  • Access area: means any paved walkway or sidewalk which is within 50 feet of an automated teller machine. See California Government Code 25691
  • Accessories: when used in connection with an antenna or rotator installation or repair, includes, but is not limited to, masts, towers, clamps, guy wires, eye hooks, standoff insulators, roof saddles, vent pipe mounts, chimney mount kits, signal amplifiers/boosters, multiset couplers, transmission lines, control cables, directional control units, and other devices as may be used from time to time to effect installation or repair. See California Government Code 25105
  • action taken: means a collective decision made by a majority of the members of a legislative body, a collective commitment or promise by a majority of the members of a legislative body to make a positive or a negative decision, or an actual vote by a majority of the members of a legislative body when sitting as a body or entity, upon a motion, proposal, report, resolution, order, or recommendation. See California Education Code 89305.4
  • administrator: means a person who performs or arranges the collection, maintenance, or disbursement of moneys to compensate any party for claims or repairs pursuant to a service contract, and who also performs or arranges any of the following activities on behalf of service contract sellers:

  • advertisement: means any communication, disseminated by television or radio, by any print medium, including, but not limited to, newspapers and billboards, or by means of a mailing directed generally to members of the public and not to a specific person, that solicits employment of legal services provided by a member, and is directed to the general public and is paid for by, or on the behalf of, an attorney.   • Affected county: means a county in which any land of the district or agency is situated. See California Education Code 88244
  • agency: means any district or agency of the type designated by and formed pursuant to the provisions of any principal act that incorporates this part. See California Education Code 88244
  • Antenna: includes , but is not limited to, a resonant device designed especially for the purpose of capturing electromagnetic energy transmitted by direct satellite or commercial radio or television broadcasting facilities. See California Government Code 25105
  • Appliance repair industry: means those activities defined in paragraph (4) of subdivision (f). See California Government Code 25105
  • Apportionment: means an apportionment made under this chapter unless the context otherwise requires. See California Education Code 16002
  • Approved program: means a program for the education of physician assistants that has been formally approved by the board. See California Education Code 87454
  • Armed forces: means the United States Air Force, Army, Navy, Marine Corps, or Coast Guard. See California Education Code 88113
  • Assessor: as used in this part , means the assessor of a district. See California Public Utilities Code 381.2
  • Association: includes any lodge, order, beneficial association, fraternal or beneficial society or association, historical, military, or veterans organization, labor union, foundation, or federation, or any other society, organization, or association, or degree, branch, subordinate lodge, or auxiliary thereof. See California Government Code 16527
  • At-large method of election: means any of the following methods of electing members to the governing body of a political subdivision:

  • attorney: means a member or former member of the State Bar. See California Government Code 26488
  • Automated teller machine: means any electronic information processing device located in California which accepts or dispenses cash in connection with a credit, deposit, or convenience account. See California Government Code 25691
  • auxiliary organization: includes the following entities:

  • Board: means the Board of Supervisors of the County of Los Angeles. See California Education Code 90048
  • Board: means the Board of Supervisors of the County of San Diego. See California Education Code 90054
  • Board: means the State Allocation Board. See California Education Code 16002
  • Board: means the Pooled Money Investment Board. See California Government Code 16493
  • Board: means the county board of supervisors acting as the governing authority of a county service area. See California Government Code 25210.2
  • Board: means the state board, department, or agency authorized by that act to request the committee to cause bonds to be issued for the purpose of creating a fund that is to be expended by the board for the purposes specified in that act. See California Government Code 16722
  • Board: means the Physician Assistant Board. See California Education Code 87454
  • Board: means the Respiratory Care Board of California. See California Education Code 87802

  • Board of supervisors: as used in this part , means the board of supervisors of the county in which the greatest portion of the area of the district, is situated at the time of the filing of the petition for formation, unless another meaning is specified.   • board of supervisors: means the Board of Supervisors of the County of Orange. See California Government Code 26295.10
  • Bond: means a state general obligation bond issued pursuant to an act adopting the provisions of this chapter. See California Government Code 16722
  • Bond act: means the act authorizing the issuance of state general obligation bonds and adopting this chapter by reference. See California Government Code 16722
  • bonds: means indebtedness and securities of any kind or class, including bonds, notes, bond anticipation notes, and commercial paper. See California Government Code 26295.6
  • Bonds: as used in this chapter means the written evidence of any obligation incurred by the board payable out of revenues as provided in this chapter in order to secure funds with which to carry out the purposes of this chapter irrespective of the form of such obligation whether in the form of bonds, notes, debentures, interest bearing certificates or other forms prescribed by the board. See California Government Code 26399
  • Bonds: as used in this chapter means the written evidence of any obligation incurred by the board payable out of revenues as provided in this chapter in order to secure funds with which to carry out the purposes of this chapter irrespective of the form of such obligation whether in the form of bonds, notes, debentures, interest bearing certificates or other forms prescribed by the board. See California Government Code 26486
  • building: includes onsite and offsite facilities, utilities, and improvements, including permanent improvement of the grounds of a building, which, as agreed upon by the parties, are appropriate for the proper operation or function of the building to be occupied jointly by the county or city and county and the private person, firm, or corporation. See California Government Code 25549.1
  • Bureau: means the Bureau of Electronic and Appliance Repair, Home Furnishings, and Thermal Insulation. See California Government Code 25105
  • Bureau: means the Bureau of Security and Investigative Services. See California Education Code 92449
  • Candlefoot power: means the light intensity of candles on a horizontal plane at 36 inches above ground level and five feet in front of the area to be measured. See California Government Code 25691
  • Chief: means the Chief of the Bureau of Electronic and Appliance Repair, Home Furnishings, and Thermal Insulation. See California Government Code 25105
  • Chief: means the Chief of the Bureau of Security and Investigative Services. See California Education Code 92449
  • Classification: means that each position in the classified service shall have a designated title, a regular minimum number of assigned hours per day, days per week, and months per year, a specific statement of the duties required to be performed by the employees in each such position, and the regular monthly salary ranges for each such position. See California Education Code 88001
  • Client: means a person who has, within the three years preceding the sale of financial products by a lawyer to that person, employed that lawyer for legal services. See California Government Code 26452
  • collaboration: include employer and employee relationships, joint ventures, partnerships, general corporations, and consulting relationships formed by written agreement in which the architect provides immediate and responsible direction of architectural services. See California Government Code 26299.033
  • Collateral: means any specific vehicle, trailer, boat, recreational vehicle, motor home, appliance, or other property that is subject to a security agreement. See California Education Code 92449
  • Commission: means the Citizens Redistricting Commission in the County of Los Angeles established pursuant to Section 21532. See California Education Code 90048
  • Commission: means the Independent Redistricting Commission established by subdivision (b). See California Education Code 90054
  • commission: means the Orange County Regional Justice Facilities Commission created pursuant to Article 2 (commencing with Section 26296). See California Government Code 26295.4
  • Commissioner: means the Commissioner of Business Oversight. See California Health and Safety Code 128365
  • committee: means a diversion evaluation committee. See California Education Code 87608.5
  • Committee: means the finance committee or other body created by that act and authorized to cause bonds to be issued by the adoption of a resolution or resolutions. See California Government Code 16722
  • comprehensive water resources management plan: means a plan for coordinating and managing the supply and distribution of water for residential, commercial, industrial or other purposes and for coordinating and managing the treatment and disposal of waste water from all sources. See California Government Code 25712
  • contestant: means any person initiating an election contest. See California Education Code 89571
  • Corporation: as used in this part means a corporation which is organized under, or subject to this part, including a central organization. See California Corporations Code 12232
  • county: means the County of San Mateo. See California Government Code 25711
  • county: means the County of Orange. See California Government Code 26295.8
  • County elections official: means the San Diego County Registrar of Voters. See California Education Code 90054
  • County service area: means a county service area formed pursuant to this chapter or any of its statutory predecessors. See California Government Code 25210.2
  • Customer: means a natural person to whom an access device has been issued for personal, family, or household use. See California Government Code 25691
  • Deadly weapon: means and includes any instrument or weapon of the kind commonly known as a blackjack, slungshot, billy, sandclub, sandbag, metal knuckles, dirk, dagger, pistol, or revolver, or any other firearm, any knife having a blade longer than five inches, any razor with an unguarded blade, and any metal pipe or bar used or intended to be used as a club. See California Education Code 92449
  • Debtor: means any person obligated under a security agreement. See California Education Code 92449
  • deed of trust: as used in this part includes "mortgage. See California Government Code 53097.5
  • Defect: means any flaw in the hardware or documentation of a remote accessible vote by mail system that could result in a state of unfitness for use or nonconformance to the manufacturer's specifications or applicable law. See California Education Code 89913
  • Defendant: means that person whose election or nomination is contested or those persons receiving an equal and highest number of votes, other than the contestant, where, in other than primary elections, the body canvassing the returns declares that no one person has received the highest number of votes for the contested office. See California Education Code 89571
  • Deferred deposit originator: means a person who offers, originates, or makes a deferred deposit transaction. See California Health and Safety Code 128365
  • Deferred deposit transaction: means a transaction whereby a person defers depositing a customer's personal check until a specific date, pursuant to a written agreement for a fee or other charge, as provided in Section 23035. See California Health and Safety Code 128365
  • Defined parking area: means that portion of any parking area open for customer parking which is (1) contiguous to an access area with respect to an automated teller machine. See California Government Code 25691
  • Demotion: means assignment to an inferior position or status without the employee's written voluntary consent. See California Education Code 88001
  • Department: means the Department of Consumer Affairs. See California Government Code 25105
  • Department: means the Department of Consumer Affairs. See California Education Code 87802
  • Department: means the Department of Consumer Affairs. See California Education Code 92449
  • Department: means the Department of Business Oversight. See California Health and Safety Code 128365
  • Director: means the Director of Consumer Affairs. See California Government Code 25105
  • Director: means the Director of Education for kindergarten and grades 1 to 12, inclusive. See California Education Code 16002
  • Director: means the Director of Consumer Affairs. See California Education Code 92449
  • Director: means a member of the governing body. See California Education Code 88244
  • Directors: means natural persons, designated in the articles or bylaws or elected by the incorporators, and their successors and natural persons designated, elected, or appointed by any other name or title to act as members of the governing body of the corporation.   • disabled: includes mental or physical illness and mental or physical injury including any illness or injury resulting from pregnancy, childbirth, or related medical condition. See California Education Code 89529.15
  • Disaster: means a devastating earthquake or other conditions specified in subdivisions (b) and (c) of Section 8558. See California Health and Safety Code 6957
  • Disciplinary action: includes any action whereby an employee is deprived of any classification or any incident of any classification in which he or she has permanence, including dismissal, suspension, demotion, or any reassignment, without his or her voluntary consent, except a layoff for lack of work or lack of funds.   • disciplinary agency: means the agency charged with the discipline of attorneys for professional misconduct. See California Government Code 25515.2
  • Dismissal: means dismissal for cause. See California Education Code 89530
  • dissenting interest: means the interest of a member that satisfies all of the following conditions:

    California Education Code 87743.3

  • dissenting member: means the recordholder of a dissenting interest, and includes an assignee of record of that interest. See California Education Code 87743.3
  • District: as used in this part , means a district formed pursuant to this part or pursuant to any law which it supersedes. See California Public Utilities Code 380.5
  • district board: as used in this part , means the governing board of a district. See California Public Utilities Code 381
  • District-based elections: means a method of electing members to the governing body of a political subdivision in which the candidate must reside within an election district that is a divisible part of the political subdivision and is elected only by voters residing within that election district. See California Education Code 89517
  • election management system: is a system that is used by a county in the state to track voter registration or voter preferences, including, for example, a voter's vote-by-mail status. See California Education Code 90022
  • Elective office: means any office that may, under the principal act of the district or agency, be filled by way of an election. See California Education Code 88244
  • Elective officer: means "elective officer" as defined by the principal act of each district or agency or if not defined, any officer of a district or agency holding an office that can be filled by election. See California Education Code 88244
  • Electrolysis: as used in this chapter includes electrolysis or thermolysis. See California Education Code 92112
  • Electronic repair industry: means those activities defined in paragraph (1), (2), or (3) of subdivision (f). See California Government Code 25105
  • Electronic set: includes , but is not limited to, any television, radio, audio or video recorder or playback equipment, video camera, video game, video monitor, computer system, photocopier, or facsimile machine normally used or sold for personal, family, household, or home office use. See California Government Code 25105
  • eligible bank: means a state or national bank located in this state, selected by the Treasurer for the safekeeping of money belonging to or in the custody of the state, that has received an overall rating of not less than "satisfactory" in its most recent evaluation by the appropriate federal financial supervisory agency of the bank's record of meeting the credit needs of the state's communities, including low- and moderate-income neighborhoods, pursuant to Section 2906 of Title 12 of the United States Code.   • Eligible institution: means either of the following:

    California Government Code 25212.4

  • Eligible savings and loan association: means a state or federal savings association, as defined in Section 5102 of the Financial Code, located in this state, insured by the Federal Savings and Loan Insurance Corporation, and selected by the Treasurer for the safekeeping of money belonging to or in the custody of the state. See California Government Code 16600
  • Employee: means any of the following:

    California Education Code 89529.15

  • escrow agent: as used in this division includes joint control agents and Internet escrow agents. See California Government Code 25823
  • faculty service area: means a service or instructional subject area or group of related services or instructional subject areas performed by faculty and established by a community college district. See California Education Code 87743.1
  • Failure: means a discrepancy between the external results of the operation of any software or firmware in a remote accessible vote by mail system and the manufacturer's product requirements for that software or firmware or applicable law. See California Education Code 89913
  • Fault: means a step, process, or data definition in any software or firmware in a ballot marking system that is incorrect under the manufacturer's program specification or applicable law. See California Education Code 89913
  • Fee generating case: means a case or matter that, if undertaken on behalf of an indigent person by an attorney in private practice, reasonably may be expected to result in payment of a fee for legal services from an award to a client, from public funds, or from the opposing party. See California Government Code 25212.4
  • Financial products: means long-term care insurance, life insurance, and annuities governed by the Insurance Code, or its successors. See California Government Code 26452
  • Full pay: means the gross base pay earnable by the employee and subject to retirement contribution if he or she had not vacated his or her position. See California Education Code 89529.02
  • Full pay: means the gross base salary earnable by the employee and subject to retirement contribution on the date of the commencement of his or her disability. See California Education Code 89529.15
  • Fund: means the fund created by that act, and into which the proceeds from the sale of the bonds are paid. See California Government Code 16722
  • Funded debt: as used in this chapter , means all interest-bearing indebtedness of a corporation not maturing within one year of the date the indebtedness was incurred. See California Government Code 26024
  • General district election: means an election held pursuant to the provisions of this part. See California Education Code 88244
  • Geologic hazard: means an actual or threatened landslide, land subsidence, soil erosion, earthquake, or any other natural or unnatural movement of land or earth. See California Government Code 25210.2
  • Governing body: means the board of directors of a district or agency or the board or body which governs the activities of the district or agency. See California Education Code 88244
  • health care facility: means a facility, other than a facility licensed under Division 2 (commencing with Section 1200) of the Health and Safety Code, that is owned or operated by a health care service plan licensed pursuant to Chapter 2. See California Education Code 88221
  • Hours of darkness: means the period that commences 30 minutes after sunset and ends 30 minutes before sunrise. See California Government Code 25691
  • Immediate family member: means a spouse, child, in-law, parent, or sibling. See California Education Code 90048
  • Indenture: means an agreement entered into by the board pursuant to which revenue bonds are issued, regardless of whether the agreement is expressed in the form of a resolution of the board or by other instrument. See California Education Code 90011
  • Industrial disability leave: means temporary disability as defined in Divisions 4 (commencing with Section 3200) and 4. See California Education Code 89529.02
  • Inhabited territory: means territory within which there reside 12 or more registered voters. See California Government Code 25210.2
  • Insignia: includes badge, motto, button, decoration, charm, emblem, or rosette. See California Government Code 16527
  • instructional aide: means a person employed to assist classroom instructors and other faculty in the performance of their duties and in the supervision of students and in instructional tasks which, in the judgment of the faculty to whom the instructional aide is assigned, may be performed by a person not qualified as a classroom instructor. See California Education Code 88243
  • IOLTA account: means an account or investment product established and maintained pursuant to subdivision (a) of Section 6211 that is any of the following:

    California Government Code 25212.4

  • Landowner voting district: means a district whose principal act requires an elector to be an owner of land located within the district. See California Education Code 88244
  • Landscape architect: means a person who holds a license to practice landscape architecture in this state under the authority of this chapter. See California Government Code 26334
  • Latent power: means any service or facility authorized by Article 4 (commencing with Section 25213) that the local agency formation commission has determined, pursuant to subdivision (i) of Section 56425, that the county service area was not authorized to provide prior to January 1, 2009. See California Government Code 25210.2
  • law practice: means (a) a law practice conducted by an individual. See California Government Code 26488
  • Lawyer: means a member of the State Bar or a person who is admitted and in good standing and eligible to practice before the bar of any United States court or the highest court of the District of Columbia or any state, territory, or insular possession of the United States, or licensed to practice law in, or is admitted in good standing and eligible to practice before the bar of the highest court of, a foreign country or any political subdivision thereof, and includes any agent of the lawyer or law firm or law corporation doing business in the state. See California Government Code 26452
  • Lawyer: means a member of the State Bar or a person who is admitted in good standing and eligible to practice before the bar of any United States court or the highest court of the District of Columbia or any state, territory, or insular possession of the United States, or is licensed to practice law in, or is admitted in good standing and eligible to practice before the bar of the highest court of, a foreign country or any political subdivision thereof, and includes any agent of the lawyer, law firm, or law corporation doing business in the state. See California Government Code 25660
  • Layoff: means separation from a position for lack of funds or lack of work. See California Education Code 89530
  • Legal owner: means a person holding a security interest in any collateral where the collateral is subject to a security agreement, a lien against any collateral, an assignment or a repossession order, or an interest in any collateral that is subject to a lease agreement. See California Education Code 92449
  • Legal Services Corporation: means the Legal Services Corporation established under the Legal Services Corporation Act of 1974 (P. See California Government Code 25212.4
  • Legislative body: means any or all of the following:

    California Education Code 89305.1

  • license: includes certificate or permit. See California Education Code 90002
  • license: includes certificate or permit. See California Education Code 90002
  • Licensed adjuster: means a person licensed by the bureau for adjusting lamps in licensed lamp adjusting stations or for adjusting brakes in licensed brake adjusting stations. See California Government Code 26298.22
  • licensed clinic: means a clinic licensed pursuant to Article 1 (commencing with Section 1200) of Chapter 1 of Division 2 of the Health and Safety Code. See California Education Code 88221
  • licensed health care facility: means a facility licensed pursuant to Article 1 (commencing with Section 1250) of Chapter 2 of Division 2 of the Health and Safety Code or a facility, as defined in Section 1250 of the Health and Safety Code, operated by a health care service plan licensed pursuant to Chapter 2. See California Education Code 88221
  • licensed home health agency: means a private or public organization licensed by the State Department of Public Health pursuant to Chapter 8 (commencing with Section 1725) of Division 2 of the Health and Safety Code, as further defined in Section 1727 of the Health and Safety Code. See California Education Code 88221
  • Licensed station: means a station licensed by the bureau pursuant to this chapter. See California Government Code 26298.22
  • Licensee: means an individual, partnership, limited liability company, or corporation licensed under this chapter as a repossession agency. See California Education Code 92449
  • Licensee: means any person who offers, originates, or makes a deferred deposit transaction, who arranges a deferred deposit transaction for a deferred deposit originator, who acts as an agent for a deferred deposit originator, or who assists a deferred deposit originator in the origination of a deferred deposit transaction. See California Health and Safety Code 128365
  • Local agency: means a city, county, city and county, special district, school district, county board of education, or community college district which levied a property tax during the 1977-78 fiscal year or for which a property tax was levied. See California Government Code 16493
  • local agency formation commission: means a local agency formation commission that operates in the county pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, Division 3 (commencing with Section 56000) of Title 5. See California Government Code 25210.2
  • master plan: means the plan for construction, furnishing, acquisition, maintenance, and operation of adult and juvenile detention facilities and courthouse facilities, and structures necessary or convenient to those facilities. See California Government Code 26295.12
  • Medical director: means a physician and surgeon who is a member of a health care facility's active medical staff and who is knowledgeable in respiratory care. See California Education Code 87802
  • Meeting: includes any congregation of a majority of the membership of a legislative body at the same time and place to hear, discuss, or deliberate upon any item that is within the subject matter jurisdiction of the legislative body to which it pertains. See California Education Code 89305.1
  • Member: means a member in good standing of the State Bar and includes any agent of the member and any law firm or law corporation doing business in the State of California. See California Government Code 25660
  • Membership certificate: as used in this part , means a document evidencing a proprietary interest in a corporation. See California Corporations Code 12240
  • Notice: includes all papers and orders required to be served in any proceedings before any court, board, or officer, or when required by law to be served independently of such proceeding. See California Government Code 26660
  • On the certificate: as used in this part means that a statement appears on the face of a certificate or on the reverse thereof with a reference thereto on the face. See California Corporations Code 12242
  • Operator: means any bank, savings association, credit union, industrial loan company, savings bank, or other business entity, or any person who operates an automated teller machine. See California Government Code 25691
  • outstanding: when used as of any particular time with reference to bonds issued by the commission, means all bonds theretofore and thereupon being authenticated and delivered by an authenticating agent duly appointed by the commission or its authorized designee except:

  • Permanent: means that the employee has a right to continued employment unless dismissed or laid off. See California Education Code 89530
  • permanent employee: includes tenure in the classification in which the employee passed the required probationary period and includes all of the incidents of that classification. See California Education Code 88001
  • Person: means an individual, a corporation, a partnership, a limited liability company, a joint venture, an association, a joint stock company, a trust, an unincorporated organization, a government entity, or a political subdivision of a government entity.   • Person: includes a firm, partnership, association, limited liability company, or corporation. See California Government Code 25105
  • person: includes any individual, firm, partnership, general corporation, professional corporation, or limited liability partnership, as authorized by the Corporations Code. See California Government Code 26299.030
  • Person: includes any individual, partnership, limited liability company, or corporation. See California Education Code 92449
  • Person: includes any individual, firm, corporation, association, copartnership, trust, business trust, receiver, trustee, or conservator for any thereof, but does not include this state or any public corporation, political subdivision, city, county, district, or any agency thereof or of this state.   • Physician assistant: means a person who meets the requirements of this chapter and is licensed by the board. See California Education Code 87454
  • Political subdivision: means a geographic area of representation created for the provision of government services, including, but not limited to, a general law city, general law county, charter city, charter county, charter city and county, school district, community college district, or other district organized pursuant to state law.   • Political subdivision: means a geographic area of representation created for the provision of government services, including, but not limited to, a city, a school district, a community college district, or other district organized pursuant to state law. See California Education Code 89525
  • Principal act: means the law providing for the creation of a particular district or agency or type of district or agency. See California Education Code 88244
  • Process: includes all writs, warrants, summons, and orders of courts of justice, or judicial officers. See California Government Code 26660
  • Program manager: means the staff manager of the diversion program, as designated by the executive officer of the board. See California Education Code 87454
  • project: shall be deemed to include any or all of the purposes for which a school district has applied for apportionments under this chapter, pursuant to any regulations that the State Allocation Board may adopt. See California Education Code 16002
  • Project: means any one or more dormitories or other housing facilities, boarding facilities, student union or activity facilities, vehicle parking facilities, alternative transportation programs, or any other auxiliary or supplementary facilities for individual or group accommodation, owned or operated or authorized to be acquired, constructed, furnished, equipped, and operated by the board for use by students, faculty members, or other employees of any one or more campuses of the California State University, or a combination of those facilities, which may include facilities already completed and facilities authorized for future completion, or any other facilities designated by the board as a project in providing for the issuance of revenue bonds or notes.   • Protected class: means a class of voters who are members of a race, color, or language minority group, as this class is referenced and defined in the federal Voting Rights Act of 1965 (52 U. See California Education Code 89517
  • Qualified legal services project: means either of the following:

    California Government Code 25212.4

  • qualified manager: is a person who possesses a valid qualification certificate in accordance with the provisions of Article 5 (commencing with Section 7504) and is in active control or management of, and who is a director of, the licensee's place of business. See California Education Code 92449
  • qualified trust company: means the trust department of any State or National bank in this State or a trust company authorized to act as such in this State. See California Government Code 16550
  • qualified trust company: means the trust department of any state or national bank in this state or a trust company authorized to act as such in this state. See California Government Code 16625
  • Racially polarized voting: means voting in which there is a difference, as defined in case law regarding enforcement of the federal Voting Rights Act of 1965 (52 U. See California Education Code 89517
  • Real estate investment trust: as used in this part means any unincorporated association or trust formed to engage in business and managed by, or under the direction of, one or more trustees for the benefit of the holders or owners (hereinafter in this part "shareowners") of transferable shares of beneficial interest in the trust estate (hereinafter in this part "shares") and that meets one of the following two tests:

  • Real property sales contract: as used in this part is an agreement wherein one party agrees to convey title to real property to another party upon the satisfaction of specified conditions set forth in the contract and which does not require conveyance of title within one year from the date of formation of the contract.   • Recipient: means a qualified legal services project or support center receiving financial assistance under this article. See California Government Code 25212.4
  • Reclassification: means the upgrading of a position to a higher classification as a result of the gradual increase of the duties being performed by the incumbent in that position. See California Education Code 88001
  • Reconstruction: means the renovation, replacement, or rebuilding of damaged or destroyed facilities which will enable this recovery to occur. See California Health and Safety Code 6957
  • Recovery: means the overall short-term and long-term restoration of social, economic, and institutional activity to levels comparable to those which existed prior to the disaster. See California Health and Safety Code 6957
  • Regents of the University of California: means any of the following:

    California Education Code 92020

  • Registered owner: means the individual listed in the records of the Department of Motor Vehicles, on a conditional sales contract, or on an assignment or a repossession order, as the registered owner. See California Education Code 92449
  • Registrant: means a person registered under this chapter. See California Education Code 92449
  • Regulations: means the rules and regulations as set forth in Chapter 13. See California Education Code 87454
  • Resident voting district: means any district other than a landowner voting district. See California Education Code 88244
  • Respiratory care: includes "respiratory therapy" or "inhalation therapy" where those terms mean respiratory care. See California Education Code 87802
  • Respiratory therapy school: means a program reviewed and approved by the board. See California Education Code 87802
  • Revenue: as used in this chapter shall mean all fees, rates, charges, rentals or other income and revenue actually received or receivable by or for the account of the board from the operation of any particular project including without limiting the generality of the foregoing interest allowed on any moneys or securities and any proceeds derived from the sale of any securities and any consideration in any way derived from the particular project owned, operated or maintained by the board. See California Government Code 26400
  • Revenue: as used in this chapter shall mean all fees, rates, charges, rentals or other income and revenue actually received or receivable by or for the account of the board from the operation of any particular project including without limiting the generality of the foregoing interest allowed on any moneys or securities and any proceeds derived from the sale of any securities and any consideration in any way derived from the particular project owned, operated or maintained by the board. See California Government Code 26487
  • revenue bonds: means the written evidence of any obligation, other than revenue bond anticipation notes, issued by the board, payment of which is secured by a pledge of revenues or any part of revenues, as provided in this article, in order to obtain funds with which to carry out the purposes of this article, irrespective of the form of the obligations. See California Education Code 90011
  • Salesperson: when used without modification, means a person licensed as a salesperson under any of the provisions of this part. See California Government Code 53090
  • Secretary: as used in this part , means the secretary of a district. See California Public Utilities Code 381.1
  • Secretary: means the secretary of the governing body or a person designated by him or her to perform a duty of the secretary. See California Education Code 88244
  • Security agreement: means an obligation, pledge, mortgage, chattel mortgage, lease agreement, deposit, or lien, given by a debtor as security for payment or performance of his or her debt, by furnishing the creditor with a recourse to be used in case of failure in the principal obligation. See California Education Code 92449
  • Sell: means to act as a broker for a commission. See California Government Code 26452
  • seller: means a person who sells or offers to sell a service contract to a service contractholder, including a person who is the obligor under a service contract sold by the seller, manufacturer, or repairer of the product covered by the service contract. See California Government Code 26026
  • Service contract: means a contract in writing to perform, over a fixed period of time or for a specified duration, services relating to the maintenance, replacement, or repair of an electronic set or appliance, as defined by this chapter, and their accessories or of furniture, jewelry, lawn and garden equipment, power tools, fitness equipment, telephone equipment, small kitchen appliances and tools, optical products, or home health care products, and may include provisions for incidental payment of indemnity under limited circumstances, including, but not limited to, power surges, food spoilage, or accidental damage from handling.   • Service contract reimbursement insurance policy: means a policy of insurance issued by an insurer admitted to do business in this state providing coverage for all obligations and liabilities incurred by a service contract seller under the terms of the service contracts sold in this state by the service contract seller to a service contractholder. See California Government Code 26026
  • Service contractholder: means a person who purchases or receives a service contract from a service contract seller. See California Government Code 26026
  • Service contractor: means a service contract administrator or a service contract seller. See California Government Code 26026
  • Service dealer: means a person who, for compensation, engages in, or holds himself or herself out to the public as offering services in the business of:

  • Services: means any duty or labor to be rendered by one person for another. See California Education Code 92449
  • Significant decrease in voter turnout: means the voter turnout for a regularly scheduled election in a political subdivision is at least 25 percent less than the average voter turnout within that political subdivision for the previous four statewide general elections. See California Education Code 89525
  • Special sessions: as used in this division , means self-supporting instructional programs conducted by the California State University. See California Education Code 89708
  • state agency: includes every state office, officer, department, division, bureau, board, and commission. See California Government Code 11000
  • Station: means a lamp adjusting station or a brake adjusting station. See California Government Code 26298.22
  • Supervising authority: means the board of supervisors of the county in which is situated all or most of the land of a district. See California Education Code 88244
  • Supervision: means that a licensed physician and surgeon oversees the activities of, and accepts responsibility for, the medical services rendered by a physician assistant. See California Education Code 87454
  • Tax collector: as used in this part , means the tax collector of the county or counties in which a district is located. See California Public Utilities Code 381.4
  • tax rate: as used in this chapter means tax rate per one hundred dollars ($100) of assessed valuation on all property to be taxed to fund a bond issue described in Section 9400. See California Education Code 92448
  • Tender: means a term of a bond that gives the holder the right to have the bond purchased from the holder at a predetermined price prior to maturity. See California Government Code 16722
  • Treasurer: as used in this part , means the treasurer of the county or counties in which a district is located. See California Public Utilities Code 381.5
  • trustees: means the Trustees of the California State University, created under Section 66600. See California Education Code 89000
  • Veteran: as used in this article means any person who has served in the United States armed forces in time of war, or national emergency declared by the President of the United States of America, and who has been discharged or released under conditions other than dishonorable, proof of which shall be submitted to the commission at the time of the examination.   • Veterinary food-animal drugs: as used in this chapter shall include the following:

  • Voter: means a voter or elector as respectively defined in the principal act of each district or agency. See California Education Code 88244
  • Voter turnout: means the percentage of voters who are eligible to cast ballots within a given political subdivision who voted. See California Education Code 89525
  • Zone: means a zone formed pursuant to Article 8 (commencing with Section 25217). See California Government Code 25210.2
