- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
This subdivision shall not apply where the defendant is charged with an offense punishable by death, nor shall this subdivision apply to the offenses enumerated in Chapter 6 of Title 13A.
