  • Account servicing: means the holding of documents or written instruments and the receipt and disbursement of payments according to the instructions of the parties to the documents or written instruments. See Arizona Laws 6-801
  • Adult: means an individual who is at least eighteen years of age. See Arizona Laws 36-841
  • Adult: means a person who has attained eighteen years of age. See Arizona Laws 1-215
  • Advertisement: means all representations disseminated in any manner or by any means other than by labeling for the purpose of inducing, or which are likely to induce, directly or indirectly, the purchase of food. See Arizona Laws 36-901
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affiliate: means an entity that directly or indirectly, through one or more intermediaries, controls, is controlled by or is under common control with the entity specified. See Arizona Laws 6-801
  • Agent: means an individual who is either:

    (a) Authorized to make health care decisions on the principal's behalf pursuant to a health care power of attorney. See Arizona Laws 36-841

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Anatomical gift: means a donation of all or part of a human body to take effect after the donor's death for the purpose of transplantation, therapy, research or education. See Arizona Laws 36-841
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved smoke detector: means an electronic device powered by batteries or alternating current that is capable of sensing visible or invisible products of combustion, that sounds an alarm audible in all sleeping areas of a residential housing unit and that meets the standards prescribed by the office of the state fire marshal pursuant to section 37-1383.   • Approved smoke detector: means an electronic device powered by batteries or alternating current that is capable of sensing visible or invisible products of combustion, that sounds an alarm audible in all sleeping areas of a guest unit and that meets the standards prescribed by the office of the state fire marshal pursuant to section 37-1383.   • Area of operation: includes all the territory of a city, town or county. See Arizona Laws 36-1401
  • Area of operation: means the area within the territorial boundaries of the municipality. See Arizona Laws 36-1471
  • article: means :

    (a) Articles used for food or drink for man or animals. See Arizona Laws 36-901

  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Associate director: means the associate director of the citrus, fruit and vegetable division of the department. See Arizona Laws 3-441
  • Automatic fire extinguishing equipment: means a mechanical system that puts out fires by ejecting chemicals or water. See Arizona Laws 36-1645
  • Auxiliary aids and services: means all of the following:

    (a) Qualified interpreters or other effective methods of making aurally delivered materials available to individuals with a hearing impairment. See Arizona Laws 36-841

  • Bank: means a corporation that holds a banking permit issued pursuant to chapter 2 of this title. See Arizona Laws 6-101
  • Bar: means that portion of any premises licensed under section 4-209, subsection B, paragraph 6, 7, 11, 12 or 14 that is primarily used for the selling, consumption or serving of alcoholic beverages and that is not primarily used for the consumption of food on the premises. See Arizona Laws 36-798
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Bequest: Property gifted by will.
  • bidis: means a product containing tobacco that is wrapped in temburni leaf (diospyros melanoxylon) or tendu leaf (diospyros exculpra), or any other product that is offered to, or purchased by, consumers as beedies or bidis. See Arizona Laws 36-798
  • Blighted area: means an area where dwellings predominate that are detrimental to safety, health or morals because they are dilapidated or overcrowded or lack ventilation, light or sanitary facilities. See Arizona Laws 36-1401
  • Blighted area: means an area, other than a slum area, where sound municipal growth and the provision of housing accommodations is substantially retarded or arrested in a predominance of the properties by any of the following:

    (a) A dominance of defective or inadequate street layout. See Arizona Laws 36-1471

  • Bonds: means bonds, notes, interim certificates, debentures or other obligations issued by a public housing authority, city, town or county pursuant to this article. See Arizona Laws 36-1401
  • Bonds: means any bonds, including refunding bonds, notes, interim certificates, debentures or other obligations. See Arizona Laws 36-1471
  • Bulk food: means unpackaged and unwrapped food in aggregate containers from which quantities are withdrawn by the consumer, excluding fresh fruits, fresh vegetables, nuts in the shell, rice, beans, food in salad bars and potentially hazardous food. See Arizona Laws 36-971
  • Child: means any person through the age of fourteen years. See Arizona Laws 36-881
  • Child care: means the care, supervision and guidance of a child or children, unaccompanied by a parent, guardian or custodian, on a regular basis, for periods of less than twenty-four hours per day, in a place other than the child's or the children's own home or homes. See Arizona Laws 36-881
  • Child care facility: means any facility in which child care is regularly provided for compensation for five or more children not related to the proprietor. See Arizona Laws 36-881
  • Child care group home: means a residential facility in which child care is regularly provided for compensation for periods of less than twenty-four hours per day for not less than five children but no more than ten children through the age of twelve years. See Arizona Laws 36-897
  • Cigarette: means a roll of tobacco or any lawful substitute for tobacco that is wrapped in paper or in any substance other than tobacco. See Arizona Laws 36-798
  • citrus fruit: means the fruit of any orange, lemon, lime, grapefruit, tangerine, kumquat or other citrus tree that produces edible citrus fruit suitable for human consumption. See Arizona Laws 3-441
  • Clerk: means the clerk of the board of supervisors, the city or town clerk or the officer charged with the duties customarily imposed on the clerk. See Arizona Laws 36-1401
  • Clerk: means the clerk or other official of the municipality who is the custodian of the official records of the municipality. See Arizona Laws 36-1471
  • Code: means a published compilation of rules or regulations prepared by a technical trade association and includes any building code, electrical wiring code, health or sanitation code, fire prevention code, wildland-urban interface code, inflammable liquids code, code for slaughtering, processing and selling meat and meat products or for production, pasteurizing and sale of milk and milk products, or other code that embraces rules and regulations pertinent to a subject that is a proper subject of municipal legislation.   • color: includes , but is not limited to, black, white and intermediate grays. See Arizona Laws 36-901
  • Color additive: means a material that both:

    (a) Is a dye, pigment, or other substance made by a process of synthesis or similar artifice, or extracted, isolated, or otherwise derived, with or without intermediate or final change of identity from a vegetable, animal, mineral, or other source. See Arizona Laws 36-901

  • Commission merchant: means a person that receives on consignment or solicits from the producer any citrus fruit for sale on commission on behalf of the producer or accepts any citrus fruit in trust from the producer for the purpose of resale. See Arizona Laws 3-441
  • Consumer firework: means small firework devices that contain restricted amounts of pyrotechnic composition designed primarily to produce visible or audible effects by combustion and that comply with the construction, chemical composition and labeling regulations prescribed in 49 Code of Federal Regulations parts 172 and 173, regulations of the United States consumer product safety commission as prescribed in 16 Code of Federal Regulations parts 1500 and 1507 and the APA 87-1.   • Contract: A legal written agreement that becomes binding when signed.
  • Control: means ownership or the power to vote, either directly or indirectly, more than twenty per cent of the outstanding voting shares of the controlled person. See Arizona Laws 6-801
  • Controlling person: means a person who:

    (a) Through ownership, has the power to vote at least ten per cent of the outstanding voting securities. See Arizona Laws 36-881

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Daytime: means the period between sunrise and sunset. See Arizona Laws 1-215
  • Dealer: means a person that sells, markets or distributes citrus fruit that the person purchased from a producer or markets as an agent, broker or commission merchant, except at retail. See Arizona Laws 3-441
  • Decedent: means a deceased individual whose body or part is or may be the source of an anatomical gift. See Arizona Laws 36-841
  • Decedent: A deceased person.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Department: means the department of health services. See Arizona Laws 36-881
  • Department: means the department of health services. See Arizona Laws 36-897

  • Dependent: A person dependent for support upon another.

  • Disinterested witness: means a witness other than the spouse, child, parent, sibling, grandchild, grandparent or guardian of the individual who makes, amends, revokes or refuses to make an anatomical gift, or another adult who exhibited special care and concern for the individual.   • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Display firework: means large firework devices that are explosive materials intended for use in fireworks displays and designed to produce visible or audible effects by combustion, deflagration or detonation as prescribed by Title 49 of the Code of Federal Regulations, Part 172, regulations of the United States consumer product safety commission as prescribed in 16 Code of Federal Regulations parts 1500 and 1507 and the APA 87-1.   • Division: means the financial institutions division within the department. See Arizona Laws 6-101
  • Docket: A log containing brief entries of court proceedings.
  • Document of gift: means a donor card or other record that is used to make an anatomical gift. See Arizona Laws 36-841
  • Donor: means an individual whose body or part is the subject of an anatomical gift. See Arizona Laws 36-841
  • Donor: The person who makes a gift.
  • Donor registry: means a database that contains records of anatomical gifts. See Arizona Laws 36-841
  • Driver license: means a license or permit that is issued pursuant to title 28 to operate a vehicle, whether or not conditions are attached to the license or permit. See Arizona Laws 36-841
  • Eligible facility: means a health care institution that operates under a federalwide assurance for the protection of human subjects pursuant to Title 45 of the Code of Federal Regulations, Part 46 and that is subject to the federal federalwide assurance regulations, policies and guidelines, including renewals or updates. See Arizona Laws 36-1331
  • Eligible patient: means a person to whom all of the following apply:

    (a) The person has a terminal illness as determined by the person's physician and a consulting physician. See Arizona Laws 36-1311

  • Eligible patient: means a patient who meets all of the following conditions:

    (a) Has a life-threatening disease or condition or a severely debilitating illness, attested to by the patient's physician. See Arizona Laws 36-1331

  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Escrow: means any transaction in which any escrow property is delivered with or without transfer of legal or equitable title, or both, and irrespective of whether a debtor-creditor relationship is created, to a person not otherwise having any right, title or interest therein in connection with the sale, transfer, encumbrance or lease of real or personal property, to be delivered or redelivered by that person upon the contingent happening or nonhappening of a specified event or performance or nonperformance of a prescribed act, when it is then to be delivered by such person to a grantee, grantor, promisee, promisor, obligee, obligor, bailee or bailor, or any designated agent or employee of any of them.   • Escrow agent: means any person engaged in the business of accepting escrows. See Arizona Laws 6-801
  • Eye bank: means a person that is licensed or regulated under federal or state law or is accredited by a nationally recognized accrediting agency to engage in recovering, screening, testing, processing, storing or distributing human eyes or portions of human eyes. See Arizona Laws 36-841
  • Federal act: means the federal food, drug and cosmetic act, as amended (21 United States Code § 301 et seq. See Arizona Laws 36-901
  • Federal government: includes the United States, the United States department of housing and urban development or any other agency or instrumentality, corporate or otherwise, of the United States. See Arizona Laws 36-1401
  • Federal government: includes the United States or any agency or instrumentality, corporate or otherwise, of the United States. See Arizona Laws 36-1471
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fiduciary: A trustee, executor, or administrator.
  • Fire and life safety inspection: means an inspection of a regulated person or facility conducted to ensure fire safety compliance. See Arizona Laws 9-831
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Food additive: means any substance, the intended use of which results or may be reasonably expected to result, directly or indirectly, in its becoming a component of or otherwise affecting the characteristics of any food, including any substance intended for use in producing, manufacturing, packing, processing, preparing, treating, packaging, transporting or holding food, and including any source of radiation intended for any use if the substance is not generally recognized among experts qualified by scientific training and experience to evaluate its safety as having been adequately shown through scientific procedures, or in the case of a substance used in a food prior to January 1, 1958 through either scientific procedures or experience based on common use in food, to be safe under the conditions of its intended use.   • Food and swimming pool inspection: means an inspection of a regulated person or facility conducted to ensure the safety of food services, swimming pools and other bathing places. See Arizona Laws 9-831
  • Fraud: Intentional deception resulting in injury to another.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Governing body: means the board of commissioners of a public housing authority, the common council or other legislative body of the city or town or the county board of supervisors. See Arizona Laws 36-1401
  • Governing body: means the board of supervisors of a county as to the area within the county but without the corporate limits of an incorporated city or town and means the governing body of an incorporated city or town as to the area within its corporate limits. See Arizona Laws 36-1601
  • Guardian: means a person who is appointed by a court to make decisions regarding the support, care, education, health or welfare of an individual. See Arizona Laws 36-841
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guest unit: means a room in a motel or hotel that is offered for lodging. See Arizona Laws 36-1645
  • Health care entity: means any of the following or an employee of any of the following:

    (a) A health care institution as defined in section 36-401. See Arizona Laws 36-1321

  • Hearing evaluation services: means services which include the identification, testing, evaluation and initiation of follow-up services as defined in the rules and regulations of the department, as provided by Section 36-899. See Arizona Laws 36-899
  • HIV: means the human immunodeficiency virus. See Arizona Laws 36-797
  • Hospital: means a facility that is licensed as a hospital under the laws of any state or that is operated as a hospital by the United States, a state or a subdivision of a state. See Arizona Laws 36-841
  • housing authority: means an agency of a city, town or county created and controlled pursuant to this article. See Arizona Laws 36-1401
  • Identification card: means a nonoperating identification license that is issued by the motor vehicle division of the department of transportation. See Arizona Laws 36-841
  • Know: means to have actual knowledge. See Arizona Laws 36-841
  • kosher: as used in this article shall not be construed to include the words "kosher style. See Arizona Laws 36-941
  • labeling: means a display of written, printed or graphic matter upon the immediate container or wrapper of an article or accompanying that article. See Arizona Laws 36-901
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: includes the whole or part of any municipal permit, certificate, approval, registration, charter or similar form of permission required by law. See Arizona Laws 9-831
  • License: means a license issued pursuant to this chapter. See Arizona Laws 6-801
  • Licensing: includes the municipal process respecting the grant, denial, renewal, revocation, suspension, annulment, withdrawal or amendment of a license. See Arizona Laws 9-831
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Life-threatening disease or condition: means a disease or condition that both:

    (a) Has a high likelihood of death unless the course of the disease or condition is interrupted. See Arizona Laws 36-1331

  • Liquefied petroleum gas: means any hydrocarbon or mixture of hydrocarbons composed predominantly of propane, propylene, butanes, normal butane, isobutane or butylenes. See Arizona Laws 36-1621
  • Local governing body: means the council or other legislative body charged with governing the municipality. See Arizona Laws 36-1471
  • Lot: means a unit of identical or similar items that are grouped or consolidated in one or more containers for packaging or transporting or a cluster of identical or similar items that are included in the same shipping order, bill of lading or other itemized transport order. See Arizona Laws 3-441
  • Magistrate: means an officer having power to issue a warrant for the arrest of a person charged with a public offense and includes the chief justice and justices of the supreme court, judges of the superior court, judges of the court of appeals, justices of the peace and judges of a municipal court. See Arizona Laws 1-215
  • Mayor: means the mayor of the city or town or the officer thereof charged with the duties customarily imposed on the mayor or executive head of a city or town. See Arizona Laws 36-1401
  • Mayor: means the mayor of a municipality or other officer or body having the duties customarily imposed upon the executive head of a municipality. See Arizona Laws 36-1471
  • Minor: means a person who is under eighteen years of age. See Arizona Laws 36-798
  • Minor: means an individual who is under eighteen years of age. See Arizona Laws 36-841
  • Month: means a calendar month unless otherwise expressed. See Arizona Laws 1-215
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Municipality: means a city or town organized in accordance with law, including a home rule or charter city. See Arizona Laws 9-801
  • municipality: means an incorporated city or town. See Arizona Laws 9-831
  • Municipality: means any incorporated city or town in the state. See Arizona Laws 36-1471
  • negligently: import a want of such attention to the nature or probable consequence of the act or omission as a prudent man ordinarily bestows in acting in his own concerns. See Arizona Laws 1-215
  • Nighttime: means the period between sunset and sunrise. See Arizona Laws 1-215
  • Nontransplant anatomical donation organization: means a tissue bank or other organization that facilitates nontransplant anatomical donations, including facilitation through referrals, obtaining informed consent or authorization and assessing donor acceptability and through the acquisition, traceability, transporting, preparation, packaging, labeling, storage, release, evaluating intended use, distribution and final disposition of nontransplant anatomical donations.   • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Obligee: includes any holder of bonds issued pursuant to this article, trustee or trustees for such bondholders, or lessor demising to a public housing authority, city, town or county property used in connection with a housing project, or an assignee or assignees of such lessor's interest or any part thereof, and the federal government when it is a party to a contract with a public housing authority, city, town or county in regard to a housing project.   • Obligee: includes any bondholder, agents or trustees for any bondholders, or lessor demising to the municipality property used in connection with a redevelopment project, or any assignee or assignees of a lessor's interest or any part thereof, and the federal government when it is a party to any contract with the municipality. See Arizona Laws 36-1471
  • Organ procurement organization: means a qualified organ procurement organization under 42 United States Code § 273 that is currently certified or recertified in accordance with that federal law. See Arizona Laws 36-841
  • Panels immediately adjacent to: means the first fixed glazed panel on either or both sides of a door in a hazardous location, whether or not on the same plane and whether or not divided by a horizontal mullion, eighteen inches to forty-eight inches in width, the nearest vertical edge of which is located within three feet horizontally of the nearest vertical edge of the door and the bottom edge is less than eighteen inches above the floor level.   • Parent: means a parent whose parental rights have not been terminated. See Arizona Laws 36-841
  • Part: means an organ, eye or tissue of a human being. See Arizona Laws 36-841
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, government or governmental subdivision, agency or instrumentality, or any other legal or commercial entity. See Arizona Laws 36-841
  • Person: means an individual, partnership, corporation, limited liability company, association, day nursery, nursery school, day camp, kindergarten, child care agency, school governing board, charter school or child care center that operates a child care facility. See Arizona Laws 36-881
  • Person: means an individual, partnership, corporation, association, governmental subdivision or unit of a governmental subdivision or a public or private organization of any character. See Arizona Laws 9-831
  • Person: includes this state and any agency or political subdivision of this state. See Arizona Laws 36-1321
  • Person: means any individual, firm, partnership, corporation, company association, joint stock association or body politic, and includes any trustee, receiver, assignee or other similar representative thereof. See Arizona Laws 36-1471
  • Person: includes an individual, partnership, firm or corporation. See Arizona Laws 36-1601
  • Person: means a natural person, a corporation, partnership, firm, receiver or trustee or any organized group of persons. See Arizona Laws 36-1621
  • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
  • Person: includes an individual, firm, association, partnership, trust or corporation. See Arizona Laws 3-441
  • Personal property: All property that is not real property.
  • Personal property: includes money, goods, chattels, things in action and evidences of debt. See Arizona Laws 1-215
  • Persons of low income: means persons or families who lack the amount of income that is necessary, as determined by the public housing authority, city, town or county undertaking the housing project, to enable them, without financial assistance, to live in decent, safe and sanitary dwellings without overcrowding. See Arizona Laws 36-1401
  • Pesticide chemical: means any substance that alone, in chemical combination or in formulation with one or more other substances is an "economic poison" within the meaning of the federal insecticide, fungicide and rodenticide act (7 United States Code §§ 135-135k) and that is used in the production, storage or transportation of raw agricultural commodities.   • Petty offense: A federal misdemeanor punishable by six months or less in prison. Source: U.S. Courts
  • Physician: means an individual who is licensed as a physician pursuant to Title 32, Chapter 13 or 17. See Arizona Laws 36-841
  • Physician: means the physician who is providing medical care or treatment to the eligible patient for the terminal illness but does not include a primary care physician. See Arizona Laws 36-1311
  • Place of business: means grocery store, market, hotel, inn, restaurant, boarding house, eating house, lunch room, cafeteria, caterer or other establishment or place in which meat, meat products, food or food products are sold for human consumption. See Arizona Laws 36-941
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Plea agreement: An arrangement between the prosecutor, the defense attorney, and the defendant in which the defendant agrees to plead guilty in exchange for special considerations. Source:
  • Population: means the population according to the most recent United States decennial census. See Arizona Laws 1-215
  • Potentially hazardous food: means food that consists in whole or in part of milk or milk products, eggs, meat, poultry, fish, shellfish, edible crustacea or other ingredients in a form capable of supporting rapid and progressive growth of infectious or toxigenic microorganisms except clean, whole, uncracked, odor free shell eggs or food that has a pH level of 4.   • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Principal: means a person who is the subject of a health care power of attorney. See Arizona Laws 36-841
  • Private education program: means all programs of private education offering courses of study for grades, kindergarten through the twelfth grade of high school. See Arizona Laws 36-899
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Procurement organization: means any of the following:

    (a) An organ procurement organization. See Arizona Laws 36-841

  • Producer: means a person that is engaged in this state in the business of producing or causing citrus fruit to be produced for market in commercial quantities. See Arizona Laws 3-441
  • Product module: means a multi-use or single service food contact container designed for customer self-service of bulk food by either direct or indirect means. See Arizona Laws 36-971
  • Prospective donor: means an individual who is dead or near death and who has been determined by a procurement organization to have a part that could be medically suitable for transplantation, therapy, research or education. See Arizona Laws 36-841
  • Provider: means the certificate holder or a person the certificate holder designates in writing who, pursuant to applicable statutes and rules, is to be responsible for direct daily supervision, operation and maintenance of the child care group home. See Arizona Laws 36-897
  • Public body: means the state or any municipality, county, village, board, commission, authority, district or any other subdivision or public body of the state. See Arizona Laws 36-1471
  • Public buildings: means hotels, motels, dormitories, health care institutions, theatres, stadiums, gymnasiums, amusement park buildings, schools and other buildings used for educational purposes, museums, restaurants, bars, places of worship and other buildings of public assembly. See Arizona Laws 36-1631
  • Public education program: means all kindergarten, primary and secondary programs of education within the public school system, including but not beyond the twelfth grade of common or high school. See Arizona Laws 36-899
  • Public record: includes a statute, rule or regulation of the United States, this state or the municipality that is desired to be adopted by reference. See Arizona Laws 9-801
  • Published: means printed, lithographed, multigraphed, mimeographed or otherwise reproduced, including electronic reproduction online. See Arizona Laws 9-801
  • Quorum: The number of legislators that must be present to do business.
  • Raw agricultural commodity: means any food in its raw or natural state, including, but not limited to, all fruits that are washed, colored or otherwise treated in their unpeeled natural form prior to marketing. See Arizona Laws 36-901
  • Real property: includes all lands, including improvements and fixtures on the land, and property of any nature appurtenant to the land, or used in connection with the land, and every estate, interest and right, legal or equitable, therein, including terms for years and liens by way of judgment, mortgage or otherwise and the indebtedness secured by such liens. See Arizona Laws 36-1401
  • Real property: includes all lands, including improvements and fixtures on the land, and property of any nature appurtenant to the land, or used in connection with the land, and every estate, interest and right, legal or equitable therein, including terms for years and liens by way of judgment, mortgage or otherwise and the indebtedness secured by the liens. See Arizona Laws 36-1471
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Reasonably available: means able to be contacted by a procurement organization without undue effort and willing and able to act in a timely manner consistent with existing medical criteria necessary for the making of an anatomical gift. See Arizona Laws 36-841
  • Recipient: means an individual into whose body a decedent's part has been or is intended to be transplanted. See Arizona Laws 36-841
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Arizona Laws 36-841
  • Redeveloper: means any person, partnership or public or private corporation or agency which enters or proposes to enter into a redevelopment contract. See Arizona Laws 36-1471
  • Redevelopment contract: means a contract entered into between a municipality and a redeveloper for the redevelopment of an area in conformity with a redevelopment plan. See Arizona Laws 36-1471
  • Redevelopment plan: means a plan, other than a preliminary or tentative plan, for the acquisition, clearance, reconstruction, rehabilitation or future use of a redevelopment project area. See Arizona Laws 36-1471
  • Refusal: means a record created pursuant to section 36-846 that expressly states an intent to bar other persons from making an anatomical gift of an individual's body or part. See Arizona Laws 36-841
  • Registered mail: includes certified mail. See Arizona Laws 1-215
  • Request for corrections: means a request for technical or clarifying corrections from an applicant who has submitted an administratively complete application for a license. See Arizona Laws 9-831
  • Residential housing unit: means a one or two family dwelling unit, including a detached, semi-detached or duplex unit, or a multi-family dwelling unit including an apartment or condominium. See Arizona Laws 36-1636
  • Retail tobacco vendor: means a person who possesses tobacco or tobacco products for the purpose of selling them for consumption and not for resale. See Arizona Laws 36-798
  • Safety glazing material: means any glazing material, including, but not limited to, tempered glass, laminated glass, wire glass or rigid plastic which meets the test requirements of the American national standards institute (ANSI) standard Z-97. See Arizona Laws 36-1631
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Severely debilitating illness: means a disease or condition that causes major irreversible morbidity. See Arizona Laws 36-1331
  • Shipper: means a person that ships, transports, sells or markets citrus fruit under the person's registered trademark or label or a person that first markets the citrus fruit on behalf of the producer. See Arizona Laws 3-441
  • Sleeping area: means any area of a residential housing unit in which bedrooms or sleeping rooms are located. See Arizona Laws 36-1636
  • Slum area: means an area in which both of the following are true:

    (a) There is a predominance of buildings or improvements, whether residential or nonresidential. See Arizona Laws 36-1471

  • slum clearance and redevelopment commission: means an agency of a municipality created pursuant to section 36-1476. See Arizona Laws 36-1471
  • Smokeless tobacco: includes shredded tobacco, snuff, cavendish and plug, twist and other tobacco products that are intended for oral use but not for smoking. See Arizona Laws 36-798
  • Smoking tobacco: includes any tobacco or tobacco product, other than cigarettes and cigars, that is intended to be smoked. See Arizona Laws 36-798
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands or any territory or insular possession subject to the jurisdiction of the United States. See Arizona Laws 36-841
  • State public body: means any public housing authority, county, municipal corporation, commission, district, authority or other subdivision or public body of the state. See Arizona Laws 36-1401
  • Statute: A law passed by a legislature.
  • Substantial compliance: means that the nature or number of violations revealed by any type of inspection or investigation of an applicant for licensure or a licensed child care facility does not pose a direct risk to the life, health or safety of children. See Arizona Laws 36-881
  • Substantial compliance: means that the nature or number of violations revealed by any type of inspection or investigation of an applicant for certification as a child care group home or a certified child care group home does not pose a direct risk to the life, health or safety of children. See Arizona Laws 36-897
  • Substantive policy statement: means a written expression that is only advisory and that informs the general public of a municipality's current approach to, or opinion of, the requirements of the ordinances or codes, including, if appropriate, the municipality's current practice, procedure or method of action based on that approach or opinion. See Arizona Laws 9-831
  • Technician: means an individual who is determined to be qualified to remove or process parts by an appropriate organization that is licensed or regulated under federal or state law or is accredited by a nationally recognized accrediting agency. See Arizona Laws 36-841
  • Terminal illness: means a disease that, without life-sustaining procedures, will result in death in the near future or a state of permanent unconsciousness from which recovery is unlikely. See Arizona Laws 36-1311
  • Tissue: means all or a portion of the human body other than blood, an organ or an eye unless the blood, organ or eye is donated for the purpose of research or education. See Arizona Laws 36-841
  • Tissue bank: means a person that is licensed or regulated under federal or state law or is accredited as a tissue bank by a nationally recognized accrediting agency to engage in the recovery, screening, testing, processing, storage or distribution of tissue. See Arizona Laws 36-841
  • Tobacco products: includes cigarettes, cigarette papers, cigars, smokeless tobacco and smoking tobacco. See Arizona Laws 36-798
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • Vending machine: means any mechanical, electrical or electronic device that, on insertion of money, tokens or any other form of payment, automatically dispenses tobacco products. See Arizona Laws 36-798
  • Working day: means a twenty-four hour period excluding weekends and legal holidays. See Arizona Laws 9-831
  • Written informed consent: means a written document that is signed by a patient, the patient's parent if the patient is a minor, the patient's legal guardian or the patient's advocate designated by the patient, that is attested to by the patient's physician and a witness and that, at a minimum, includes all of the following:

    (a) An explanation of the currently approved products and treatments for the disease or condition from which the patient suffers. See Arizona Laws 36-1331
