Terms Used In Alabama Code > Title 30 > Chapter 5A

  • ALLEGED VICTIM: A person or persons to whom transmission of body fluids from the perpetrator of the crime occurred or was likely to have occurred in the course of the alleged crime. See Alabama Code 15-23-100
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • court: All state courts including juvenile courts. See Alabama Code 15-23-60
  • CRIMINAL PROCEEDING: A hearing, argument, or other matter scheduled by and held before a trial court but does not include a lineup, grand jury proceeding, or other matter not held in the presence of the court. See Alabama Code 15-23-60
  • defendant: A person or entity that is formally charged by complaint, indictment, information, or petition, of committing a criminal offense. See Alabama Code 15-23-60
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • PARENT OR GUARDIAN OF THE ALLEGED VICTIM: A parent or legal guardian of an alleged victim who is a minor or incapacitated person. See Alabama Code 15-23-100
  • POSITIVE REACTION: A positive test with a positive confirmatory test result as specified by the Department of Public Health. See Alabama Code 15-23-100
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • right: Any right granted to the victim by the laws of this state. See Alabama Code 15-23-60
  • SEXUALLY TRANSMITTED DISEASE: Those diseases designated by the State Board of Health as sexually transmitted diseases for the purposes of this article. See Alabama Code 15-23-100
  • Testify: Answer questions in court.
  • TRANSMISSION OF BODY FLUIDS: The transfer of blood, semen, vaginal secretions, or other body fluids identified by the Department of Public Health, from the alleged perpetrator of a crime to the mucous membranes or potentially broken skin of the victim. See Alabama Code 15-23-100
  • victim: A person against whom the criminal offense has been committed, or if the person is killed or incapacitated, the spouse, sibling, parent, child, or guardian of the person, except if the person is in custody for an offense or is the accused. See Alabama Code 15-23-60
