19-1-104. Creation of department — Appointment of executive director.

There is created within state government the Department of Environmental Quality. The department shall be administered by an executive director. |

- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Executive director: means the executive director of the department appointed pursuant to Section 19-1-104. See Utah Code 19-1-103
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5

The executive director shall be appointed by the governor with the advice and consent of the Senate and shall serve at the pleasure of the governor. |

The executive director shall have demonstrated the necessary administrative and professional ability through education and experience to efficiently and effectively manage the department’s affairs. |
