If this state or a city, town or county does not own title to a roadway but holds right-of-way easements, the easements may be extinguished by the governing body‘s resolution.

  • Governing body: means the city or town council or other authority of a city or town, the board of supervisors of a county or the transportation board. See Arizona Laws 28-7201
  • Right-of-way: when used within the context of the regulation of the movement of traffic on a highway means the privilege of the immediate use of the highway. See Arizona Laws 28-101
  • Roadway: includes all or part of a platted or designated public street, highway, alley, lane, parkway, avenue, road, sidewalk or other public way, whether or not it has been used as such. See Arizona Laws 28-7201
