- administer: The direct application of a controlled substance, whether by injection, inhalation, ingestion, or any other means, to the body of a patient or research subject by:
a. See Alabama Code 20-2-2
- agent: An authorized person who acts on behalf of or at the direction of a manufacturer, distributor, or dispenser. See Alabama Code 20-2-2
- article: When referring to food or drugs, such term is used in the broad and comprehensive sense and has reference to the food product or the drug product in question. See Alabama Code 20-1-20
- board: The State Board of Agriculture and Industries. See Alabama Code 20-1-20
- CERTIFYING BOARDS: The State Board of Medical Examiners, the State Board of Health, the State Board of Pharmacy, the State Board of Dental Examiners, the State Board of Podiatry, and the State Board of Veterinary Medical Examiners. See Alabama Code 20-2-2
- CONTROLLED SUBSTANCE: A drug, substance, or immediate precursor in Schedules I through V of Article 2 of this chapter. See Alabama Code 20-2-2
- COUNTERFEIT SUBSTANCE: Substances which, or the container or labeling of which, without authorization, bears the trademark, trade name, or other identifying mark, imprint, number, or device or any likeness thereof of a manufacturer, distributor, or dispenser other than the person who in fact manufactured, distributed, or dispensed the substance. See Alabama Code 20-2-2
- department: The Department of Agriculture and Industries. See Alabama Code 20-1-20
- dispense: To deliver a controlled substance to an ultimate user or research subject by or pursuant to the lawful order of a practitioner, including the prescribing, administering, packaging, labeling, or compounding necessary to prepare the substance for that delivery. See Alabama Code 20-2-2
- dispenser: A practitioner who dispenses. See Alabama Code 20-2-2
- distribute: To deliver other than by administering or dispensing a controlled substance. See Alabama Code 20-2-2
- distributor: A person who distributes. See Alabama Code 20-2-2
- drug: All medicines and preparations recognized in the United States pharmacopoeia or national formulary for internal or external use and any substance or mixture of substances to be used for the cure, mitigation, or prevention of disease in man or domestic animals. See Alabama Code 20-1-20
- food: All articles of food, drink, confectionery, or condiment, whether simple, mixed, or compound, used or intended for use by man or domestic animals. See Alabama Code 20-1-20
- Fraud: Intentional deception resulting in injury to another.
- IMMEDIATE PRECURSOR: A substance that the State Board of Pharmacy has found to be and by rule designates as being the principal compound commonly used or produced primarily for use and that is an immediate chemical intermediary used or likely to be used in the manufacture of a controlled substance, the control of which is necessary to prevent, curtail, or limit manufacture. See Alabama Code 20-2-2
- manufacture: The production, preparation, propagation, compounding, conversion, or processing of a controlled substance, either directly or indirectly, by extraction from substances of natural origin or independently by means of chemical synthesis or by a combination of extraction and chemical synthesis, and includes any packaging or repackaging of the substance or labeling or relabeling of its container; except, that this term does not include the preparation, compounding, packaging, or labeling of a controlled substance by either of the following:

- marijuana: All parts of the plant Cannabis sativa L. See Alabama Code 20-2-2
- misbranded: Such term shall apply to all drugs or foods or articles which enter into the composition of food, the package or label of which shall bear or contain any statement, design, or device regarding such article or the ingredients or substances contained therein which shall be false or misleading in any particular and to any food or drug product which is falsely branded as to the state, territory, or country in which it is manufactured or produced. - NARCOTIC DRUG: Any of the following, whether produced directly or indirectly by extraction from substances of vegetable origin or independently by means of chemical synthesis or by a combination of extraction and chemical synthesis:

- opiate: Any substance having an addiction-forming or addiction-sustaining liability similar to morphine or being capable of conversion into a drug having addiction-forming or addiction-sustaining liability. See Alabama Code 20-2-2
- OPIUM POPPY: The plant of the species Papaver somniferum L. See Alabama Code 20-2-2
- person: Individual, corporation, government or governmental subdivision or agency, business trust, estate, trust, partnership, or association or any other legal entity. See Alabama Code 20-2-2
- person: An individual, partnership, corporation, or association or any combination thereof. See Alabama Code 20-1-20
- POPPY STRAW: All parts, except the seeds, of the opium poppy, after mowing. See Alabama Code 20-2-2
- production: The manufacture, planting, cultivation, growing, or harvesting of a controlled substance. See Alabama Code 20-2-2
- state: When applied to a part of the United States, the term includes any state, district, commonwealth, territory, insular possession thereof, and any area subject to the legal authority of the United States of America. See Alabama Code 20-2-2
- ULTIMATE USER: A person who lawfully possesses a controlled substance for his or her own use or for the use of a member of his or her household or for administering to an animal owned by him or her or by a member of his or her household. See Alabama Code 20-2-2
