Terms Used In Illinois Compiled Statutes > Chapter 110

  • Access: means that the cable or video provider is capable of providing cable services or video services at the household address using any technology, other than direct-to-home satellite service, that provides 2-way broadband Internet capability and video programming, content, and functionality, regardless of whether any customer has ordered service or whether the owner or landlord or other responsible person has granted access to the household.   • accountants: means and includes all persons authorized to practice public accounting under the laws of this State;

  • Actuarial present value: means the single amount, as of a given valuation date, that results from applying actuarial assumptions to an amount or series of amounts payable or receivable at various times. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Actuarial value of assets: means the value assigned by the actuary to the assets of a plan for the purposes of an actuarial valuation. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • administrative enforcement unit: when used in this Article, means local governmental units or the Child and Spouse Support Unit established under Section 10-3. See Illinois Compiled Statutes 305 ILCS 5/10-3
  • Administrator: means any person, partnership or corporation, other than an insurer or health maintenance organization holding a certificate of authority under the "Health Maintenance Organization Act" as now or hereafter amended, that arranges, contracts with, or administers contracts with a provider whereby beneficiaries are provided an incentive to use the services of such provider. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Adult with a mental disability: means a person over the age of 18 years who lives in his or her own home; who needs home-based services, but does not require 24-hour-a-day supervision; and who has one of the following conditions: severe autism, severe mental illness, a severe or profound intellectual disability, or severe and multiple impairments. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Adverse underwriting decision: means :
            (1) any of the following actions with respect to
    
insurance transactions involving insurance coverage which is individually underwritten:
            (a) a declination of insurance coverage,
            (b) a termination of insurance coverage,
            (c) failure of an agent to apply for insurance
        
coverage with a specific insurance institution which the agent represents and which is requested by an applicant,
            (d) in the case of a property or casualty
        
insurance coverage:
                (i) placement by an insurance institution or
            
agent of a risk with a residual market mechanism, an unauthorized insurer or an insurance institution which specializes in substandard risks, or
                (ii) the charging of a higher rate on the
            
basis of information which differs from that which the applicant or policyholder furnished, or
            (e) in the case of life, health or disability
        
insurance coverage, an offer to insure at higher than standard rates. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Advisory Committee: means the group of members selected from the public and private sectors to advise in the development and implementation of the comprehensive road improvement plan, and the periodic update of the plan. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • affected areas: means the counties of Cook, DuPage, Lake, Kane, McHenry, Will, Madison, St. See Illinois Compiled Statutes 625 ILCS 5/13-100.1
  • affiliate: as used in this Article means a person that directly, or indirectly through one or more intermediaries, controls, is controlled by, or is under common control with, the person specified. See Illinois Compiled Statutes 215 ILCS 5/187
  • Aftercare release: means the conditional and
  •     
    revocable release of an adjudicated delinquent juvenile committed to the Department of Juvenile Justice under the supervision of the Department of Juvenile Justice. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Agency: means the Illinois Environmental Protection Agency. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Agency: means an agency or entity licensed by the Department pursuant to this Article or pursuant to the Community Residential Alternatives Licensing Act. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Agent: means an individual, firm, partnership, association or corporation who is involved in the solicitation, negotiation or binding of coverages for or on applications or policies of insurance, covering property or risks located in this State. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Appeal: means any of the procedures that deal with the review of adverse organization determinations on the health care services the enrollee believes he or she is entitled to receive, including delay in providing, arranging for, or approving the health care services, such that a delay would adversely affect the health of the enrollee or on any amounts the enrollee must pay for a service, as defined under 42 CFR 422. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Applicant: means any person who seeks to contract for insurance coverage other than a person seeking group insurance that is not individually underwritten. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Approved electronic monitoring device: means a device approved by the supervising authority that is primarily intended to record or transmit information as to the minor's presence or nonpresence in the home. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Area background: means concentrations of regulated substances that are consistently present in the environment in the vicinity of a site that are the result of natural conditions or human activities, and not the result solely of releases at the site. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Ashes: means residue from fires used for cooking and for heating buildings. See Illinois Compiled Statutes 60 ILCS 1/210-10

  • Assisted financing: means the financing of residential development by the Illinois Housing Development Authority, including loans to developers for multi-unit residential development and loans to purchasers of single family residences, including condominiums and townhomes.   • Attending physician: means the physician who has primary responsibility at the time of reference for the treatment and care of the patient. See Illinois Compiled Statutes 755 ILCS 45/4-4
  • Audit: means a systematic inspection or examination of plans, reports, records, or documents to determine the completeness and accuracy of the data and conclusions contained therein. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • audit report: means the written report of the accountant or accountants and all appended statements and schedules relating thereto, presenting or recording the findings of an examination or audit of the financial transactions, affairs and condition of a county;

  • Authority: means any Municipal Zoo Authority, as provided in this Division. See Illinois Compiled Statutes 65 ILCS 5/11-48.3-2
  • Bailee: means a person that by a warehouse
  •     
    receipt, bill of lading, or other document of title acknowledges possession of goods and contracts to deliver them. See Illinois Compiled Statutes 810 ILCS 5/7-102
  • Ballot: means paper ballot sheets. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Ballot: means an electronic audio or video display or any other medium, including paper, used to record a voter's choices for the candidates of their preference and for or against public questions. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • Ballot card: means a ballot which is voted by the process of punching. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • Ballot configuration: means the particular combination of political subdivision ballots including, for each political subdivision, the particular combination of offices, candidate names and ballot position numbers for each candidate and question as it appears for each group of voters who may cast the same ballot. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • Ballot configuration: means the particular combination of political subdivision ballots including, for each political subdivision, the particular combination of offices, candidate names and questions as it appears for each group of voters who may cast the same ballot.   • Ballot labels: means the cards, papers, booklet, pages or other material containing the names of officers and candidates and statements of measures to be voted on. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • ballot screen: means the display of material containing the names of offices and candidates and public questions to be voted on. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • Ballot sheet: means a paper ballot printed on one or both sides which is (1) designed and prepared so that the voter may indicate his or her votes in designated areas, which must be enclosed areas clearly printed or otherwise delineated for such purpose, and (2) capable of having votes marked in the designated areas automatically examined, counted, and tabulated by an electronic scanning process. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • Ballot sheet: means a paper ballot printed on one or both sides which is (1) designed and prepared so that the voter may indicate his or her votes in designated areas, which must be areas clearly printed or otherwise delineated for such purpose, and (2) capable of having votes marked in the designated areas automatically examined, counted, and tabulated by an electronic scanning process.   • Banking association: means any Illinois corporation, whether for-profit or not-for-profit, which functions as a professional or trade association of dues-paying member commercial banks. See Illinois Compiled Statutes 215 ILCS 5/1102
  • Basic cable or video service: means any cable or video service offering or tier that includes the retransmission of local television broadcast signals. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Beneficiary: means an individual entitled to reimbursement for expenses of or the discount of provider fees for health care services under a program where the beneficiary has an incentive to utilize the services of a provider which has entered into an agreement or arrangement with an administrator. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Board: means the township board in counties having a population of more than 150,000. See Illinois Compiled Statutes 60 ILCS 1/115-5
  • Board: means the Board of Trustees of the University or its successor. See Illinois Compiled Statutes 110 ILCS 661/6-5
  • Board: means the Board of Trustees of the University or its successor. See Illinois Compiled Statutes 110 ILCS 666/11-5

  • board: means the board of trustees of a museum district. See Illinois Compiled Statutes 55 ILCS 5/5-31003
  • Bridge: means any bridge over or across a river, including any bridges on the approaches thereto to eliminate intersection at grade with any street, tunnel, public road, thoroughfare, highway, railroad or street railroad, where the complete project is located entirely within the State;
         (2) "Net Revenue" means the gross revenue of a bridge less the reasonable cost of operating, maintaining, and repairing the bridge;
         (3) "United States" means the United States of America and any agent or agency thereof;
         (4) "Holder" means the holder or holders of any of the bonds issued under this Division of this Article. See Illinois Compiled Statutes 605 ILCS 5/10-701
  • Broadband service: means a high speed service connection to the public Internet capable of supporting, in at least one direction, a speed in excess of 200 kilobits per second (kbps) to the network demarcation point at the subscriber's premises. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • brownfields: means a parcel of real property, or a portion of the parcel, that has actual or perceived contamination and an active potential for redevelopment. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Building purposes: means the preparation of preliminary drawings and sketches, working drawings and specifications, erection, building acquiring, altering, improving or expanding college facilities, including the acquisition of land therefor, and the inspection and supervision thereof, to be used exclusively for community colleges.   • Cable operator: means that term as defined in item (5) of 47 U. See Illinois Compiled Statutes 220 ILCS 5/21-201

  • Care facility for persons with a developmental disability: means an intermediate care facility for the intellectually disabled within the meaning of Title XIX of the Social Security Act, whether public or private and whether organized for profit or not-for-profit, but shall not include any facility operated by the State.   • Care provider for persons with a developmental disability: means a person conducting, operating, or maintaining a facility for persons with a developmental disability. See Illinois Compiled Statutes 305 ILCS 5/5C-1
  • Caregiver: includes a caregiver's spouse, cohabitant, child, or employee. See Illinois Compiled Statutes 755 ILCS 5/4a-5
  • Carrier: means a person that issues a bill of
  •     
    lading. See Illinois Compiled Statutes 810 ILCS 5/7-102
  • Central Counting: means the counting of ballots in one or more locations selected by the election authority for the processing or counting, or both, of ballots. See Illinois Compiled Statutes 10 ILCS 5/24A-2

  • Certification program: means an instructional curriculum, examination, and process for certification, recertification, and revocation of certification of certified public accountants that is administered by the Illinois CPA Society and that is officially approved by the Department to ensure that a certified public accountant possesses the necessary skills and abilities to successfully perform an attestation engagement for tax compliance review in a certified audit project. See Illinois Compiled Statutes 720 ILCS 5/2-5
  • Child care facilities: has the meaning set forth in the Child Care Act of 1969, but does not include licensed foster homes. See Illinois Compiled Statutes 730 ILCS 152/105
  • Class I Groundwater: means groundwater that meets the Class I: Potable Resource Groundwater criteria set forth in the Board regulations adopted pursuant to the Illinois Groundwater Protection Act. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Class III groundwater: means groundwater that meets the Class III Special Resource Groundwater criteria set forth in the Board rules adopted under the Illinois Groundwater Protection Act. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Code: means any municipal ordinance that pertains to or regulates: sanitation practices; forestry practices; the attachment of bills or notices to public property; the definition, identification and abatement of public nuisances; and the accumulation, disposal and transportation of garbage, refuse and other forms of solid waste in a municipality. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • Code: means any municipal ordinance, law, housing or building code or zoning ordinance that establishes construction, plumbing, heating, electrical, fire prevention, sanitation or other health and safety standards that are applicable to structures in a municipality or any municipal ordinance that requires, after notice, the cutting of weeds, the removal of garbage and debris, the removal of inoperable motor vehicles, or the abatement of nuisances from private property;
         (b) "Building inspector" means a full time state, county or municipal employee whose duties include the inspection or examination of structures or property in a municipality to determine if zoning or other code violations exist;
         (c) "Property owner" means the legal or beneficial owner of a structure;
         (d) "Hearing officer" means a municipal employee or an officer or agent of a municipality, other than a building inspector or law enforcement officer, whose duty it is to:
            (1) preside at an administrative hearing called to
  •     
    determine whether or not a code violation exists;
            (2) hear testimony and accept evidence from the
        
    building inspector, the building owner and all interested parties relevant to the existence of a code violation;
            (3) preserve and authenticate the transcript and
        
    record of the hearing and all exhibits and evidence introduced at the hearing;
            (4) issue and sign a written finding, decision and
        
    order stating whether a code violation exists. See Illinois Compiled Statutes 65 ILCS 5/11-31.1-1
  • Combined waterworks and sewerage system: means and includes a waterworks and sewerage system, as defined in this Section, that a township determines to operate in combination. See Illinois Compiled Statutes 60 ILCS 1/205-5
  • Combined waterworks and sewerage system: means and includes a waterworks and sewerage system, which the municipality determines by ordinance to operate in combination. See Illinois Compiled Statutes 65 ILCS 5/11-139-1
  • combined waterworks and sewerage system: means and includes a waterworks and sewerage system, as hereinabove defined, which any county shall determine to operate in combination. See Illinois Compiled Statutes 55 ILCS 5/5-15002
  • Commercial Building: means any building, other than a residence, permanently affixed to realty located in Illinois, including basements, footings, foundations, septic systems and underground pipes directly servicing the building, but does not include sidewalks, driveways, parking lots, living units, land, trees, plants, crops or agricultural field drainage tile. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Commercial Coverage: means mine subsidence insurance for a commercial building. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Commercial unit: means such a unit of goods as
  •     
    by commercial usage is a single whole for purposes of lease and division of which materially impairs its character or value on the market or in use. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Commission: means the Illinois Commerce Commission. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Commission: means the Illinois Commerce Commission. See Illinois Compiled Statutes 625 ILCS 5/18d-105
  • Community service: means uncompensated labor for
  •     
    a community service agency as hereinafter defined. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • company: as used in this Article includes all of the corporations, associations, societies, orders, firms, companies, partnerships, and individuals specified in subsections (1), (4), and (5) of this Section and agents, managing general agents, brokers, premium finance companies, insurance holding companies, and all other non-risk bearing entities or persons engaged in any aspect of the business of insurance on behalf of an insurer against which a receivership proceeding has been or is being filed under this Article, including, but not limited to, entities or persons that provide management, administrative, accounting, data processing, marketing, underwriting, claims handling, or any other similar services to that insurer, whether or not those entities are licensed to engage in the business of insurance in Illinois, if the entity or person is an affiliate of that insurer.   • compensation: includes compensation received in a lump sum for accumulated unused vacation, personal leave or sick leave, with the exception of health care providers. See Illinois Compiled Statutes 40 ILCS 5/24-102
  • Comprehensive road improvement plan: means a plan prepared by the unit of local government in consultation with the Advisory Committee. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • comprehensive unified local transportation system: as used in this Article means a transportation system comprising all of the street railways and also all of the local railroads the major portions of which are within the city (provided there are such local railroads in such city) and may also comprise public utility motor vehicle lines and/or any other local public utility transportation facilities, the major portions of which are within the city. See Illinois Compiled Statutes 220 ILCS 5/14-101
  • Comptroller: means the Comptroller of the State of Illinois;

  • Computer operator: means any person or persons designated by the election authority to operate the automatic tabulating equipment during any portion of the vote tallying process in an election, but shall not include judges of election operating vote tabulating equipment in the precinct.   • Construction: means any one or more of the following which is undertaken for a public purpose: preliminary planning to determine the feasibility of the treatment works or public water supply, engineering, architectural, legal, fiscal or economic investigations or studies, surveys, designs, plans, working drawings, specifications, procedures or other necessary actions, erection, building, acquisition, alteration, remodeling, improvement or extension of treatment works or public water supplies, or the inspection or supervision of any of the foregoing items. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Consumer lease: means a lease that a lessor
  •     
    regularly engaged in the business of leasing or selling makes to a lessee who is an individual and who takes under the lease primarily for a personal, family, or household purpose, if the total payments to be made under the lease contract, excluding payments for options to renew or buy, do not exceed $40,000. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Consumer report: means any written, oral or other communication of information bearing on a natural person's credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics or mode of living which is used or expected to be used in connection with an insurance transaction. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Consumer reporting agency: means any person who:
            (1) regularly engages, in whole or in part, in the
  •     
    practice of assembling or preparing consumer reports for a monetary fee,
            (2) obtains information primarily from sources other
        
    than insurance institutions, and
            (3) furnishes consumer reports to other persons. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Contingency reserve fund: means a separate fund maintained for payment of claims in excess of the pool retention fund amount. See Illinois Compiled Statutes 215 ILCS 5/1102
  • Contractual services: shall include all purchases, leases, and contracts for impersonal services, necessary for the operation of any Office, department, institution or agency of the county government which are not encompassed in the above definition of "supplies, material and equipment". See Illinois Compiled Statutes 55 ILCS 5/5-36004
  • Corrective action: means activities associated with compliance with the provisions of Sections 57. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • costs: as used in this Division 58 means sums paid by way of compensation to any property owner for the actual taking or damaging of his property, and attorney's fees and court costs incurred as a result of, or incident to, any grade separation covered by this Division 58. See Illinois Compiled Statutes 65 ILCS 5/11-58-7
  • County hospital: means a hospital, as defined in Section 14-1 of this Code, which is a county hospital located in a county of over 3,000,000 population. See Illinois Compiled Statutes 305 ILCS 5/15-1
  • County provider: means a health care provider that is, or is operated by, a county with a population greater than 3,000,000. See Illinois Compiled Statutes 305 ILCS 5/15-1
  • Court: means the circuit court in a session or
  •     
    division assigned to hear proceedings under this Act, and includes the term Juvenile Court. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • court: shall mean the court before which the conservation, rehabilitation, or liquidation proceeding of the company is pending, or the judge presiding in such proceedings. See Illinois Compiled Statutes 215 ILCS 5/187
  • Coverage grant: means the document describing specific coverages and terms of coverage which are provided by a risk retention trust created under this Article. See Illinois Compiled Statutes 215 ILCS 5/1102
  • Current value: means the fair market value when available; otherwise, the fair value as determined in good faith by a trustee, assuming an orderly liquidation at the time of the determination. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Debt: means indebtedness incurred by a dissolving township including, but not limited to, mortgages, judgments, and moneys due through the issuance and sale of bonds, or through an equivalent manner of borrowing for which notes or other evidences of indebtedness are issued fixing the amount of principal and interest from time to time payable to retire the indebtedness. See Illinois Compiled Statutes 60 ILCS 1/23-5
  • Delinquent minor: means any minor who prior to
  •     
    his or her 18th birthday has violated or attempted to violate, regardless of where the act occurred, any federal, State, county or municipal law or ordinance. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Demonstration Project: means the nursing home component of the Medicare-Medicaid Alignment Initiative Demonstration Project. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Department: means the Department of Children and Family Services. See Illinois Compiled Statutes 65 ILCS 5/11-29-18
  • Department: means the Department of Human
  •     
    Services unless specifically referenced as another department. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Department: means the Illinois Department of Revenue. See Illinois Compiled Statutes 720 ILCS 5/2-5

  • Deposit accounts: means certificates of deposit, withdrawable deposits, savings accounts, demand deposit accounts, checking accounts, or any other term or terms appropriate. See Illinois Compiled Statutes 205 ILCS 205/7001
  • Designated market area: means a designated market area, as determined by Nielsen Media Research and published in the 1999-2000 Nielsen Station Index Directory and Nielsen Station Index United States Television Household Estimates or any successor publication. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • detention: includes the court ordered care of an alleged or adjudicated delinquent minor who requires secure custody pursuant to Section 5-125 of this Act. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Developer: means any person who undertakes new development. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • development of real property: means the construction, installation, planting or creation of any permanent improvement of real property in which a museum district has or has taken steps to acquire an interest. See Illinois Compiled Statutes 55 ILCS 5/5-31003
  • Director: means the Director of Insurance. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Director: means the Director of the Department of Insurance. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Dispatcher: means any person who, as an employee or agent of a commercial vehicle relocator, dispatches vehicles to or from locations from which operators perform removal activities; and
         (7) "Dispatcher's employment permit" means a license issued to a dispatcher in accordance with Sections 18a-407 or 18a-408 of this Chapter. See Illinois Compiled Statutes 625 ILCS 5/18a-100
  • Dissolving road district: means a road district in a dissolving township, which is dissolved under subsection (c) of Section 23-25. See Illinois Compiled Statutes 60 ILCS 1/23-5
  • Dissolving township: means a township which is proposed to be dissolved into and be merged with 2 other adjacent townships. See Illinois Compiled Statutes 60 ILCS 1/23-5
  • Diversion: means the referral of a juvenile,
  •     
    without court intervention, into a program that provides services designed to educate the juvenile and develop a productive and responsible approach to living in the community. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Division: means the Public Pension Division of the Department of Insurance. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Edit listing: means a computer generated listing of the names and ballot position numbers for each candidate and proposition as they appear in the program for each precinct. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • Edit listing: means a computer generated listing of the names of each candidate and proposition as they appear in the program for each precinct. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Edit listing: means a computer generated listing of the names of each candidate and public question as they appear in the program for each precinct. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • electrical equipment: as used in this Division 37 means conductors and other equipment installed for the utilization of electricity for light, heat, or power. See Illinois Compiled Statutes 65 ILCS 5/11-37-1
  • Electronic Voting System: means that combination of equipment and programs used in the casting, examination and tabulation of ballots and the cumulation and reporting of results by electronic means. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • electronic voting system: means that combination of equipment and programs used in the casting, examination and tabulation of ballots and the cumulation and reporting of results by electronic means. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • employee: means any person, including a person elected, appointed or under contract, receiving compensation from the State or a unit of local government or school district for personal services rendered, including salaried persons. See Illinois Compiled Statutes 40 ILCS 5/24-102
  • Enrollee: means an individual who resides in a nursing home or is qualified to be admitted to a nursing home and is enrolled with a managed care organization participating in the Demonstration Project. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Equalized assessed value: has the meaning provided in Section 18-213 of the Property Tax Code. See Illinois Compiled Statutes 60 ILCS 1/23-5
  • equipment: includes apparatus necessary to automatically examine and count votes as designated on ballots, and data processing machines which can be used for counting ballots and tabulating results. See Illinois Compiled Statutes 10 ILCS 5/24A-2

  • Expressways: means streets, avenues, roads and drives constituting limited access roadways, with all auxiliary streets, avenues, roads, drives, bridges, viaducts, underpasses, and approaches for ingress and egress to and from the main thoroughfares of such streets, avenues, roads and drives, and other necessary or appropriate appurtenances thereto, to facilitate the movement of through traffic, to be constructed in accordance with the resolutions of the Board of Commissioners heretofore or hereafter approved by the Department of Public Works and Buildings or the Department of Transportation of the State of Illinois and in accordance with the provisions of Section 15d of "An Act to revise the law in relation to roads and bridges" approved June 27, 1913, as amended or Section 5-403 of the "Illinois Highway Code" as the same may from time to time be amended.   • Facilities: means classroom buildings and equipment, related structures and utilities necessary or appropriate for the uses of a community college, but not including land or buildings intended primarily for staff housing, dormitories, or for athletic exhibitions, contests or games for which admission charges are to be made to the general public. See Illinois Compiled Statutes 110 ILCS 805/5-2
  • families: means a family member or members and his, her or their parents or legal guardians. See Illinois Compiled Statutes 405 ILCS 80/3-3
  • Family member: means a child 17 years old or younger who has one of the following conditions: severe autism, severe emotional disturbance, a severe or profound intellectual disability, or severe and multiple impairments. See Illinois Compiled Statutes 405 ILCS 80/3-3
  • Farm crossing: means a crossing used for agricultural and livestock purposes only. See Illinois Compiled Statutes 625 ILCS 5/18c-1104
  • Fault: means wrongful act, omission, breach, or
  •     
    default. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Federal agency: means the United States of America, the President of the United States of America, or such agency or agencies of the United States of America as may be designated or created to make loans or grants or both. See Illinois Compiled Statutes 110 ILCS 661/6-5
  • Federal agency: means the United States of America, the President of the United States of America, or such agency or agencies of the United States of America as may be designated or created to make loans or grants or both. See Illinois Compiled Statutes 110 ILCS 666/11-5

  • Fill material: means non-native or disturbed materials used to bed and backfill around an underground storage tank. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Finance lease: means a lease with respect to
  •     
    which:
                (i) the lessor does not select, manufacture, or
            
    supply the goods;
                (ii) the lessor acquires the goods or the right
            
    to possession and use of the goods in connection with the lease; and
                (iii) one of the following occurs:
                     (A) the lessee receives a copy of the
                
    contract by which the lessor acquired the goods or the right to possession and use of the goods before signing the lease contract;
                    (B) the lessee's approval of the contract by
                
    which the lessor acquired the goods or the right to possession and use of the goods is a condition to effectiveness of the lease contract;
                    (C) the lessee, before signing the lease
                
    contract, receives an accurate and complete statement designating the promises and warranties, and any disclaimers of warranties, limitations or modifications of remedies, or liquidated damages, including those of a third party, such as the manufacturer of the goods, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods; or
                    (D) if the lease is not a consumer lease, the
                
    lessor, before the lessee signs the lease contract, informs the lessee in writing (a) of the identity of the person supplying the goods to the lessor, unless the lessee has selected that person and directed the lessor to acquire the goods or the right to possession and use of the goods from that person, (b) that the lessee is entitled under this Article to the promises and warranties, including those of any third party, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods, and (c) that the lessee may communicate with the person supplying the goods to the lessor and receive an accurate and complete statement of those promises and warranties, including any disclaimers and limitations of them or of remedies. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Footprint: means the geographic area designated by the cable service or video service provider as the geographic area in which it will offer cable services or video services during the period of its State-issued authorization. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Fuel: means all liquids defined as "Motor Fuel" in Section 1. See Illinois Compiled Statutes 415 ILCS 125/305
  • Fund: means the Water Revolving Fund created pursuant to this Title, consisting of the Water Pollution Control Loan Program, the Public Water Supply Loan Program, and the Loan Support Program. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Fund: means the fund established by this Article. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Fund: means the Underground Storage Tank Fund. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Fund: means the Hospital Provider Fund. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Fund: means the Long-Term Care Provider Fund. See Illinois Compiled Statutes 305 ILCS 5/5B-1

  • funds and accounts: means all funds of a county derived from property taxes and all funds and accounts derived from sources other than property taxes, including the receipts and expenditures of the fee earnings of each county fee officer;

  • Garbage: means wastes resulting from the handling, preparation, cooking, and consumption of food and wastes from the handling, storage, and sale of produce. See Illinois Compiled Statutes 60 ILCS 1/210-10

  • Garbage: means any refuse products or materials including but not limited to the following: putrescible animal and vegetable wastes resulting from the handling, preparation, cooking, sale or consumption of food; animal excretion; glass or metal containers, products or objects discarded as no longer useable; paper, wood, and cardboard waste; uprooted weeds, grass clippings, leaves and the like; ashes and cinders; discarded furniture or clothing; and dead animals.   • Garbage disposal area: means any area within a county but outside any city, village or incorporated town in such county to which garbage is hauled for disposal. See Illinois Compiled Statutes 55 ILCS 5/5-8001
  • General construction or demolition debris: has the meaning given to that term in Section 3. See Illinois Compiled Statutes 65 ILCS 5/11-19-2
  • Good faith: means honesty in fact and the
  •     
    observance of reasonable commercial standards of fair dealing. See Illinois Compiled Statutes 810 ILCS 5/7-102
  • Goods: means all things that are movable at the
  •     
    time of identification to the lease contract, or are fixtures (Section 2A-309), but the term does not include money, documents, instruments, accounts, chattel paper, general intangibles, or minerals or the like, including oil and gas, before extraction. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Goods: means all things that are treated as
  •     
    movable for the purposes of a contract for storage or transportation. See Illinois Compiled Statutes 810 ILCS 5/7-102
  • Governmental unit: means the State of Illinois, any instrumentality or agency thereof (except transit authorities or agencies operating within or within and without cities with a population over 3,000,000), and any political subdivision or municipal corporation that establishes and maintains a public pension fund. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Hazardous material: means any substance or material in a quantity and form determined by the federal Office of Hazardous Materials and the Federal Railroad Administration to be capable of posing an unreasonable risk to health, safety, or property when transported in commerce. See Illinois Compiled Statutes 625 ILCS 5/18c-1104
  • Health care: means any care, treatment, service or procedure to maintain, diagnose, treat or provide for the patient's physical or mental health or personal care. See Illinois Compiled Statutes 755 ILCS 45/4-4
  • Health care agency: means an agency governing any type of health care, anatomical gift, autopsy or disposition of remains for and on behalf of a patient and refers to the power of attorney or other written instrument defining the agency or the agency, itself, as appropriate to the context. See Illinois Compiled Statutes 755 ILCS 45/4-4
  • Health care agent: means an individual at least 18 years old designated by the principal to make health care decisions of any type, including, but not limited to, anatomical gift, autopsy, or disposition of remains for and on behalf of the individual. See Illinois Compiled Statutes 755 ILCS 45/4-4
  • Health care services: means health care services or products rendered or sold by a provider within the scope of the provider's license or legal authorization. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Health care services: means the diagnosis, treatment, and prevention of disease and includes medication, primary care, nursing or medical care, mental health treatment, psychiatric rehabilitation, memory loss services, physical, occupational, and speech rehabilitation, enhanced care, medical supplies and equipment and the repair of such equipment, and assistance with activities of daily living. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Hearing officer: means a person other than a sanitation inspector or law enforcement officer having the following powers and duties:
            (1) to preside at an administrative hearing called to
  •     
    determine whether or not a code violation exists;
            (2) to hear testimony and accept evidence from the
        
    sanitation inspector, the respondent and all interested parties relevant to the existence of a code violation;
            (3) to preserve and authenticate the record of the
        
    hearing and all exhibits and evidence introduced at the hearing;
            (4) to issue and sign a written finding, decision and
        
    order stating whether a code violation exists; and
            (5) to impose penalties consistent with applicable
        
    code provisions and to assess costs reasonably related to instituting the proceeding upon finding the respondent liable for the charged violation, provided, however, that in no event shall the hearing officer have the authority to impose a penalty of incarceration. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • Heating Oil: means petroleum that is No. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Holder: means a person or entity that has received authorization to offer or provide cable or video service from the Commission pursuant to Section 21-401 of this Article. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Home detention: means the confinement of a minor adjudicated delinquent or subject to an adjudicatory hearing under Article V for an act that if committed by an adult would be an offense to his or her place of residence under the terms and conditions established by the supervising authority. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Home-based services: means services provided to an adult with a mental disability who lives in his or her own home. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Hospital: means an institution, place, building, or agency located in this State that is subject to licensure by the Illinois Department of Public Health under the Hospital Licensing Act, whether public or private and whether organized for profit or not-for-profit. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Hospital: means any institution, place, building, or agency, public or private, whether organized for profit or not-for-profit, which is located in the State and is subject to licensure by the Illinois Department of Public Health under the Hospital Licensing Act or any institution, place, building, or agency, public or private, whether organized for profit or not-for-profit, which meets all comparable conditions and requirements of the Hospital Licensing Act in effect for the state in which it is located, and is required to submit cost reports to the Illinois Department under Title 89, Part 148, of the Illinois Administrative Code, but shall not include the University of Illinois Hospital as defined in the University of Illinois Hospital Act or a county hospital in a county of over 3 million population. See Illinois Compiled Statutes 305 ILCS 5/14-1
  • Hospital provider: means a person licensed by the Department of Public Health to conduct, operate, or maintain a hospital, regardless of whether the person is a Medicaid provider. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Household: means a house, an apartment, a mobile home, a group of rooms, or a single room that is intended for occupancy as separate living quarters. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • In-precinct counting: means the counting of ballots on automatic tabulating equipment provided by the election authority in the same precinct polling place in which those ballots have been cast. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • In-precinct counting: means the counting of ballots on automatic tabulating equipment provided by the election authority in the same precinct polling place in which those ballots have been cast. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • In-precinct counting: means the recording and counting of ballots on automatic tabulating equipment provided by the election authority in the same precinct polling place in which those ballots have been cast. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • Incumbent cable operator: means a person or entity that provided cable services or video services in a particular area under a franchise agreement with a local unit of government pursuant to Section 11-42-11 of the Illinois Municipal Code (65 ILCS 5/11-42-11) or Section 5-1095 of the Counties Code (55 ILCS 5/5-1095) on January 1, 2007. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Indemnification: means indemnification of an owner or operator for the amount of any judgment entered against the owner or operator in a court of law, for the amount of any final order or determination made against the owner or operator by an agency of State government or any subdivision thereof, or for the amount of any settlement entered into by the owner or operator, if the judgment, order, determination, or settlement arises out of bodily injury or property damage suffered as a result of a release of petroleum from an underground storage tank owned or operated by the owner or operator. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Individual: means any natural person who:
            (1) in the case of property or casualty insurance, is
  •     
    a past, present or proposed named insured or certificateholder;
            (2) in the case of life, health or disability
        
    insurance, is a past, present or proposed principal insured or certificateholder;
            (3) is a past, present or proposed policyowner;
            (4) is a past or present applicant;
            (5) is a past or present claimant; or
            (6) derived, derives or is proposed to derive
        
    insurance coverage under an insurance policy or certificate subject to this Article. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Industrial project: means any (a) capital project, including one or more buildings and other structures, improvements, machinery and equipment whether or not on the same site or sites now existing or hereafter acquired, suitable for use by any manufacturing, industrial, research, transportation or commercial enterprise, including but not limited to use as a factory, mill, processing plant, assembly plant, packaging plant, fabricating plant, office building, industrial distribution center, warehouse, repair, overhaul or service facility, freight terminal, research facility, test facility, railroad facility, or commercial facility, and including also the sites thereof and other rights in land therefor whether improved or unimproved, site preparation and landscaping, and all appurtenances and facilities incidental thereto such as utilities, access roads, railroad sidings, truck docking and similar facilities, parking facilities, dockage, wharfage, and other improvements necessary or convenient thereto; or (b) land, buildings, machinery or equipment comprising an addition to or renovation, rehabilitation or improvement of any existing capital project; (c) construction, remodeling or conversion of a structure to be leased to the Illinois Department of Corrections for the purposes of its serving as a correctional institution or facility pursuant to paragraph (c) of Section 3-2-2 of the Unified Code of Corrections; or (d) construction, remodeling or conversion of a structure to be leased to the Department of Central Management Services for the purpose of serving as a State facility pursuant to Section 405-320 of the Department of Central Management Services Law (20 ILCS 405/405-320).   • Initiative: means the Urban Weatherization Initiative. See Illinois Compiled Statutes 30 ILCS 738/40-5
  • Installment lease contract: means a lease
  •     
    contract that authorizes or requires the delivery of goods in separate lots to be separately accepted, even though the lease contract contains a clause "each delivery is a separate lease" or its equivalent. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Institutional source: means any person or governmental entity that provides information about an individual to an agent, insurance institution or insurance-support organization, other than:
            (1) an agent,
            (2) the individual who is the subject of the
  •     
    information, or
            (3) a natural person acting in a personal capacity
        
    rather than in a business or professional capacity. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Insurance institution: means any corporation, association, partnership, reciprocal exchange, inter-insurer, Lloyd's insurer, fraternal benefit society or other person engaged in the business of insurance, health maintenance organizations as defined in Section 2 of the Health Maintenance Organization Act, voluntary health services plans as defined in Section 2 of the Voluntary Health Services Plans Act, and dental service plans as defined in Section 4 of the Dental Service Plan Act. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Insurance transaction: means any transaction involving insurance primarily for personal, family or household needs rather than business or professional needs which entails:
            (1) the determination of an individual's eligibility
  •     
    for an insurance coverage, benefit or payment, or
            (2) the servicing of an insurance application,
        
    policy, contract or certificate. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Insurance-support organization: means :
            (1) any person who regularly engages, in whole or in
  •     
    part, in the practice of assembling or collecting information about natural persons for the primary purpose of providing the information to an insurance institution or agent for insurance transactions, including:
                (a) the furnishing of consumer reports or
            
    investigative consumer reports to an insurance institution or agent for use in connection with an insurance transaction, or
                (b) the collection of personal information from
            
    insurance institutions, agents or other insurance-support organizations for the purpose of detecting or preventing fraud, material misrepresentation or material nondisclosure in connection with insurance underwriting or insurance claim activity. See Illinois Compiled Statutes 215 ILCS 5/1003
  • insured: as used in this article , shall not be construed as preventing a person other than the insured with a proper insurable interest from making application for and owning a policy covering the insured or from being entitled under such a policy to any indemnities, benefits and rights provided therein. See Illinois Compiled Statutes 215 ILCS 5/357.28
  • Insured: means an individual entitled to reimbursement for expenses of health care services under a policy or subscriber contract issued or administered by an insurer. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Insurer: means an insurance company or a health service corporation authorized in this State to issue policies or subscriber contracts which reimburse for expenses of health care services. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Insurers: means insurance companies and reciprocals licensed and authorized to write Class 3 policies of insurance, as defined in this Code, within Illinois. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Intended use plan: means a plan which includes a description of the short and long term goals and objectives of the Water Pollution Control Loan Program and the Public Water Supply Loan Program, project categories, discharge requirements, terms of financial assistance and the loan applicants to be served. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Intergovernmental cooperative: means an intergovernmental cooperative organized pursuant to Article VII, Section 10 of the Illinois Constitution and Section 6 of the Intergovernmental Cooperation Act. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Investigative consumer report: means a consumer report or portion thereof in which information about a natural person's character, general reputation, personal characteristics or mode of living is obtained through personal interviews with the person's neighbors, friends, associates, acquaintances or others who may have knowledge concerning such items of information. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Issuer: means a bailee that issues a document of
  •     
    title or, in the case of an unaccepted delivery order, the person that orders the possessor of goods to deliver. See Illinois Compiled Statutes 810 ILCS 5/7-102
  • Juvenile detention home: means a public facility
  •     
    with specially trained staff that conforms to the county juvenile detention standards adopted by the Department of Juvenile Justice. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Juvenile sex offender: means any person who is adjudicated a juvenile delinquent as the result of the commission of or attempt to commit a violation set forth in item (B), (C), or (C-5) of Section 2 of the Sex Offender Registration Act, or a violation of any substantially similar federal, Uniform Code of Military Justice, sister state, or foreign country law, and whose adjudication occurred on or after the effective date of this amendatory Act of the 91st General Assembly. See Illinois Compiled Statutes 730 ILCS 152/105
  • Land use assumptions: means a description of the service area or areas and the roads, streets or highways incorporated therein, including projections relating to changes in land uses, densities and population growth rates which affect the level of traffic within the service area or areas over a 20 year period of time. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Law enforcement agency having jurisdiction: includes the location where out-of-state students attend school and where out-of-state employees are employed or are otherwise required to register. See Illinois Compiled Statutes 730 ILCS 152/105
  • Laws now in force: and words of similar import, mean the laws in force at the time the Act containing the words shall take effect. See Illinois Compiled Statutes 5 ILCS 70/1.18
  • Lease: means a transfer of the right to
  •     
    possession and use of goods for a term in return for consideration, but a sale, including a sale on approval or a sale or return, or retention or creation of a security interest is not a lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lease agreement: means the bargain, with respect
  •     
    to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this Article. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lease contract: means the total legal obligation
  •     
    that results from the lease agreement as affected by this Article and any other applicable rules of law. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Leasehold interest: means the interest of the
  •     
    lessor or the lessee under a lease contract. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Legal guardian: means a person appointed by a court of competent jurisdiction to exercise certain powers on behalf of an adult with a mental disability. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Legal guardian: means a person appointed by a court of competent jurisdiction to exercise certain powers on behalf of a family member and with whom the family member resides. See Illinois Compiled Statutes 405 ILCS 80/3-3
  • Lessee: means a person who acquires the right to
  •     
    possession and use of goods under a lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lessor: means a person who transfers the right
  •     
    to possession and use of goods under a lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Level of service: means one of the categories of road service as defined by the Institute of Transportation Engineers which shall be selected by a unit of local government imposing the impact fee as the adopted level of service to serve existing development not subject to the fee and new development, provided that the level of service selected for new development shall not exceed the level of service adopted for existing development. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Licensed establishment: means the premises specified in a retailer's license pursuant to paragraph (d) of Section 5-1 and whose primary business is the sale of alcoholic beverages on the premises, which premises are located in any municipality having more than 2,000,000 inhabitants. See Illinois Compiled Statutes 235 ILCS 5/9-1
  • Licensed Professional Engineer: means a person, corporation, or partnership licensed under the laws of the State of Illinois to practice professional engineering. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Licensed Professional Geologist: means a person licensed under the laws of the State of Illinois to practice as a professional geologist. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Licensed Professional Geologist: means a person licensed under the laws of the State of Illinois to practice as a professional geologist. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Licensed service company: means an entity licensed under Section 464a of the Illinois Insurance Code to perform claims adjusting, loss control and data processing. See Illinois Compiled Statutes 215 ILCS 5/1102
  • Lien: means a charge against or interest in
  •     
    goods to secure payment of a debt or performance of an obligation, but the term does not include a security interest. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Living Unit: shall mean that physical portion designated for separate ownership or occupancy for residential purposes, of a building or group of buildings, permanently affixed to realty located in Illinois, having elements which are owned or used in common, including a condominium unit, a cooperative unit or any other similar unit. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Living Unit Coverage: means mine subsidence insurance for a living unit covering the losses described in Section 805. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Loan: means a loan made from the Water Pollution Control Loan Program or the Public Water Supply Loan Program to an eligible applicant as a result of a contractual agreement between the Agency and such applicant. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Local franchising authority: means the local unit of government that has or requires a franchise with a cable operator, a provider of cable services, or a provider of video services to construct or operate a cable or video system or to offer cable services or video services under Section 11-42-11 of the Illinois Municipal Code (65 ILCS 5/11-42-11) or Section 5-1095 of the Counties Code (55 ILCS 5/5-1095). See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Local government unit: means a county, municipality, township, municipal or county sewerage or utility authority, sanitary district, public water district, improvement authority or any other political subdivision whose primary purpose is to construct, operate and maintain wastewater treatment facilities, including storm water treatment systems, or public water supply facilities or both. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Local governmental unit: means any unit of local government or school district. See Illinois Compiled Statutes 735 ILCS 5/20-101
  • Local unit of government: means a city, village, incorporated town, or county. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Long-term care facility: means (i) a nursing facility, whether public or private and whether organized for profit or not-for-profit, that is subject to licensure by the Illinois Department of Public Health under the Nursing Home Care Act, the ID/DD Community Care Act, or the MC/DD Act, including a county nursing home directed and maintained under Section 5-1005 of the Counties Code, and (ii) a part of a hospital in which skilled or intermediate long-term care services within the meaning of Title XVIII or XIX of the Social Security Act are provided; except that the term "long-term care facility" does not include a facility operated by a State agency or operated solely as an intermediate care facility for the mentally retarded within the meaning of Title XIX of the Social Security Act. See Illinois Compiled Statutes 305 ILCS 5/5B-1
  • Long-term care provider: means (i) a person licensed by the Department of Public Health to operate and maintain a skilled nursing or intermediate long-term care facility or (ii) a hospital provider that provides skilled or intermediate long-term care services within the meaning of Title XVIII or XIX of the Social Security Act. See Illinois Compiled Statutes 305 ILCS 5/5B-1
  • Lot: means a parcel or a single article that is
  •     
    the subject matter of a separate lease or delivery, whether or not it is sufficient to perform the lease contract. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Low-income household: means those residential households located within the holder's existing telephone service area where the average annual household income is less than $35,000, based on the United States Census Bureau estimates adjusted annually to reflect rates of change and distribution. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Marking device: means either an apparatus in which ballots or ballot cards are inserted and used in connection with a punch apparatus for the piercing of ballots by the voter, or any approved device for marking a paper ballot with ink or other substance which will enable the ballot to be tabulated by means of automatic tabulating equipment or by an electronic scanning process. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • Marking device: means a pen, computer, or other device approved by the State Board of Elections for marking, or causing to be marked, a paper ballot with ink or other substance which will enable the ballot to be tabulated by automatic tabulating equipment or by an electronic scanning process. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • MCO: means an entity that meets the definition of health maintenance organization as defined in the Health Maintenance Organization Act, is licensed, regulated and in good standing with the Department of Insurance, and is authorized to participate in the nursing home component of the Medicare-Medicaid Alignment Initiative Demonstration Project by a 3-way contract with the Department of Healthcare and Family Services and the Centers for Medicare and Medicaid Services. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Medical facility: includes a hospital, infirmary, clinic, dispensary, mental institution or similar facility. See Illinois Compiled Statutes 745 ILCS 10/6-101
  • Medical professional: means any person licensed or certified to provide health care services to natural persons, including but not limited to, a physician, dentist, nurse, optometrist, chiropractor, naprapath, pharmacist, physical or occupational therapist, psychiatric social worker, speech therapist, clinical dietitian or clinical psychologist. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Medical-care institution: means any facility or institution that is licensed to provide health care services to natural persons, including but not limited to: hospitals, skilled nursing facilities, home-health agencies, medical clinics, rehabilitation agencies and public-health agencies and health-maintenance organizations. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Medical-record information: means personal information which:
            (1) relates to an individual's physical or mental
  •     
    condition, medical history or medical treatment, and
            (2) is obtained from a medical professional or
        
    medical-care institution, from the individual, or from the individual's spouse, parent or legal guardian. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Medically necessary: means health care services that a medical professional, exercising prudent clinical judgment, would provide to a patient for the purpose of preventing, evaluating, diagnosing, or treating an illness, injury, or disease or its symptoms, and that are: (i) in accordance with the generally accepted standards of medical practice; (ii) clinically appropriate, in terms of type, frequency, extent, site, and duration, and considered effective for the patient's illness, injury, or disease; and (iii) not primarily for the convenience of the patient, a medical professional, other health care provider, caregiver, family member, or other interested party. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Medicare bed days: means , for each hospital, the sum of the number of days that each bed was occupied by a patient who was covered by Title XVIII of the Social Security Act, excluding days attributable to the routine services provided to persons receiving skilled or intermediate long term care services. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Merchant lessee: means a lessee that is a
  •     
    merchant with respect to goods of the kind subject to the lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Metropolitan Area: means all that territory in the State of Illinois lying within the corporate boundaries of the municipality or municipalities establishing an authority as provided in this Division. See Illinois Compiled Statutes 65 ILCS 5/11-48.3-2
  • Mine Subsidence: means lateral or vertical ground movement caused by a failure initiated at the mine level, of man-made underground mines, including, but not limited to coal mines, clay mines, limestone mines, and fluorspar mines that directly damages residences or commercial buildings. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Minor: means a person under the age of 21 years
  •     
    subject to this Act. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • municipal: refers to any such municipality. See Illinois Compiled Statutes 65 ILCS 5/11-29.1-1
  • municipality: means any city, village or incorporated town; and "municipal" refers to any such municipality. See Illinois Compiled Statutes 65 ILCS 5/11-29.1-1
  • Municipality: includes any city, village or incorporated town in this State. See Illinois Compiled Statutes 65 ILCS 5/11-74-2
  • Municipality: means an incorporated city, village, or town in this State. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • museum district: means a museum district organized under this Division. See Illinois Compiled Statutes 55 ILCS 5/5-31003
  • Netting agreement: as used in this Article , means (a) a contract or agreement (including terms and conditions incorporated by reference therein), including a master agreement (which master agreement, together with all schedules, confirmations, definitions, and addenda thereto and transactions under any thereof, shall be treated as one netting agreement), that documents one or more transactions between the parties to the agreement for or involving one or more qualified financial contracts and that provides for the netting, liquidation, setoff, termination, acceleration, or close out under or in connection with one or more qualified financial contracts or present or future payment or delivery obligations or payment or delivery entitlements thereunder (including liquidation or close-out values relating to such obligations or entitlements) among the parties to the netting agreement; (b) any master agreement or bridge agreement for one or more master agreements described in paragraph (a) of this subsection (8); or (c) any security agreement or arrangement or other credit enhancement or guarantee or reimbursement obligation related to any contract or agreement described in paragraph (a) or (b) of this subsection (8); provided that any contract or agreement described in paragraphs (a) or (b) of this subsection (8) relating to agreements or transactions that are not qualified financial contracts shall be deemed to be a netting agreement only with respect to those agreements or transactions that are qualified financial contracts. See Illinois Compiled Statutes 215 ILCS 5/187
  • New development: means any residential, commercial, industrial or other project which is being newly constructed, reconstructed, redeveloped, structurally altered, relocated, or enlarged, and which generates additional traffic within the service area or areas of the unit of local government. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Noninstitutional provider: means any person licensed under the Medical Practice Act of 1987, as now or hereafter amended. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Normal cost: means that part of the actuarial present value of all future benefit payments and appropriate administrative expenses assigned to the current year under the actuarial valuation method used by the plan (excluding any amortization of the unfunded accrued liability). See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Nursing home: means (i) a skilled nursing or intermediate long-term care facility, whether public or private and whether organized for profit or not-for-profit, that is subject to licensure by the Illinois Department of Public Health under the Nursing Home Care Act, the ID/DD Community Care Act, or the MC/DD Act, including a county nursing home directed and maintained under Section 5-1005 of the Counties Code, and (ii) a part of a hospital in which skilled or intermediate long-term care services within the meaning of Title XVIII or XIX of the Social Security Act are provided; except that the term "nursing home" does not include a facility operated solely as an intermediate care facility for the intellectually disabled within the meaning of Title XIX of the Social Security Act or a specialized mental health rehabilitation facility. See Illinois Compiled Statutes 305 ILCS 5/5E-5
  • Nursing home: means a facility licensed under the Nursing Home Care Act. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Nursing home provider: means (i) a person licensed by the Department of Public Health to operate and maintain a skilled nursing or intermediate long-term care facility which charges its residents, a third party payor, Medicaid, or Medicare for skilled nursing or intermediate long-term care services, or (ii) a hospital provider that provides skilled or intermediate long-term care services within the meaning of Title XVIII or XIX of the Social Security Act. See Illinois Compiled Statutes 305 ILCS 5/5E-5
  • Occupied bed days: means the sum of the number of days that each bed was occupied by a patient for all beds, excluding days attributable to the routine services provided to persons receiving skilled or intermediate long term care services. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Occurrence: means an accident, including continuous or repeated exposure to conditions, that results in a sudden or nonsudden release from an underground storage tank. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Official state newspaper: means the newspaper designated and certified to the Commission annually by the Director of Central Management Services of the State of Illinois, or, if said Director fails to certify to the Commission the name and address of the official newspaper selected by the Director prior to expiration of the previous certification, the newspaper designated in the most recent certification. See Illinois Compiled Statutes 625 ILCS 5/18c-1104
  • open space: means any space or area of land or water of an area of 50 acres or more, the preservation or the restriction of development or use of which would (i) maintain or enhance the conservation of natural or scenic resources; (ii) protect natural streams or water supply; (iii) promote conservation of soils, wet lands, or shores; (iv) afford or enhance public outdoor recreation opportunities; (v) preserve flora and fauna, geological features, historic sites, or other areas of educational or scientific interest; (vi) enhance the value to the public of abutting or neighboring highways, parks, or other public lands; (vii) implement the plan of development adopted by the planning commission of any municipality or county; or (viii) promote orderly urban or suburban development. See Illinois Compiled Statutes 60 ILCS 1/115-5
  • Open space plan: means the written plan adopted by the board to implement an open space program and includes properly adopted amendments or additions to the plan. See Illinois Compiled Statutes 60 ILCS 1/115-5
  • Open space program: means the acquisition of the fee or of a lesser right or interest in tracts of open land in the township for open space purposes. See Illinois Compiled Statutes 60 ILCS 1/115-5
  • Open space purposes: includes (i) the preservation and maintenance of open land, scenic roadways, and pathways; (ii) the holding of real property described in clause (i), with or without public access, for the education, pleasure, and recreation of the public or for other open space values; (iii) the preservation of portions of that property in their natural condition and the development of other portions of that property; (iv) the management and use of that property in a manner and with restrictions that will leave it unimpaired for the benefit of future generations; and (v) otherwise promoting the conservation of the nature, flora and fauna, natural environment, and natural resources of the township. See Illinois Compiled Statutes 60 ILCS 1/115-5
  • Outpatient gross revenue: means , for each hospital, its total gross charges attributed to outpatient services as reported on the Medicare cost report at Worksheet C, Part I, Column 7, line 101, less the sum of lines 45, 60, 63, 64, 65, 66, 67, and 68 (and any subsets of those lines). See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • own home: means that an adult with a mental disability lives alone; or that an adult with a mental disability is in full-time residence with his or her parents, legal guardian, or other relatives; or that an adult with a mental disability is in full-time residence in a setting not subject to licensure under the Nursing Home Care Act, the Specialized Mental Health Rehabilitation Act of 2013, the ID/DD Community Care Act, the MC/DD Act, or the Child Care Act of 1969, as now or hereafter amended, with 3 or fewer other adults unrelated to the adult with a mental disability who do not provide home-based services to the adult with a mental disability. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Paralegal: means a person who is qualified through education, training, or work experience and is employed by a lawyer, law office, governmental agency, or other entity to work under the direction of an attorney in a capacity that involves the performance of substantive legal work that usually requires a sufficient knowledge of legal concepts and would be performed by the attorney in the absence of the paralegal. See Illinois Compiled Statutes 5 ILCS 70/1.35
  • Parent: means the biological or adoptive parent of an adult with a mental disability, or a person licensed as a foster parent under the laws of this State who acts as a foster parent to an adult with a mental disability. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Parent: means a biological or adoptive parent with whom the family member resides, or a person licensed as a foster parent under the laws of this State, acting as a family member's foster parent, and with whom the family member resides. See Illinois Compiled Statutes 405 ILCS 80/3-3
  • Participant: means a minor placed into an electronic monitoring program. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Participant: means a participating member or deferred pensioner or annuitant of a pension fund as provided in the Article of this Code under which the pension fund is established, or a beneficiary thereof. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Participating taxpayer: means any person subject to the revenue laws administered by the Department who enters into an engagement with a qualified practitioner for tax compliance review and who is approved by the Department under the certified audit project. See Illinois Compiled Statutes 720 ILCS 5/2-5
  • Participating unit of local government: means a unit of local government which has entered into an intergovernmental agreement or contract with a county for the administrative adjudication of violations of its ordinances by the county pursuant to this Division. See Illinois Compiled Statutes 55 ILCS 5/5-43010
  • Passenger rail systems: includes all passenger rail systems maintained by the National Passenger Railroad Corporation in Illinois and those passenger rail systems under the jurisdiction of the Commuter Rail Board as established in Section 3B. See Illinois Compiled Statutes 725 ILCS 5/124B-1020
  • Patient: means the principal or, if the agency governs health care for a minor child of the principal, then the child. See Illinois Compiled Statutes 755 ILCS 45/4-4
  • Pension fund: means any public pension fund, annuity and benefit fund, or retirement system established under this Code. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Permanent paper record: means a paper record upon which shall be printed in human readable form the votes cast for each candidate and for or against each public question on each ballot recorded in the voting system. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • person: as used in this Article means an individual, an aggregation of individuals, a partnership, or a corporation. See Illinois Compiled Statutes 215 ILCS 5/187
  • Person: means any natural person, corporation, association, partnership or other legal entity. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Person: means any individual, firm, partnership, corporation, both domestic and foreign, company, association or joint stock association; and includes any trustee, receiver, assignee or personal representative thereof. See Illinois Compiled Statutes 65 ILCS 5/11-48.3-2
  • Person: shall mean any individual, partnership, association, corporation, society, order, firm, company, aggregation of individuals, reciprocal exchange, inter-insurer, Lloyds insurer, fraternal benefit society, and any other legal entity to which any article of this Code is applicable, or which is subject to examination, visitation or supervision by the Director under any provision of this Code or under any law of this State, or which is engaged or engaging in or proposing or attempting to engage in or is representing that it is doing an insurance or surety business in this State, or which is in process of organization for the purpose of doing such business, including agents, brokers, adjusters and solicitors. See Illinois Compiled Statutes 215 ILCS 5/422
  • Person: means individual, trust, firm, joint stock company, joint venture, consortium, commercial entity, corporation (including a government corporation), partnership, association, State, municipality, commission, political subdivision of a State, or any interstate body including the United States Government and each department, agency, and instrumentality of the United States. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • person: means any political subdivision of the State, municipal corporation, individual, firm, partnership, corporation, company, limited liability company, association, joint stock association, or trust, or a receiver, executor, trustee, guardian, or other representative appointed by order of any court. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • person: means any political subdivision of the State, municipal corporation, individual, firm, partnership, corporation, company, limited liability company, association, joint stock association, or trust, or a receiver, executor, trustee, guardian, or other representative appointed by order of any court. See Illinois Compiled Statutes 305 ILCS 5/5B-1
  • person: means any political subdivision of the State, municipal corporation, individual, firm, partnership, corporation, company, limited liability company, association, joint stock association, or trust, or a receiver, executor, trustee, guardian or other representative appointed by order of any court.   • Person: means any individual, firm, partnership, association, public or private corporation, organization or business, charitable trust, or unit of local government. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Person: includes any firm, corporation, association, agency, institution or other legal entity, as well as any natural person. See Illinois Compiled Statutes 735 ILCS 5/20-101
  • Personal information: includes an individual's name and address and "medical-record information" but does not include "privileged information". See Illinois Compiled Statutes 215 ILCS 5/1003
  • Physician: means an individual licensed to practice in all branches of medicine under the Medical Practice Act of 1987. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Plan year: means the calendar or fiscal year on which the records of a given plan are kept. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • policies: means any contract or contracts of insurance providing the coverage of the Standard Fire Policy and Extended Coverage Endorsement on any residence, living unit or commercial building. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Policyholder: means any person who:
            (1) in the case of individual property or casualty
  •     
    insurance, is a present named insured;
            (2) in the case of individual life, health or
        
    disability insurance, is a present policyowner; or
            (3) in the case of group insurance which is
        
    individually underwritten, is a present group certificateholder. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Political subdivision: means a township, road district, city, village or incorporated town, as the case may be. See Illinois Compiled Statutes 235 ILCS 5/9-1
  • Pool retention fund: means a separate fund maintained for payment of first dollar claims, up to a specific amount per claim ("specific retention") and up to an aggregate amount for a 12-month period ("aggregate retention"). See Illinois Compiled Statutes 215 ILCS 5/1102
  • Precinct: means any part of a city, village or incorporated town of over 200,000 population which was a "voting precinct" or an "election precinct" for voting at the last general election. See Illinois Compiled Statutes 235 ILCS 5/9-1
  • Precinct Tabulation Optical Scan Technology: means the capability to examine a ballot through electronic means and tabulate the votes at one or more counting places. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • premiums: means the gross amount charged to policyholders for the mine subsidence insurance made available under this Article. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Present value: means the amount as of a date
  •     
    certain of one or more sums payable in the future, discounted to the date certain. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Pretext interview: means an interview whereby a person, in an attempt to obtain information about a natural person, performs one or more of the following acts:
            (1) pretends to be someone he or she is not,
            (2) pretends to represent a person he or she is not
  •     
    in fact representing,
            (3) misrepresents the true purpose of the interview,
        
    or
            (4) refuses to identify himself or herself upon
        
    request. See Illinois Compiled Statutes 215 ILCS 5/1003
  • prisoner: means a person held in custody. See Illinois Compiled Statutes 745 ILCS 10/4-101
  • Privately owned community water supply: means :
             (1) an investor-owned water utility, if under
  •     
    Illinois Commerce Commission regulation and operating as a separate and distinct water utility;
            (2) a not-for-profit water corporation, if operating
        
    specifically as a water utility; and
            (3) a mutually owned or cooperatively owned community
        
    water system, if operating as a separate water utility. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Privileged information: means any individually identifiable information that: (1) relates to a claim for insurance benefits or a civil or criminal proceeding involving an individual, and (2) is collected in connection with or in reasonable anticipation of a claim for insurance benefits or civil or criminal proceeding involving an individual; provided, however, information otherwise meeting the requirements of this subsection shall nevertheless be considered "personal information" under this Article if it is disclosed in violation of Section 1014 of this Article. See Illinois Compiled Statutes 215 ILCS 5/1003
  • program: means the set of operating instructions for the automatic tabulating equipment by which it examines, counts, tabulates, canvasses and prints votes recorded by a voter on a ballot card or other medium. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • program: means the set of operating instructions for the automatic tabulating equipment that examines, counts, tabulates, canvasses and prints votes recorded by a voter on a ballot. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • program: means the set of operating instructions for the automatic tabulating equipment that examines, records, displays, counts, tabulates, canvasses, or prints votes recorded by a voter on a ballot or that displays any and all information, graphics, or other visual or audio information or images used in presenting voting information, instructions, or voter choices. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • Project: means and includes revenue producing buildings, structures and facilities which, as determined by the Board, are required by, or necessary for the use or benefit of, such University, including, without limiting the generality of the foregoing, student residence halls; apartments; staff housing facilities; dormitories; health, hospital or medical facilities; dining halls; student union buildings; field houses; stadiums; physical education installations and facilities; auditoriums; facilities for student or staff services; any facility or building leased to the United States of America; off-street parking facilities; heretofore, or as may be hereafter, acquired, with all equipment and appurtenant facilities; or any one, or more than one, or all, of the foregoing, or any combination thereof, for such University.   • Projected benefits: means benefit amounts under a plan which are expected to be paid at various future times under a particular set of actuarial assumptions, taking into account, as applicable, the effect of advancement in age and past and anticipated future compensation and service credits. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Property owner: means the legal or beneficial owner of an improved or unimproved parcel of real estate. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • Proportionate share: means the cost of road improvements that are specifically and uniquely attributable to a new development after the consideration of the following factors: the amount of additional traffic generated by the new development, any appropriate credit or offset for contribution of money, dedication of land, construction of road improvements or traffic reduction techniques, payments reasonably anticipated to be made by or as a result of a new development in the form of user fees, debt service payments, or taxes which are dedicated for road improvements and all other available sources of funding road improvements. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • provider: means the attending physician and any other person administering health care to the patient at the time of reference who is licensed, certified, or otherwise authorized or permitted by law to administer health care in the ordinary course of business or the practice of a profession, including any person employed by or acting for any such authorized person. See Illinois Compiled Statutes 755 ILCS 45/4-4
  • Provider: means an individual or entity duly licensed or legally authorized to provide health care services. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Public health clinic: means an outpatient program conducted by a locally based not-for-profit corporation, or by any local board of health whose health department is recognized by, and has a designation status established by, the Illinois Department of Public Health and complies with the Public Health Standing Orders Act. See Illinois Compiled Statutes 745 ILCS 10/6-101
  • public or community service: means uncompensated labor for a non-profit organization or public body whose purpose is to enhance physical or mental stability, environmental quality or the social welfare and which agrees to accept public or community service from offenders or those adjudged liable for civil violations of a local public entity and to report on the progress of the public or community service to the court. See Illinois Compiled Statutes 745 ILCS 10/6A-101
  • Public rights-of-way: means the areas on, below, or above a public roadway, highway, street, public sidewalk, alley, waterway, or utility easements dedicated for compatible uses. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Purchase: includes taking by sale, lease,
  •     
    mortgage, security interest, pledge, gift, or any other voluntary transaction creating an interest in goods. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Qualified financial contract: means any commodity contract, forward contract, repurchase agreement, securities contract, swap agreement, or any similar agreement that the Director determines by regulation, resolution, or order to be a qualified financial contract for the purposes of this Act. See Illinois Compiled Statutes 215 ILCS 5/187
  • Qualified practitioner: means a certified public accountant who is licensed to practice in Illinois and who has completed the certification program. See Illinois Compiled Statutes 720 ILCS 5/2-5
  • RAI Manual: means the most recent Resident Assessment Instrument Manual, published by the Centers for Medicare and Medicaid Services. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Rail yard: means a system of parallel tracks, cross-overs and switches where cars are switched and made up into trains, and where cars, locomotives, and other rolling stock are kept when not in use or awaiting repairs. See Illinois Compiled Statutes 625 ILCS 5/18c-1104
  • Receiver: means a person who is licensed under Section 3c of the Motor Fuel Tax Law and who either produces, refines, blends, compounds or manufactures fuel in this State, or transports fuel into this State or receives fuel transported to him from without the State or exports fuel out of this State, or who is engaged in distribution of fuel primarily by tank car or tank truck, or both, and who operates an Illinois bulk plant that has active fuel bulk storage capacity of not less than 30,000 gallons. See Illinois Compiled Statutes 415 ILCS 125/305
  • Receiving township: means a township into which a portion of the dissolving township will be merged. See Illinois Compiled Statutes 60 ILCS 1/23-5
  • recipient: means only those persons receiving aid under Article IV. See Illinois Compiled Statutes 305 ILCS 5/9A-2
  • Record: means information that is inscribed on
  •     
    a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Illinois Compiled Statutes 810 ILCS 5/7-102
  • Recycling: means the transfer of brush, wood chips, or leaves by employees of the township to a facility or place that will utilize the product without charge. See Illinois Compiled Statutes 60 ILCS 1/210-10
  • Redundant count: means a verification of the original computer count by another count using compatible equipment or by hand as part of a discovery recount. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • Redundant count: means a verification of the original computer count by another count using compatible equipment or by hand as part of a discovery recount. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Redundant count: means a verification of the original computer count of ballots by another count using compatible equipment or other means as part of a discovery recount, including a count of the permanent paper record of each ballot cast by using compatible equipment, different equipment approved by the State Board of Elections for that purpose, or by hand. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • Refuse: means (i) combustible trash, including but not limited to paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, and bedding; (ii) noncombustible trash, including but not limited to metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, and other mineral waste; and (iii) street rubbish, including but not limited to street sweepings, dirt, leaves, catch-basin dirt, and contents of litter receptacles. See Illinois Compiled Statutes 60 ILCS 1/210-10
  • Refuse: means combustible trash, including, but not limited to, paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, bedding; noncombustible trash, including, but not limited to, metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, other mineral waste; street rubbish, including, but not limited to, street sweepings, dirt, leaves, catch-basin dirt, contents of litter receptacles, but refuse does not mean earth and wastes from building operations, nor shall it include solid wastes resulting from industrial processes and manufacturing operations such as food processing wastes, boiler-house cinders, lumber, scraps and shavings. See Illinois Compiled Statutes 65 ILCS 5/11-19-2
  • Regulated substance: means any hazardous substance as defined under Section 101(14) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (P. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Regulated substance of concern: means any contaminant that is expected to be present at the site based upon past and current land uses and associated releases that are known to the Remediation Applicant based upon reasonable inquiry. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Release: means any spilling, leaking, emitting, discharging, escaping, leaching or disposing of petroleum from an underground storage tank into groundwater, surface water or subsurface soils. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • relocator: means any person or entity engaged in the business of removing trespassing vehicles from private property by means of towing or otherwise, and thereafter relocating and storing such vehicles;
         (2) "Commission" means the Illinois Commerce Commission;
         (3) "Operator" means any person who, as an employee of a commercial vehicle relocator, removes trespassing vehicles from private property by means of towing or otherwise. See Illinois Compiled Statutes 625 ILCS 5/18a-100
  • RELPEG: means a Licensed Professional Engineer or a Licensed Professional Geologist engaged in review and evaluation under this Title. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Remedial action: means activities associated with compliance with the provisions of Sections 58. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Remediation costs: means reasonable costs paid for investigating and remediating regulated substances of concern consistent with the remedy selected for a site. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • reorganize: means reorganize, reincorporate, or domesticate as an Illinois insurer; "reorganization" means reorganization, reincorporation, or domestication as an Illinois insurer; "reorganized company" means any company that has availed itself of the provisions of this Article, and the reorganization of which has been effected as in this Article provided; and "similar domestic company" means, in the case of an application for reorganization as a domestic captive insurance company, a domestic captive insurance company organized under Article VIIC. See Illinois Compiled Statutes 215 ILCS 5/180
  • Residence: means a building used principally for residential purposes up to and including a four family dwelling, permanently affixed to realty located in Illinois, including appurtenant structures, driveways, sidewalks, basements, footings, foundations, septic systems and underground pipes directly servicing the dwelling or building, but does not include living units, land, trees, plants, crops or agricultural field drainage tile. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Resident: means an enrollee who is receiving personal or medical care, including, but not limited to, mental health treatment, psychiatric rehabilitation, physical rehabilitation, and assistance with activities of daily living, from a nursing home. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Residential Coverage: means mine subsidence insurance for a residence. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Residential development: means a house, building, or other structure that is suitable or capable of being used for residential purposes. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Residential property: means any real property that is used for habitation by individuals and other property uses defined by Board rules such as education, health care, child care and related uses. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Residual market mechanism: means an association, organization or other entity described in Article XXXIII of this Act, or Section 7-501 of The Illinois Vehicle Code. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Respondent: means a property owner, waste hauler or other person charged with liability for an alleged code violation and the person to whom the notice of violation is directed. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • River Edge Redevelopment Zone: has the meaning set forth under the River Edge Redevelopment Zone Act. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Road improvement impact fee: means any charge or fee levied or imposed by a unit of local government as a condition to the issuance of a building permit or a certificate of occupancy in connection with a new development, when any portion of the revenues collected is intended to be used to fund any portion of the costs of road improvements. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • safety relocator: means any person or entity engaged in the business of removing damaged or disabled vehicles from public or private property by means of towing or otherwise, and thereafter relocating and storing such vehicles. See Illinois Compiled Statutes 625 ILCS 5/18d-105
  • Sanitation inspector: means a municipal employee authorized to issue citations for code violations and to conduct inspections of public or private real property in a municipality to determine if code violations exist. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • Security designation: means a printed designation placed on a ballot to identify to the computer program the offices and propositions for which votes may be cast and to indicate the manner in which votes cast should be tabulated while negating any inadmissible votes. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Security punch: means a punch placed on a ballot card to identify to the computer program the offices and propositions for which votes may be cast and to indicate the manner in which votes cast should be tabulated while negating any inadmissible votes. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • Sentencing hearing: means a hearing to
  •     
    determine whether a minor should be adjudged a ward of the court, and to determine what sentence should be imposed on the minor. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Separate ballot: means a separate page or display screen of the ballot that is clearly defined and distinguishable from other portions of the ballot. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • Service: means the provision of cable service or video service to subscribers and the interaction of subscribers with the person or entity that has received authorization to offer or provide cable or video service from the Commission pursuant to Section 21-401 of this Act. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Service area: means one or more land areas within the boundaries of the unit of local government which has been designated by the unit of local government in the comprehensive road improvement plan. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Service provider fee: means the amount paid under Section 21-801 of this Act by the holder to a municipality, or in the case of an unincorporated service area to a county, for service areas within its territorial jurisdiction, but under no circumstances shall the service provider fee be paid to more than one local unit of government for the same portion of the holder's service area. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Severe and multiple impairments: means the manifestation of all of the following characteristics:
             (1) The evaluation determines the presence of a
  •     
    developmental disability which is expected to continue indefinitely, constitutes a substantial disability and is attributable to any of the following:
                (A) Intellectual disability, which is defined as
            
    general intellectual functioning that is 2 or more standard deviations below the mean concurrent with impairment of adaptive behavior which is 2 or more standard deviations below the mean. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Severe and multiple impairments: means the manifestation of all the following characteristics:
             (1) The evaluation determines the presence of a
  •     
    developmental disability which is expected to continue indefinitely, constitutes a substantial disability and is attributable to any of the following:
                (A) Intellectual disability, which is defined as
            
    general intellectual functioning that is 2 or more standard deviations below the mean concurrent with impairment of adaptive behavior which is 2 or more standard deviations below the mean. See Illinois Compiled Statutes 405 ILCS 80/3-3
  • Severe autism: means a lifelong developmental disability which is typically manifested before 30 months of age and is characterized by severe disturbances in reciprocal social interactions; verbal and nonverbal communication and imaginative activity; and repertoire of activities and interests. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Severe autism: means a lifelong developmental disability which is typically manifested before 30 months of age and is characterized by severe disturbances in reciprocal social interactions; verbal and nonverbal communication and imaginative activity; and repertoire of activities and interests.   • Severe mental illness: means the manifestation of all of the following characteristics:
             (1) A primary diagnosis of one of the major mental

    disorders in the current edition of the Diagnostic and Statistical Manual of Mental Disorders listed below:
                (A) Schizophrenia disorder. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Severe mental illness: means the manifestation of all of the following characteristics:
             (1) a severe mental illness characterized by the
  •     
    presence of a mental disorder in children or adolescents, classified in the Diagnostic and Statistical Manual of Mental Disorders (Third Edition - Revised), as now or hereafter revised, excluding V-codes (as that term is used in the current edition of the Diagnostic and Statistical Manual of Mental Disorders), adjustment disorders, the presence of an intellectual disability when no other mental disorder is present, alcohol or substance abuse, or other forms of dementia based upon organic or physical disorders; and
            (2) a functional disability of an extended duration
        
    which results in substantial limitations in major life activities. See Illinois Compiled Statutes 405 ILCS 80/3-3
  • Severe or profound intellectual disability: means a manifestation of all of the following characteristics:
             (1) A diagnosis which meets Classification in Mental
  •     
    Retardation or criteria in the current edition of the Diagnostic and Statistical Manual of Mental Disorders for severe or profound mental retardation (an IQ of 40 or below). See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Severe or profound intellectual disability: means a manifestation of all of the following characteristics:
             (1) A diagnosis which meets Classification in Mental
  •     
    Retardation or criteria in the current edition of the Diagnostic and Statistical Manual of Mental Disorders for severe or profound mental retardation (an IQ of 40 or below). See Illinois Compiled Statutes 405 ILCS 80/3-3
  • Sewerage system: means and includes any one or more of the following: sewerage treatment plant or plants, collecting, intercepting, and outlet sewers, lateral sewers and drains, including combined and separate storm water and sanitary drains, force mains, conduits, pumping stations, ejector stations, and all other appurtenances, extensions, and improvements necessary, useful, or convenient for the collection, treatment, and disposal in a sanitary manner of sewage and industrial wastes. See Illinois Compiled Statutes 60 ILCS 1/205-5
  • Sewerage system: means and includes any or all of the following: a sewerage treatment plant or plants, collecting, intercepting and outlet sewers, lateral sewers, and drains, including combined and separate storm water and sanitary drains, force mains, conduits, pumping stations, ejector stations and all other appurtenances, extensions and improvements necessary, useful, or convenient for the collection, treatment, and disposal in a sanitary manner of sewage and industrial wastes. See Illinois Compiled Statutes 65 ILCS 5/11-139-1
  • sewerage system: means and includes any or all of the following: a sewage treatment plant or plants, collecting, intercepting and outlet sewers, force mains, conduits, lateral sewers and extensions, pumping stations, ejector stations, and all other appurtenances, extensions or improvements necessary or useful and convenient for the collection, treatment, and disposal, in a sanitary manner, of sewage and industrial wastes. See Illinois Compiled Statutes 65 ILCS 5/11-141-1
  • sewerage system: means and includes any or all of the following: Sewerage treatment plant or plants, collecting, intercepting, and outlet sewers, lateral sewers and drains, including combined storm water and sanitary drains, force mains, conduits, pumping stations, ejector stations, and all other appurtenances, extensions and improvements necessary, useful or convenient for the collection, treatment and disposal in a sanitary manner of storm water, sanitary sewage and industrial wastes.   • Sex offender: means any sex offender as defined in the Sex Offender Registration Act whose offense or adjudication as a sexually dangerous person occurred on or after June 1, 1996, and whose victim was under the age of 18 at the time the offense was committed but does not include the offenses set forth in subsection (b)(1. See Illinois Compiled Statutes 730 ILCS 152/105
  • Shelter: means the temporary care of a minor in
  •     
    physically unrestricting facilities pending court disposition or execution of court order for placement. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Shipper: means a person that enters into a
  •     
    contract of transportation with a carrier. See Illinois Compiled Statutes 810 ILCS 5/7-102
  • Site: means a not-for-profit organization,
  •     
    public body, church, charitable organization, or individual agreeing to accept community service from offenders and to report on the progress of ordered or required public or community service to the court or to the authorized diversion program that has referred the offender for public or community service. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Site: means any single location, place, tract of land or parcel of property including contiguous property not separated by a public right-of-way. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Site: means any single location, place, tract of land or parcel of property, or portion thereof, including contiguous property separated by a public right-of-way. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Site investigation: means activities associated with compliance with the provisions of subsection (a) of Section 57. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Site specific development approval: means an approval of a plan submitted by a developer to a unit of local government describing with reasonable certainty the type and intensity of use for a specific parcel or parcels of property. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Specifically and uniquely attributable: means that a new development creates the need, or an identifiable portion of the need, for additional capacity to be provided by a road improvement. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Specimen ballot: means a representation of names of offices and candidates and statements of measures to be voted on which will appear on the official ballot or marking device on election day. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • superhighways: means streets, avenues, roads and drives constituting limited access roadways, with all auxiliary streets, avenues, roads, drives, bridges, viaducts, underpasses, and approaches for ingress and egress to and from the main thoroughfares of such streets, avenues, roads, and drives, and other necessary or appropriate appurtenances thereto, to facilitate the movement of through traffic, to be constructed in accordance with the resolutions of the County Board heretofore or hereafter approved by the Department of Public Works and Buildings or the Department of Transportation of the State of Illinois. See Illinois Compiled Statutes 55 ILCS 5/5-33007
  • Supervising authority: means the Department of Juvenile Justice, probation supervisory authority, sheriff, superintendent of a juvenile detention center, or any other officer or agency charged with authorizing and supervising home detention. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Supplier: means a person from whom a lessor buys
  •     
    or leases goods to be leased under a finance lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Supportive living facility: means an enrolled supportive living site as described under Section 5-5. See Illinois Compiled Statutes 305 ILCS 5/5G-5
  • System: means a waterworks system, a sewerage system, or any separate integral part of a waterworks system or a sewerage system, or a waterworks system and sewerage system in combination as authorized and provided in Section 205-10. See Illinois Compiled Statutes 60 ILCS 1/205-5
  • system: means the total combination of mechanical, electromechanical or electronic equipment, programs and practices used to define ballots, cast and count votes, report or display election results, maintain or produce any audit trail information, identify all system components, test the system during development, maintenance and operation, maintain records of system errors and defects, determine specific system changes to be made to a system after initial qualification, and make available any materials to the voter such as notices, instructions, forms or paper ballots. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • System of administrative adjudication: means the adjudication of any violation of a county ordinance or of a participating unit of local government's ordinance, except for (i) proceedings not within the statutory or the home rule authority of counties or a participating unit of local government; and (ii) any offense under the Illinois Vehicle Code (or a similar offense that is a traffic regulation governing the movement of vehicles and except for any reportable offense under Section 6-204 of the Illinois Vehicle Code).   • teachers: means and includes all members of the teaching force excluding the general superintendent and principals. See Illinois Compiled Statutes 105 ILCS 5/34-84
  • Telecommunications service area: means the area designated by the Commission as the area in which a telecommunications company was obligated to provide non-competitive local telephone service as of February 8, 1996 as incorporated into Section 13-202. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Transfer instrument: means the legal document intended to effectuate a transfer effective on or after the transferor's death and includes, without limitation, a will, trust, deed, form designated as payable on death, contract, or other beneficiary designation form. See Illinois Compiled Statutes 755 ILCS 5/4a-5
  • Transferee: means a legatee, a beneficiary of a trust, a grantee of a deed, or any other person designated in a transfer instrument to receive a nonprobate transfer. See Illinois Compiled Statutes 755 ILCS 5/4a-5
  • Transferor: means a testator, settlor, grantor of a deed, or a decedent whose interest is transferred pursuant to a nonprobate transfer. See Illinois Compiled Statutes 755 ILCS 5/4a-5
  • Treatment works: means treatment works, as defined in Section 212 of the Federal Water Pollution Control Act, including, but not limited to, the following: any devices and systems owned by a local government unit and used in the storage, treatment, recycling, and reclamation of sewerage or industrial wastes of a liquid nature, including intercepting sewers, outfall sewers, sewage collection systems, pumping power and other equipment, and appurtenances; extensions, improvements, remodeling, additions, and alterations thereof; elements essential to provide a reliable recycled supply, such as standby treatment units and clear well facilities; any works, including site acquisition of the land that will be an integral part of the treatment process for wastewater facilities; and any other method or system for preventing, abating, reducing, storing, treating, separating, or disposing of municipal waste, including storm water runoff, or industrial waste, including waste in combined storm water and sanitary sewer systems as those terms are defined in the Federal Water Pollution Control Act. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Trial: means a hearing to determine whether the
  •     
    allegations of a petition under Section 5-520 that a minor is delinquent are proved beyond a reasonable doubt. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Trust sponsor: means a banking association which has created a risk retention trust under this Article. See Illinois Compiled Statutes 215 ILCS 5/1102
  • trustee: means a trustee of a museum district. See Illinois Compiled Statutes 55 ILCS 5/5-31003
  • Unfunded accrued liability: means the excess of the accrued liability over the actuarial value of the assets of a plan. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Unit of local government: has the meaning as defined in the Illinois Constitution of 1970 and also includes a not-for-profit corporation organized for the purpose of conducting public business including, but not limited to, the Northeast Illinois Regional Commuter Railroad Corporation. See Illinois Compiled Statutes 55 ILCS 5/5-43010
  • University: means and includes Chicago State University, located at Chicago, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 661/6-5
  • University: means and includes Eastern Illinois University, located at Charleston, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 666/11-5
  • University: means and includes Governors State University, located at University Park, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 671/16-5
  • University: means and includes Illinois State University, located at Normal, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 676/21-5
  • University: means and includes Northeastern Illinois University, located at Chicago, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 681/26-5
  • University: means and includes Northern Illinois University, located at DeKalb, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 686/31-5
  • University: means and includes Western Illinois University, located at Macomb, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 691/36-5
  • Video programming: means that term as defined in item (20) of 47 U. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Video service: means video programming and subscriber interaction, if any, that is required for the selection or use of such video programming services, and that is provided through wireline facilities located at least in part in the public rights-of-way without regard to delivery technology, including Internet protocol technology. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Voting defect identification: means the capability to detect overvoted ballots or ballots which cannot be read by the automatic tabulating equipment. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Voting defects: means an overvoted ballot, or a ballot which cannot be read by the automatic tabulating equipment. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Waste hauler: means any person owning or controlling any vehicle used to carry or transport garbage, refuse or other forms of solid waste. See Illinois Compiled Statutes 65 ILCS 5/11-19.2-1
  • waste management: means the process of storage, treatment or disposal, but not the hauling or transport, of "waste" as defined in Section 3. See Illinois Compiled Statutes 55 ILCS 5/5-15002
  • waterworks: means and includes a waterworks system in its entirety or any integral part thereof, including mains, hydrants, meters, values, standpipes, storage tanks, pump tanks, intakes, wells, impounding reservoirs, pumps, machinery, purification plants, softening apparatus, and all other elements, useful in connection with a water supply or water distribution system. See Illinois Compiled Statutes 65 ILCS 5/11-139-1
  • Waterworks system: means and includes a waterworks system in its entirety, or any integral part of a waterworks system, including mains, hydrants, meters, valves, standpipes, storage tanks, pumps, tanks, intakes, wells, impounding reservoirs, machinery, purification plants, softening apparatus, and all other elements useful in connection with a water supply or water distribution system.
