is stayed.

(2)        Payment of a fine is stayed.

(3)        Confinement is stayed only when the defendant has been released pursuant to Article 26, Bail.

(4)        Probation or special probation is stayed.

(b)        The effect of dismissal of charges is not stayed by an appeal by the State, and the defendant is free from such charges unless they? are subsequently reinstated as a result of the determination upon appeal. (1977, c. 711, s. 1.)

Terms Used In North Carolina General Statutes 15A-1451

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall be construed to include the said district and territories and all dependencies.
