Terms Used In North Carolina General Statutes 20-28.8
- Arrest: Taking physical custody of a person by lawful authority.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3
- state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall be construed to include the said district and territories and all dependencies. In any case in which a vehicle has been seized pursuant to N.C. Gen. Stat. § 20-28.3, in addition to any other information that must be reported pursuant to this Chapter, the clerk of superior court shall report to the Division by electronic means the execution of an impaired driving acknowledgment as defined in N.C. Gen. Stat. § 20-28.2(a1)(1a), a speeding to elude arrest acknowledgment as defined in N.C. Gen. Stat. § 20-28.2(a1)(8), the entry of an order of forfeiture as defined in N.C. Gen. Stat. § 20-28.2(a1)(4), and the entry of an order of release as defined in N.C. Gen. Stat. § 20-28.3 and N.C. Gen. Stat. § 20-28.4 Each report shall include any of the following information that has not previously been reported to the Division in the case: the name, address, and drivers license number of the defendant; the name, address, and drivers license number of the nondefendant motor vehicle owner, if known; and the make, model, year, vehicle identification number, state of registration, and vehicle registration plate number of the seized vehicle, if known.
