Terms Used In Illinois Compiled Statutes > Chapter 110

  • Access: means that the cable or video provider is capable of providing cable services or video services at the household address using any technology, other than direct-to-home satellite service, that provides 2-way broadband Internet capability and video programming, content, and functionality, regardless of whether any customer has ordered service or whether the owner or landlord or other responsible person has granted access to the household. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Accrued liability: means the actuarial present value of future benefit payments and appropriate administrative expenses under a plan, reduced by the actuarial present value of all future normal costs (including any participant contributions) with respect to the participants included in the actuarial valuation of the plan. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Acquire: includes to purchase, erect, build, construct, reconstruct, complete, repair, replace, alter, extend, better, equip, develop, and improve a project, including the acquisition and clearing of a site or sites therefor. See Illinois Compiled Statutes 110 ILCS 661/6-5

  • Acquiring corporation: as used in this Article , means any stock insurance corporation incorporated under this Code or under prior laws of this State relating to the incorporation of domestic insurance corporations; any stock corporation incorporated under the "Business Corporation Act of 1983" or under prior laws of this State authorizing the establishment of business corporations; and any foreign or alien stock corporation qualified to do business in Illinois and registered by the corporation department; and any foreign or alien stock insurance company authorized to do business in Illinois. See Illinois Compiled Statutes 215 ILCS 5/156.1
  • Actuarial present value: means the single amount, as of a given valuation date, that results from applying actuarial assumptions to an amount or series of amounts payable or receivable at various times. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Actuarial value of assets: means the value assigned by the actuary to the assets of a plan for the purposes of an actuarial valuation. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Adjusted RBC Report: means an RBC Report that has been adjusted by the Director in accordance with subsection (f) of Section 35A-10. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • administrative enforcement unit: when used in this Article, means local governmental units or the Child and Spouse Support Unit established under Section 10-3. See Illinois Compiled Statutes 305 ILCS 5/10-3
  • Administrative separation: means a parent's, legal guardian's, legal custodian's, or primary caretaker's: (1) arrest, detention, incarceration, removal, or deportation in connection with federal immigration enforcement; or (2) receipt of official communication by federal, State, or local authorities regarding immigration enforcement that gives reasonable notice that care and supervision of the child by the parent, legal guardian, legal custodian, or primary caretaker will be interrupted or cannot be provided. See Illinois Compiled Statutes 755 ILCS 5/11-1
  • Administrator: means any person, partnership or corporation, other than an insurer or health maintenance organization holding a certificate of authority under the "Health Maintenance Organization Act" as now or hereafter amended, that arranges, contracts with, or administers contracts with a provider whereby beneficiaries are provided an incentive to use the services of such provider. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Adult with a mental disability: means a person over the age of 18 years who lives in his or her own home; who needs home-based services, but does not require 24-hour-a-day supervision; and who has one of the following conditions: severe autism, severe mental illness, a severe or profound intellectual disability, or severe and multiple impairments. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Adverse underwriting decision: means :
            (1) any of the following actions with respect to
    
insurance transactions involving insurance coverage which is individually underwritten:
            (a) a declination of insurance coverage,
            (b) a termination of insurance coverage,
            (c) failure of an agent to apply for insurance
        
coverage with a specific insurance institution which the agent represents and which is requested by an applicant,
            (d) in the case of a property or casualty
        
insurance coverage:
                (i) placement by an insurance institution or
            
agent of a risk with a residual market mechanism, an unauthorized insurer or an insurance institution which specializes in substandard risks, or
                (ii) the charging of a higher rate on the
            
basis of information which differs from that which the applicant or policyholder furnished, or
            (e) in the case of life, health or disability
        
insurance coverage, an offer to insure at higher than standard rates. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Advisory Committee: means the group of members selected from the public and private sectors to advise in the development and implementation of the comprehensive road improvement plan, and the periodic update of the plan. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Advisory Organization: means every person, other than an insurance company who as its primary functions (i) compiles insurance statistics, or (ii) prepares insurance policies, bond forms, and underwriting rules, and (iii) furnishes that which it compiles and prepares to insurance companies who are its only members and subscribers. See Illinois Compiled Statutes 215 ILCS 5/123A-2
  • affected areas: means the counties of Cook, DuPage, Lake, Kane, McHenry, Will, Madison, St. See Illinois Compiled Statutes 625 ILCS 5/13-100.1
  • affiliate: as used in this Article means a person that directly, or indirectly through one or more intermediaries, controls, is controlled by, or is under common control with, the person specified. See Illinois Compiled Statutes 215 ILCS 5/187
  • Affiliated company: includes a parent entity that controls a captive insurance company and:
             (1) is an affiliate of another entity if the entity
  •     
    directly or indirectly, through one or more intermediaries, controls, is controlled by, or is under common control with the other entity. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Aftercare release: means the conditional and
  •     
    revocable release of an adjudicated delinquent juvenile committed to the Department of Juvenile Justice under the supervision of the Department of Juvenile Justice. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Agency: means an agency or entity licensed by the Department pursuant to this Article or pursuant to the Community Residential Alternatives Licensing Act. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Agency: means the Illinois Environmental Protection Agency. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Agent: means an individual, firm, partnership, association or corporation who is involved in the solicitation, negotiation or binding of coverages for or on applications or policies of insurance, covering property or risks located in this State. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Ancillary administration: Probate administration of property (usually real property) owned in a State other than the one in which the decedent had his (her) principal residence at the time of death.
  • Annexed area: means a territory which has attached to and become a part of a different political subdivision or precinct. See Illinois Compiled Statutes 235 ILCS 5/9-1
  • Appeal: means any of the procedures that deal with the review of adverse organization determinations on the health care services the enrollee believes he or she is entitled to receive, including delay in providing, arranging for, or approving the health care services, such that a delay would adversely affect the health of the enrollee or on any amounts the enrollee must pay for a service, as defined under 42 CFR 422. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Applicant: means any person who seeks to contract for insurance coverage other than a person seeking group insurance that is not individually underwritten. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Area background: means concentrations of regulated substances that are consistently present in the environment in the vicinity of a site that are the result of natural conditions or human activities, and not the result solely of releases at the site. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
  • Artificially made or reclaimed land: includes all land which formerly was submerged under the public waters of the state, the title to which is in the state, and which has been artificially made or reclaimed in whole or in part. See Illinois Compiled Statutes 65 ILCS 5/11-92-1
  • Ashes: means residue from fires used for cooking and for heating buildings. See Illinois Compiled Statutes 60 ILCS 1/210-10
  • Asset forfeiture: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Assets: means all assets or property, whether real, personal or mixed, tangible or intangible, and any right or interest therein, including all rights under contracts and other agreements. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • assets: as used in this Article includes all deposits and funds of a special or trust nature. See Illinois Compiled Statutes 215 ILCS 5/187
  • Association: means any entity meeting the requirements set forth in either of the following paragraphs (1), (2) or (3):
             (1) any organized association of individuals, legal
  •     
    representatives, corporations (whether for profit or not for profit), partnerships, trusts, associations, units of government or other organizations, or any combination of the foregoing, that has been in continuous existence for at least one year, the member organizations of which collectively:
                (a) own, control, or hold with power to vote
            
    (directly or indirectly) all of the outstanding voting securities of an association captive insurance company incorporated as a stock insurer; or
                (b) have complete voting control (directly or
            
    indirectly) over an association captive insurance company organized as a mutual insurer;
            (2) any organized association of individuals, legal
        
    representatives, corporations (whether for profit or not for profit), partnerships, trusts, associations, units of government or other organizations, or any combination of the foregoing:
                (a) whose member organizations are engaged in
            
    businesses or activities similar or related with respect to the liability of which such members are exposed by virtue of any related, similar, or common business, trade, product, services, premises, or operations; and
                (b) whose member organizations:
                     (i) directly or indirectly own or control,
                
    and hold with power to vote, at least 80% of all of the outstanding voting securities of an association captive insurance company incorporated as a stock insurer; or
                    (ii) directly or indirectly have at least 80%
                
    of the voting control over an association captive insurance company organized as a mutual insurer; or
            (3) any risk retention group, as defined in
        
    subsection (11) of Section 123B-2, domiciled in this State and organized under this Article; however, beginning 6 months after the effective date of this amendatory Act of 1995, a risk retention group shall no longer qualify as an association under this Article. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Association captive insurance company: means any company that insures risks of (i) the member organizations of an association, and (ii) their affiliated companies. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.
  • attorney-in-fact: shall mean the representative of the subscribers. See Illinois Compiled Statutes 215 ILCS 5/61
  • Audit: means a systematic inspection or examination of plans, reports, records, or documents to determine the completeness and accuracy of the data and conclusions contained therein. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Banking association: means any Illinois corporation, whether for-profit or not-for-profit, which functions as a professional or trade association of dues-paying member commercial banks. See Illinois Compiled Statutes 215 ILCS 5/1102
  • Base year: means the 12-month period from January 1, 2018 to December 31, 2018. See Illinois Compiled Statutes 305 ILCS 5/5H-1
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Basic cable or video service: means any cable or video service offering or tier that includes the retransmission of local television broadcast signals. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Bench trial: Trial without a jury in which a judge decides the facts.
  • Beneficiary: means an individual entitled to reimbursement for expenses of or the discount of provider fees for health care services under a program where the beneficiary has an incentive to utilize the services of a provider which has entered into an agreement or arrangement with an administrator. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Bequeath: To gift property by will.
  • Board: means the township board in counties having a population of more than 150,000. See Illinois Compiled Statutes 60 ILCS 1/115-5
  • Board: means the Board of Trustees of the University or its successor. See Illinois Compiled Statutes 110 ILCS 661/6-5
  • Board: means the Board of Trustees of the University or its successor. See Illinois Compiled Statutes 110 ILCS 666/11-5
  • Board: means the Board of Trustees of the University or its successor. See Illinois Compiled Statutes 110 ILCS 671/16-5
  • Board: means the Weatherization Initiative Board. See Illinois Compiled Statutes 30 ILCS 738/40-5
  • Board: means the Board of Trustees of the University or its successor. See Illinois Compiled Statutes 110 ILCS 676/21-5
  • Board: means the Board of Trustees of the University or its successor. See Illinois Compiled Statutes 110 ILCS 681/26-5
  • Board: means the Board of Trustees of the University or its successor. See Illinois Compiled Statutes 110 ILCS 686/31-5
  • Board: means the Board of Trustees of the University or its successor. See Illinois Compiled Statutes 110 ILCS 691/36-5
  • Board: means a Board of a Community College District. See Illinois Compiled Statutes 110 ILCS 805/3B-1
  • Bonds: means any revenue bonds authorized under this Division and payable as provided hereunder. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Bridge: means any bridge over or across a river, including any bridges on the approaches thereto to eliminate intersection at grade with any street, tunnel, public road, thoroughfare, highway, railroad or street railroad, where the complete project is located entirely within the State;
         (2) "Net Revenue" means the gross revenue of a bridge less the reasonable cost of operating, maintaining, and repairing the bridge;
         (3) "United States" means the United States of America and any agent or agency thereof;
         (4) "Holder" means the holder or holders of any of the bonds issued under this Division of this Article. See Illinois Compiled Statutes 605 ILCS 5/10-701
  • Broadband service: means a high speed service connection to the public Internet capable of supporting, in at least one direction, a speed in excess of 200 kilobits per second (kbps) to the network demarcation point at the subscriber's premises. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • brownfields: means a parcel of real property, or a portion of the parcel, that has actual or perceived contamination and an active potential for redevelopment. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Building purposes: means the preparation of preliminary drawings and sketches, working drawings and specifications, erection, building acquiring, altering, improving or expanding college facilities, including the acquisition of land therefor, and the inspection and supervision thereof, to be used exclusively for community colleges. See Illinois Compiled Statutes 110 ILCS 805/5-2
  • Cable operator: means that term as defined in item (5) of 47 U. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Cable service: means that term as defined in item (6) of 47 U. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Cable system: means that term as defined in item (7) of 47 U. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Capital: means the capital stock component of statutory surplus, as defined in the National Association of Insurance Commissioners Accounting Practices and Procedures Manual, version effective January 1, 2001, and subsequent revisions. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • Capital offense: A crime punishable by death.
  • Captive insurance company: means any pure captive insurance company, association captive insurance company or industrial insured captive insurance company organized under the provisions of this Article. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Captive management company: means an entity providing administrative services to a captive insurance company. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Care facility for persons with a developmental disability: means an intermediate care facility for the intellectually disabled within the meaning of Title XIX of the Social Security Act, whether public or private and whether organized for profit or not-for-profit, but shall not include any facility operated by the State. See Illinois Compiled Statutes 305 ILCS 5/5C-1
  • Care provider for persons with a developmental disability: means a person conducting, operating, or maintaining a facility for persons with a developmental disability. See Illinois Compiled Statutes 305 ILCS 5/5C-1
  • Caregiver: includes a caregiver's spouse, cohabitant, child, or employee. See Illinois Compiled Statutes 755 ILCS 5/4a-5
  • Chambers: A judge's office.
  • Child care facilities: has the meaning set forth in the Child Care Act of 1969, but does not include licensed foster homes. See Illinois Compiled Statutes 730 ILCS 152/105
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • Class III groundwater: means groundwater that meets the Class III Special Resource Groundwater criteria set forth in the Board rules adopted under the Illinois Groundwater Protection Act. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Codicil: An addition, change, or supplement to a will executed with the same formalities required for the will itself.
  • Combined waterworks and sewerage system: means and includes a waterworks and sewerage system, as defined in this Section, that a township determines to operate in combination. See Illinois Compiled Statutes 60 ILCS 1/205-5
  • Combined waterworks and sewerage system: means and includes a waterworks and sewerage system, which the municipality determines by ordinance to operate in combination. See Illinois Compiled Statutes 720 ILCS 5/9-3
  • Commercial Building: means any building, other than a residence, permanently affixed to realty located in Illinois, including basements, footings, foundations, septic systems and underground pipes directly servicing the building, but does not include sidewalks, driveways, parking lots, living units, land, trees, plants, crops or agricultural field drainage tile. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Commercial Coverage: means mine subsidence insurance for a commercial building. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Commercial unit: means such a unit of goods as
  •     
    by commercial usage is a single whole for purposes of lease and division of which materially impairs its character or value on the market or in use. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Commission: means the Illinois Commerce Commission. See Illinois Compiled Statutes 625 ILCS 5/18d-105
  • Commission: means the Illinois Commerce Commission. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Committee membership: Legislators are assigned to specific committees by their party. Seniority, regional balance, and political philosophy are the most prominent factors in the committee assignment process.
  • company: as used in this Article includes all of the corporations, associations, societies, orders, firms, companies, partnerships, and individuals specified in subsections (1), (4), and (5) of this Section and agents, managing general agents, brokers, premium finance companies, insurance holding companies, and all other non-risk bearing entities or persons engaged in any aspect of the business of insurance on behalf of an insurer against which a receivership proceeding has been or is being filed under this Article, including, but not limited to, entities or persons that provide management, administrative, accounting, data processing, marketing, underwriting, claims handling, or any other similar services to that insurer, whether or not those entities are licensed to engage in the business of insurance in Illinois, if the entity or person is an affiliate of that insurer. See Illinois Compiled Statutes 215 ILCS 5/187
  • compensation: includes compensation received in a lump sum for accumulated unused vacation, personal leave or sick leave, with the exception of health care providers. See Illinois Compiled Statutes 40 ILCS 5/24-102
  • Comprehensive road improvement plan: means a plan prepared by the unit of local government in consultation with the Advisory Committee. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • comprehensive unified local transportation system: as used in this Article means a transportation system comprising all of the street railways and also all of the local railroads the major portions of which are within the city (provided there are such local railroads in such city) and may also comprise public utility motor vehicle lines and/or any other local public utility transportation facilities, the major portions of which are within the city. See Illinois Compiled Statutes 220 ILCS 5/14-101
  • Construction: means any one or more of the following which is undertaken for a public purpose: preliminary planning to determine the feasibility of the treatment works or public water supply, engineering, architectural, legal, fiscal or economic investigations or studies, surveys, designs, plans, working drawings, specifications, procedures or other necessary actions, erection, building, acquisition, alteration, remodeling, improvement or extension of treatment works or public water supplies, or the inspection or supervision of any of the foregoing items. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Consumer lease: means a lease that a lessor
  •     
    regularly engaged in the business of leasing or selling makes to a lessee who is an individual and who takes under the lease primarily for a personal, family, or household purpose, if the total payments to be made under the lease contract, excluding payments for options to renew or buy, do not exceed $40,000. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Consumer report: means any written, oral or other communication of information bearing on a natural person's credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics or mode of living which is used or expected to be used in connection with an insurance transaction. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Consumer reporting agency: means any person who:
            (1) regularly engages, in whole or in part, in the
  •     
    practice of assembling or preparing consumer reports for a monetary fee,
            (2) obtains information primarily from sources other
        
    than insurance institutions, and
            (3) furnishes consumer reports to other persons. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Contingency reserve fund: means a separate fund maintained for payment of claims in excess of the pool retention fund amount. See Illinois Compiled Statutes 215 ILCS 5/1102
  • Contingent beneficiary: Receiver of property or benefits if the first named beneficiary fails to receive any or all of the property or benefits in question before his (her) death.
  • Control: means the power to direct, or cause the direction of, the management and policies of an entity, other than the power that results from an official position with or corporate office held in the entity. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Controlled unaffiliated business: means an entity:
             (1) that is not an affiliate;
             (2) that has an existing contractual relationship
  •     
    with an affiliate under which the affiliate bears a potential financial loss; and
            (3) whose risks are managed by a captive
        
    insurance company under Section 123C-24 of this Code. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Corporate authorities: means the corporate authorities as defined in this Illinois Municipal Code. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Corrective action: means activities associated with compliance with the provisions of Sections 57. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Corrective Order: means an order issued by the Director in accordance with Article XII 1/2 specifying corrective actions that the Director determines are required. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • costs: as used in this Division 58 means sums paid by way of compensation to any property owner for the actual taking or damaging of his property, and attorney's fees and court costs incurred as a result of, or incident to, any grade separation covered by this Division 58. See Illinois Compiled Statutes 65 ILCS 5/11-58-7
  • County hospital: means a hospital, as defined in Section 14-1 of this Code, which is a county hospital located in a county of over 3,000,000 population. See Illinois Compiled Statutes 305 ILCS 5/15-1
  • County provider: means a health care provider that is, or is operated by, a county with a population greater than 3,000,000. See Illinois Compiled Statutes 305 ILCS 5/15-1
  • Court: means the circuit court in a session or
  •     
    division assigned to hear proceedings under this Act, and includes the term Juvenile Court. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • court: shall mean the court before which the conservation, rehabilitation, or liquidation proceeding of the company is pending, or the judge presiding in such proceedings. See Illinois Compiled Statutes 215 ILCS 5/187
  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
  • Coverage grant: means the document describing specific coverages and terms of coverage which are provided by a risk retention trust created under this Article. See Illinois Compiled Statutes 215 ILCS 5/1102
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Credit Score: A number, roughly between 300 and 800, that measures an individual's credit worthiness. The most well-known type of credit score is the FICO score. This score represents the answer from a mathematical formula that assigns numerical values to various pieces of information in your credit report. Source: OCC
  • Current value: means the fair market value when available; otherwise, the fair value as determined in good faith by a trustee, assuming an orderly liquidation at the time of the determination. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Debt: means indebtedness incurred by a dissolving township including, but not limited to, mortgages, judgments, and moneys due through the issuance and sale of bonds, or through an equivalent manner of borrowing for which notes or other evidences of indebtedness are issued fixing the amount of principal and interest from time to time payable to retire the indebtedness.   • Defense attorney: Represent defendants in criminal matters.
  • Delinquent minor: means any minor who prior to

  • division: means the act by operation of law by which a domestic stock company divides into 2 or more resulting companies in accordance with a plan of division and this Article;
         "Dividing company" means a domestic stock company that approves a plan of division pursuant to Section 35B-20;
         "Domestic stock company" means a domestic stock company transacting or being organized to transact any of the kinds of insurance business enumerated in Section 4. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • Domestic insurer: means any insurance company domiciled in this State under Article II, Article III, Article III 1/2, or Article IV or a health organization as defined by this Article, except this shall include only those health maintenance organizations that are "domestic companies" in accordance with Section 5-3 of the Health Maintenance Organization Act and only those limited health service organizations that are "domestic companies" in accordance with Section 4003 of the Limited Health Service Organization Act.   • Dower: A widow
  • electors: means the registered voters of any single township in McHenry County. See Illinois Compiled Statutes 60 ILCS 1/24-10
  • employee: means any person, including a person elected, appointed or under contract, receiving compensation from the State or a unit of local government or school district for personal services rendered, including salaried persons. See Illinois Compiled Statutes 40 ILCS 5/24-102
  • En banc: In the bench or "full bench." Refers to court sessions with the entire membership of a court participating rather than the usual quorum. U.S. courts of appeals usually sit in panels of three judges, but may expand to a larger number in certain cases. They are then said to be sitting en banc.
  • Enrollee: means an individual who resides in a nursing home or is qualified to be admitted to a nursing home and is enrolled with a managed care organization participating in the Demonstration Project. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Equal Credit Opportunity Act: Prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age, or because an applicant receives income from a public assistance program. Source: OCC
  • Equalized assessed value: has the meaning provided in Section 18-213 of the Property Tax Code. See Illinois Compiled Statutes 60 ILCS 1/23-5
  • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Facilities: means classroom buildings and equipment, related structures and utilities necessary or appropriate for the uses of a community college, but not including land or buildings intended primarily for staff housing, dormitories, or for athletic exhibitions, contests or games for which admission charges are to be made to the general public.   • Faculty Member: means a full time employee of the District regularly engaged in teaching or academic support services, but excluding supervisors, administrators and clerical employees. See Illinois Compiled Statutes 110 ILCS 805/3B-1

  • Finance lease: means a lease with respect to
  •     
    which:
                (i) the lessor does not select, manufacture, or
            
    supply the goods;
                (ii) the lessor acquires the goods or the right
            
    to possession and use of the goods in connection with the lease; and
                (iii) one of the following occurs:
                     (A) the lessee receives a copy of the
                
    contract by which the lessor acquired the goods or the right to possession and use of the goods before signing the lease contract;
                    (B) the lessee's approval of the contract by
                
    which the lessor acquired the goods or the right to possession and use of the goods is a condition to effectiveness of the lease contract;
                    (C) the lessee, before signing the lease
                
    contract, receives an accurate and complete statement designating the promises and warranties, and any disclaimers of warranties, limitations or modifications of remedies, or liquidated damages, including those of a third party, such as the manufacturer of the goods, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods; or
                    (D) if the lease is not a consumer lease, the
                
    lessor, before the lessee signs the lease contract, informs the lessee in writing (a) of the identity of the person supplying the goods to the lessor, unless the lessee has selected that person and directed the lessor to acquire the goods or the right to possession and use of the goods from that person, (b) that the lessee is entitled under this Article to the promises and warranties, including those of any third party, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods, and (c) that the lessee may communicate with the person supplying the goods to the lessor and receive an accurate and complete statement of those promises and warranties, including any disclaimers and limitations of them or of remedies.   • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • Footprint: means the geographic area designated by the cable service or video service provider as the geographic area in which it will offer cable services or video services during the period of its State-issued authorization. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Foreign insurer: means any foreign or alien insurance company licensed under Article VI that is not domiciled in this State and any health maintenance organization that is not a "domestic company" in accordance with Section 5-3 of the Health Maintenance Organization Act and any limited health service organization that is not a "domestic company" in accordance with Section 4003 of the Limited Health Service Organization Act.   • Foreign judgment: means any judgment or order relating to fraudulent claims practices, false and deceptive advertising, unfair methods of transacting business, or payment of taxes, of a court located in a "reciprocal state" including a court of the United States located therein, against any insurer incorporated or authorized to do business in this State. See Illinois Compiled Statutes 215 ILCS 5/121-13
  • Fraternal benefit society: means any insurance company licensed under Article XVII of this Code. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • Fuel: means all liquids defined as "Motor Fuel" in Section 1. See Illinois Compiled Statutes 415 ILCS 125/305
  • Fund: means the fund established by this Article. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Fund: means the Hospital Provider Fund. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Fund: means the Long-Term Care Provider Fund. See Illinois Compiled Statutes 305 ILCS 5/5B-1
  • Fund: means the Care Provider Fund for Persons with a Developmental Disability. See Illinois Compiled Statutes 305 ILCS 5/5C-1

  • Garbage: means wastes resulting from the handling, preparation, cooking, and consumption of food and wastes from the handling, storage, and sale of produce. See Illinois Compiled Statutes 60 ILCS 1/210-10
  • Goods: means all things that are movable at the
  •     
    time of identification to the lease contract, or are fixtures (Section 2A-309), but the term does not include money, documents, instruments, accounts, chattel paper, general intangibles, or minerals or the like, including oil and gas, before extraction. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • governmental reciprocal: shall mean a reciprocal in which all subscribers are governmental entities, including, but not limited to, federal, State, territorial, commonwealth, and local governments and agencies, subdivisions, departments, joint ventures, partnerships, and consortia of these governments. See Illinois Compiled Statutes 215 ILCS 5/61
  • Governmental unit: means the State of Illinois, any instrumentality or agency thereof (except transit authorities or agencies operating within or within and without cities with a population over 3,000,000), and any political subdivision or municipal corporation that establishes and maintains a public pension fund. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Gross estate: The total fair market value of all property and property interests, real and personal, tangible and intangible, of which a decedent had beneficial ownership at the time of death before subtractions for deductions, debts, administrative expenses, and casualty losses suffered during estate administration.
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Harbor: as used in this Division 92 includes harbors, marinas, slips, docks, piers, breakwaters, and all buildings, structures, facilities, connections, equipment, parking areas and all other improvements for use in connection therewith. See Illinois Compiled Statutes 65 ILCS 5/11-92-1
  • Hazardous financial condition: means that, based on its present or reasonably anticipated financial condition, a risk retention group, although not yet financially impaired or insolvent, is unlikely to be able:
             (a) to meet obligations to policyholders with respect
  •     
    to known claims and reasonably anticipated claims; or
            (b) to pay other obligations in the normal course of
        
    business. See Illinois Compiled Statutes 215 ILCS 5/123B-2
  • Hazardous material: means any substance or material in a quantity and form determined by the federal Office of Hazardous Materials and the Federal Railroad Administration to be capable of posing an unreasonable risk to health, safety, or property when transported in commerce. See Illinois Compiled Statutes 625 ILCS 5/18c-1104
  • Health care services: means health care services or products rendered or sold by a provider within the scope of the provider's license or legal authorization. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Health care services: means the diagnosis, treatment, and prevention of disease and includes medication, primary care, nursing or medical care, mental health treatment, psychiatric rehabilitation, memory loss services, physical, occupational, and speech rehabilitation, enhanced care, medical supplies and equipment and the repair of such equipment, and assistance with activities of daily living. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Health organization: means an entity operating under a certificate of authority issued pursuant to the Health Maintenance Organization Act, the Dental Service Plan Act, the Limited Health Service Organization Act, or the Voluntary Health Services Plans Act, unless the entity is otherwise defined as a "life, health, or life and health insurer" pursuant to this Act. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • Heating Oil: means petroleum that is No. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Holder: means a person or entity that has received authorization to offer or provide cable or video service from the Commission pursuant to Section 21-401 of this Article. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Home: means real property and improvements thereon located within the municipality consisting of not more than 4 dwelling units, including but not limited to, condominium units owned by one mortgagor who occupies or intends to occupy one of such units. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Home detention: means the confinement of a minor adjudicated delinquent or subject to an adjudicatory hearing under Article V for an act that if committed by an adult would be an offense to his or her place of residence under the terms and conditions established by the supervising authority. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Home mortgage loan: means an interest bearing loan to a mortgagor evidenced by a promissory note and secured by a mortgage on a home, purchased or originated in accordance with this Division made for the purpose of acquiring a home having an appraised value or a purchase price, whichever is less, of not less than the minimum home value and less than the maximum home value. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Home-based services: means services provided to an adult with a mental disability who lives in his or her own home. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Hospital: means an institution, place, building, or agency located in this State that is subject to licensure by the Illinois Department of Public Health under the Hospital Licensing Act, whether public or private and whether organized for profit or not-for-profit. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Hospital: means any institution, place, building, or agency, public or private, whether organized for profit or not-for-profit, which is located in the State and is subject to licensure by the Illinois Department of Public Health under the Hospital Licensing Act or any institution, place, building, or agency, public or private, whether organized for profit or not-for-profit, which meets all comparable conditions and requirements of the Hospital Licensing Act in effect for the state in which it is located, and is required to submit cost reports to the Illinois Department under Title 89, Part 148, of the Illinois Administrative Code, but shall not include the University of Illinois Hospital as defined in the University of Illinois Hospital Act or a county hospital in a county of over 3 million population. See Illinois Compiled Statutes 305 ILCS 5/14-1
  • Hospital provider: means a person licensed by the Department of Public Health to conduct, operate, or maintain a hospital, regardless of whether the person is a Medicaid provider. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Household: means a house, an apartment, a mobile home, a group of rooms, or a single room that is intended for occupancy as separate living quarters. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • In forma pauperis: In the manner of a pauper. Permission given to a person to sue without payment of court fees on claim of indigence or poverty.
  • Incumbent cable operator: means a person or entity that provided cable services or video services in a particular area under a franchise agreement with a local unit of government pursuant to Section 11-42-11 of the Illinois Municipal Code (65 ILCS 5/11-42-11) or Section 5-1095 of the Counties Code (55 ILCS 5/5-1095) on January 1, 2007. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Indemnification: means indemnification of an owner or operator for the amount of any judgment entered against the owner or operator in a court of law, for the amount of any final order or determination made against the owner or operator by an agency of State government or any subdivision thereof, or for the amount of any settlement entered into by the owner or operator, if the judgment, order, determination, or settlement arises out of bodily injury or property damage suffered as a result of a release of petroleum from an underground storage tank owned or operated by the owner or operator.   • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Individual: means any natural person who:
            (1) in the case of property or casualty insurance, is
  •     
    a past, present or proposed named insured or certificateholder;
            (2) in the case of life, health or disability
        
    insurance, is a past, present or proposed principal insured or certificateholder;
            (3) is a past, present or proposed policyowner;
            (4) is a past or present applicant;
            (5) is a past or present claimant; or
            (6) derived, derives or is proposed to derive
        
    insurance coverage under an insurance policy or certificate subject to this Article. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Industrial insured: means an insured which (together with its affiliates) at the time of its initial procurement of insurance from an industrial insured captive insurance company:
             (1) has available to it advice with respect to the
  •     
    purchase of insurance through the use of the services of a full-time employee acting as an insurance manager or buyer or the services of a regularly and continuously retained qualified insurance consultant; and
            (2) pays aggregate annual premiums in excess of
            
    $100,000 for insurance on all risks except for life, accident and health; and
            (3) either (i) has at least 25 full-time employees,
        
    or (ii) has gross assets in excess of $3,000,000, or (iii) has annual gross revenues in excess of $5,000,000. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Industrial insured captive insurance company: means any company that insures risks of industrial insureds that are members of the industrial insured group, and their affiliated companies. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Industrial project: means any (a) capital project, including one or more buildings and other structures, improvements, machinery and equipment whether or not on the same site or sites now existing or hereafter acquired, suitable for use by any manufacturing, industrial, research, transportation or commercial enterprise, including but not limited to use as a factory, mill, processing plant, assembly plant, packaging plant, fabricating plant, office building, industrial distribution center, warehouse, repair, overhaul or service facility, freight terminal, research facility, test facility, railroad facility, or commercial facility, and including also the sites thereof and other rights in land therefor whether improved or unimproved, site preparation and landscaping, and all appurtenances and facilities incidental thereto such as utilities, access roads, railroad sidings, truck docking and similar facilities, parking facilities, dockage, wharfage, and other improvements necessary or convenient thereto; or (b) land, buildings, machinery or equipment comprising an addition to or renovation, rehabilitation or improvement of any existing capital project; (c) construction, remodeling or conversion of a structure to be leased to the Illinois Department of Corrections for the purposes of its serving as a correctional institution or facility pursuant to paragraph (c) of Section 3-2-2 of the Unified Code of Corrections; or (d) construction, remodeling or conversion of a structure to be leased to the Department of Central Management Services for the purpose of serving as a State facility pursuant to Section 405-320 of the Department of Central Management Services Law (20 ILCS 405/405-320).   • Initiative: means the Urban Weatherization Initiative. See Illinois Compiled Statutes 30 ILCS 738/40-5
  • Installment lease contract: means a lease
  •     
    contract that authorizes or requires the delivery of goods in separate lots to be separately accepted, even though the lease contract contains a clause "each delivery is a separate lease" or its equivalent. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Institutional source: means any person or governmental entity that provides information about an individual to an agent, insurance institution or insurance-support organization, other than:
            (1) an agent,
            (2) the individual who is the subject of the
  •     
    information, or
            (3) a natural person acting in a personal capacity
        
    rather than in a business or professional capacity. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Insurance: means primary insurance, excess insurance, reinsurance, surplus lines insurance, and any other arrangement for shifting and distributing risk which is determined to be insurance under the laws of Illinois. See Illinois Compiled Statutes 215 ILCS 5/123B-2
  • Insurance institution: means any corporation, association, partnership, reciprocal exchange, inter-insurer, Lloyd's insurer, fraternal benefit society or other person engaged in the business of insurance, health maintenance organizations as defined in Section 2 of the Health Maintenance Organization Act, voluntary health services plans as defined in Section 2 of the Voluntary Health Services Plans Act, and dental service plans as defined in Section 4 of the Dental Service Plan Act.   • Insurance transaction: means any transaction involving insurance primarily for personal, family or household needs rather than business or professional needs which entails:
            (1) the determination of an individual's eligibility
  •     
    for an insurance coverage, benefit or payment, or
            (2) the servicing of an insurance application,
        
    policy, contract or certificate. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Insurance-support organization: means :
            (1) any person who regularly engages, in whole or in
  •     
    part, in the practice of assembling or collecting information about natural persons for the primary purpose of providing the information to an insurance institution or agent for insurance transactions, including:
                (a) the furnishing of consumer reports or
            
    investigative consumer reports to an insurance institution or agent for use in connection with an insurance transaction, or
                (b) the collection of personal information from
            
    insurance institutions, agents or other insurance-support organizations for the purpose of detecting or preventing fraud, material misrepresentation or material nondisclosure in connection with insurance underwriting or insurance claim activity. See Illinois Compiled Statutes 215 ILCS 5/1003
  • insured: as used in this article , shall not be construed as preventing a person other than the insured with a proper insurable interest from making application for and owning a policy covering the insured or from being entitled under such a policy to any indemnities, benefits and rights provided therein. See Illinois Compiled Statutes 215 ILCS 5/357.28
  • Insured: means an individual entitled to reimbursement for expenses of health care services under a policy or subscriber contract issued or administered by an insurer. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Insurer: means an insurance company or a health service corporation authorized in this State to issue policies or subscriber contracts which reimburse for expenses of health care services. See Illinois Compiled Statutes 215 ILCS 5/370g
  • insurer: as used in this Article includes all corporations, associations, partnerships and individuals, engaged as principals in the business of insurance and also includes interinsurance exchanges and mutual benefit societies. See Illinois Compiled Statutes 215 ILCS 5/121-3
  • Insurers: means insurance companies and reciprocals licensed and authorized to write Class 3 policies of insurance, as defined in this Code, within Illinois. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Intended use plan: means a plan which includes a description of the short and long term goals and objectives of the Water Pollution Control Loan Program and the Public Water Supply Loan Program, project categories, discharge requirements, terms of financial assistance and the loan applicants to be served. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Inter vivos: Transfer of property from one living person to another living person.
  • Intergovernmental cooperative: means an intergovernmental cooperative organized pursuant to Article VII, Section 10 of the Illinois Constitution and Section 6 of the Intergovernmental Cooperation Act. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Investigative consumer report: means a consumer report or portion thereof in which information about a natural person's character, general reputation, personal characteristics or mode of living is obtained through personal interviews with the person's neighbors, friends, associates, acquaintances or others who may have knowledge concerning such items of information. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Juvenile sex offender: means any person who is adjudicated a juvenile delinquent as the result of the commission of or attempt to commit a violation set forth in item (B), (C), or (C-5) of Section 2 of the Sex Offender Registration Act, or a violation of any substantially similar federal, Uniform Code of Military Justice, sister state, or foreign country law, and whose adjudication occurred on or after the effective date of this amendatory Act of the 91st General Assembly. See Illinois Compiled Statutes 730 ILCS 152/105
  • Land use assumptions: means a description of the service area or areas and the roads, streets or highways incorporated therein, including projections relating to changes in land uses, densities and population growth rates which affect the level of traffic within the service area or areas over a 20 year period of time. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Law enforcement agency having jurisdiction: includes the location where out-of-state students attend school and where out-of-state employees are employed or are otherwise required to register. See Illinois Compiled Statutes 730 ILCS 152/105
  • Law of descent: The State statutes that specify how a deceased person
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Lease: means a transfer of the right to
  •     
    possession and use of goods for a term in return for consideration, but a sale, including a sale on approval or a sale or return, or retention or creation of a security interest is not a lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lease agreement: means the bargain, with respect
  •     
    to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this Article. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lease contract: means the total legal obligation
  •     
    that results from the lease agreement as affected by this Article and any other applicable rules of law. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Legal guardian: means a person appointed by a court of competent jurisdiction to exercise certain powers on behalf of an adult with a mental disability. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • Lender: means any lending institution participating in a residential housing finance plan as the originator of home mortgage loans or as a servicing agent for home mortgage loans. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Lending institution: means any bank, bank holding company, credit union, trust company, savings bank, national banking association, savings and loan association, building and loan association, mortgage banker or other financial institution which customarily provides service or otherwise aids in the financing of home mortgages, or any holding company for any of the foregoing. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Lessee: means a person who acquires the right to
  •     
    possession and use of goods under a lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Lessor: means a person who transfers the right
  •     
    to possession and use of goods under a lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Liability: means a liability or obligation of any kind, character, or description, whether known or unknown, absolute or contingent, accrued or unaccrued, disputed or undisputed, liquidated or unliquidated, secured or unsecured, joint or several, due or to become due, determined, determinable, or otherwise. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • Liability: means :
             (a) legal liability for damages (including costs of
  •     
    defense, legal costs and fees, and other claims expenses) because of injuries to other persons, damage to their property, or other damage or loss to such other persons resulting from or arising out of:
                (i) any business (whether for profit or not for
            
    profit), trade, product, services (including professional services), premises, or operations; or
                (ii) any activity of any state or local
            
    government, or any agency or political subdivision thereof; but
            (b) does not include personal risk liability and an
        
    employer's liability with respect to its employees other than legal liability under the Federal Employers' Liability Act (45 U. See Illinois Compiled Statutes 215 ILCS 5/123B-2
  • Licensed establishment: means the premises specified in a retailer's license pursuant to paragraph (d) of Section 5-1 and whose primary business is the sale of alcoholic beverages on the premises, which premises are located in any municipality having more than 2,000,000 inhabitants. See Illinois Compiled Statutes 235 ILCS 5/9-1
  • Licensed Professional Engineer: means a person, corporation, or partnership licensed under the laws of the State of Illinois to practice professional engineering. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Licensed Professional Geologist: means a person licensed under the laws of the State of Illinois to practice as a professional geologist. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Licensed Professional Geologist: means a person licensed under the laws of the State of Illinois to practice as a professional geologist. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Licensed service company: means an entity licensed under Section 464a of the Illinois Insurance Code to perform claims adjusting, loss control and data processing. See Illinois Compiled Statutes 215 ILCS 5/1102
  • Life estate: A property interest limited in duration to the life of the individual holding the interest (life tenant).
  • Lineal descendant: Direct descendant of the same ancestors.
  • Living Unit: shall mean that physical portion designated for separate ownership or occupancy for residential purposes, of a building or group of buildings, permanently affixed to realty located in Illinois, having elements which are owned or used in common, including a condominium unit, a cooperative unit or any other similar unit. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Living Unit Coverage: means mine subsidence insurance for a living unit covering the losses described in Section 805. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Loan: means a loan made from the Water Pollution Control Loan Program or the Public Water Supply Loan Program to an eligible applicant as a result of a contractual agreement between the Agency and such applicant. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Local franchising authority: means the local unit of government that has or requires a franchise with a cable operator, a provider of cable services, or a provider of video services to construct or operate a cable or video system or to offer cable services or video services under Section 11-42-11 of the Illinois Municipal Code (65 ILCS 5/11-42-11) or Section 5-1095 of the Counties Code (55 ILCS 5/5-1095).   • Local government unit: means a county, municipality, township, municipal or county sewerage or utility authority, sanitary district, public water district, improvement authority or any other political subdivision whose primary purpose is to construct, operate and maintain wastewater treatment facilities, including storm water treatment systems, or public water supply facilities or both. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Local governmental unit: means any unit of local government or school district. See Illinois Compiled Statutes 735 ILCS 5/20-101
  • Local unit of government: means a city, village, incorporated town, or county. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Long-term care facility: means (i) a nursing facility, whether public or private and whether organized for profit or not-for-profit, that is subject to licensure by the Illinois Department of Public Health under the Nursing Home Care Act, the ID/DD Community Care Act, or the MC/DD Act, including a county nursing home directed and maintained under Section 5-1005 of the Counties Code, and (ii) a part of a hospital in which skilled or intermediate long-term care services within the meaning of Title XVIII or XIX of the Social Security Act are provided; except that the term "long-term care facility" does not include a facility operated by a State agency or operated solely as an intermediate care facility for the mentally retarded within the meaning of Title XIX of the Social Security Act.   • Long-term care provider: means (i) a person licensed by the Department of Public Health to operate and maintain a skilled nursing or intermediate long-term care facility or (ii) a hospital provider that provides skilled or intermediate long-term care services within the meaning of Title XVIII or XIX of the Social Security Act. See Illinois Compiled Statutes 305 ILCS 5/5B-1
  • Lot: means a parcel or a single article that is
  •     
    the subject matter of a separate lease or delivery, whether or not it is sufficient to perform the lease contract. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Low-income household: means those residential households located within the holder's existing telephone service area where the average annual household income is less than $35,000, based on the United States Census Bureau estimates adjusted annually to reflect rates of change and distribution. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Managed care organization: means an entity operating under a certificate of authority issued pursuant to the Health Maintenance Organization Act or as a Managed Care Community Network pursuant to Section 5-11 of the Public Aid Code. See Illinois Compiled Statutes 305 ILCS 5/5H-1
  • Marital deduction: The deduction(s) that can be taken in the determination of gift and estate tax liabilities because of the existence of a marriage or marital relationship.
  • Markup: The process by which congressional committees and subcommittees debate, amend, and rewrite proposed legislation.
  • MCO: means an entity that meets the definition of health maintenance organization as defined in the Health Maintenance Organization Act, is licensed, regulated and in good standing with the Department of Insurance, and is authorized to participate in the nursing home component of the Medicare-Medicaid Alignment Initiative Demonstration Project by a 3-way contract with the Department of Healthcare and Family Services and the Centers for Medicare and Medicaid Services. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Medicaid managed care organization: means a managed care organization under contract with the Department to provide services to recipients of benefits in the medical assistance program pursuant to Article V of the Public Aid Code, the Children's Health Insurance Program Act, or the Covering ALL KIDS Health Insurance Act. See Illinois Compiled Statutes 305 ILCS 5/5H-1
  • Medical facility: includes a hospital, infirmary, clinic, dispensary, mental institution or similar facility. See Illinois Compiled Statutes 745 ILCS 10/6-101
  • Medical professional: means any person licensed or certified to provide health care services to natural persons, including but not limited to, a physician, dentist, nurse, optometrist, chiropractor, naprapath, pharmacist, physical or occupational therapist, psychiatric social worker, speech therapist, clinical dietitian or clinical psychologist. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Medical-care institution: means any facility or institution that is licensed to provide health care services to natural persons, including but not limited to: hospitals, skilled nursing facilities, home-health agencies, medical clinics, rehabilitation agencies and public-health agencies and health-maintenance organizations. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Medical-record information: means personal information which:
            (1) relates to an individual's physical or mental
  •     
    condition, medical history or medical treatment, and
            (2) is obtained from a medical professional or
        
    medical-care institution, from the individual, or from the individual's spouse, parent or legal guardian. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Medically necessary: means health care services that a medical professional, exercising prudent clinical judgment, would provide to a patient for the purpose of preventing, evaluating, diagnosing, or treating an illness, injury, or disease or its symptoms, and that are: (i) in accordance with the generally accepted standards of medical practice; (ii) clinically appropriate, in terms of type, frequency, extent, site, and duration, and considered effective for the patient's illness, injury, or disease; and (iii) not primarily for the convenience of the patient, a medical professional, other health care provider, caregiver, family member, or other interested party. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Medicare: means the federal Medicare program established under Title XVIII of the federal Social Security Act. See Illinois Compiled Statutes 305 ILCS 5/5H-1
  • Medicare bed days: means , for each hospital, the sum of the number of days that each bed was occupied by a patient who was covered by Title XVIII of the Social Security Act, excluding days attributable to the routine services provided to persons receiving skilled or intermediate long term care services. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Member: means an insurance company who participates in or is entitled to participate in the management of an advisory organization. See Illinois Compiled Statutes 215 ILCS 5/123A-2
  • Member: means a nonprofit organization that participates as an insured in a nonprofit risk organization. See Illinois Compiled Statutes 215 ILCS 5/123D-5
  • Member months: means the aggregate total number of months all individuals are enrolled for coverage in a Managed Care Organization during the base year. See Illinois Compiled Statutes 305 ILCS 5/5H-1
  • Member organization: means any individual, legal representative, corporation (whether for profit or not for profit), partnership, association, unit of government, trust or other organization that belongs to an association or an industrial insured group. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Merchant lessee: means a lessee that is a
  •     
    merchant with respect to goods of the kind subject to the lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Mine Subsidence: means lateral or vertical ground movement caused by a failure initiated at the mine level, of man-made underground mines, including, but not limited to coal mines, clay mines, limestone mines, and fluorspar mines that directly damages residences or commercial buildings. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Minimum finance charge: The minimum, or fixed, finance charge that will be imposed during a billing cycle. A minimum finance charge usually applies only when a finance charge is imposed, that is, when you carry over a balance. Source: Federal Reserve
  • Minor: means is a person who has not attained the age of 18 years. See Illinois Compiled Statutes 755 ILCS 5/11-1

  • NAIC: means the National Association of Insurance Commissioners. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • NAIC: means the National Association of Insurance Commissioners. See Illinois Compiled Statutes 215 ILCS 5/123B-2
  • National Credit Union Administration: The federal regulatory agency that charters and supervises federal credit unions. (NCUA also administers the National Credit Union Share Insurance Fund, which insures the deposits of federal credit unions.) Source: OCC
  • Negative trend: means , with respect to a life, health, or life and health insurer or a fraternal benefit society, a negative trend over a period of time, as determined in accordance with the trend test calculation included in the Life or Fraternal RBC Instructions. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • Netting agreement: as used in this Article , means (a) a contract or agreement (including terms and conditions incorporated by reference therein), including a master agreement (which master agreement, together with all schedules, confirmations, definitions, and addenda thereto and transactions under any thereof, shall be treated as one netting agreement), that documents one or more transactions between the parties to the agreement for or involving one or more qualified financial contracts and that provides for the netting, liquidation, setoff, termination, acceleration, or close out under or in connection with one or more qualified financial contracts or present or future payment or delivery obligations or payment or delivery entitlements thereunder (including liquidation or close-out values relating to such obligations or entitlements) among the parties to the netting agreement; (b) any master agreement or bridge agreement for one or more master agreements described in paragraph (a) of this subsection (8); or (c) any security agreement or arrangement or other credit enhancement or guarantee or reimbursement obligation related to any contract or agreement described in paragraph (a) or (b) of this subsection (8); provided that any contract or agreement described in paragraphs (a) or (b) of this subsection (8) relating to agreements or transactions that are not qualified financial contracts shall be deemed to be a netting agreement only with respect to those agreements or transactions that are qualified financial contracts.   • New company: means a domestic stock company that is created by a division occurring on or after the effective date of this amendatory Act of the 100th General Assembly. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • New development: means any residential, commercial, industrial or other project which is being newly constructed, reconstructed, redeveloped, structurally altered, relocated, or enlarged, and which generates additional traffic within the service area or areas of the unit of local government.   • Nonprofit organizations: means organizations described in paragraph (3) of subsection (c), and exempt from taxation under subsection (a), of Section 501 of the Internal Revenue Code. See Illinois Compiled Statutes 215 ILCS 5/123D-5
  • Nonprofit risk organization: means a nonprofit company organized to do business solely with nonprofit organizations as a qualified charitable risk pool under subsection (n) of Section 501 of the Internal Revenue Code that is organized in accordance with this Article.   • Normal cost: means that part of the actuarial present value of all future benefit payments and appropriate administrative expenses assigned to the current year under the actuarial valuation method used by the plan (excluding any amortization of the unfunded accrued liability). See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Notice: means a written notice delivered in person or deposited in the U. See Illinois Compiled Statutes 110 ILCS 805/3B-1
  • Nursing home: means (i) a skilled nursing or intermediate long-term care facility, whether public or private and whether organized for profit or not-for-profit, that is subject to licensure by the Illinois Department of Public Health under the Nursing Home Care Act, the ID/DD Community Care Act, or the MC/DD Act, including a county nursing home directed and maintained under Section 5-1005 of the Counties Code, and (ii) a part of a hospital in which skilled or intermediate long-term care services within the meaning of Title XVIII or XIX of the Social Security Act are provided; except that the term "nursing home" does not include a facility operated solely as an intermediate care facility for the intellectually disabled within the meaning of Title XIX of the Social Security Act or a specialized mental health rehabilitation facility. See Illinois Compiled Statutes 305 ILCS 5/5E-5
  • Nursing home: means a facility licensed under the Nursing Home Care Act. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Nursing home provider: means (i) a person licensed by the Department of Public Health to operate and maintain a skilled nursing or intermediate long-term care facility which charges its residents, a third party payor, Medicaid, or Medicare for skilled nursing or intermediate long-term care services, or (ii) a hospital provider that provides skilled or intermediate long-term care services within the meaning of Title XVIII or XIX of the Social Security Act. See Illinois Compiled Statutes 305 ILCS 5/5E-5
  • Occupied bed days: means the sum of the number of days that each bed was occupied by a patient for all beds, excluding days attributable to the routine services provided to persons receiving skilled or intermediate long term care services. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • Occurrence: means an accident, including continuous or repeated exposure to conditions, that results in a sudden or nonsudden release from an underground storage tank. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Official state newspaper: means the newspaper designated and certified to the Commission annually by the Director of Central Management Services of the State of Illinois, or, if said Director fails to certify to the Commission the name and address of the official newspaper selected by the Director prior to expiration of the previous certification, the newspaper designated in the most recent certification. See Illinois Compiled Statutes 625 ILCS 5/18c-1104
  • open space: means any space or area of land or water of an area of 50 acres or more, the preservation or the restriction of development or use of which would (i) maintain or enhance the conservation of natural or scenic resources; (ii) protect natural streams or water supply; (iii) promote conservation of soils, wet lands, or shores; (iv) afford or enhance public outdoor recreation opportunities; (v) preserve flora and fauna, geological features, historic sites, or other areas of educational or scientific interest; (vi) enhance the value to the public of abutting or neighboring highways, parks, or other public lands; (vii) implement the plan of development adopted by the planning commission of any municipality or county; or (viii) promote orderly urban or suburban development. See Illinois Compiled Statutes 60 ILCS 1/115-5
  • Open space plan: means the written plan adopted by the board to implement an open space program and includes properly adopted amendments or additions to the plan. See Illinois Compiled Statutes 60 ILCS 1/115-5
  • Open space program: means the acquisition of the fee or of a lesser right or interest in tracts of open land in the township for open space purposes. See Illinois Compiled Statutes 60 ILCS 1/115-5
  • Open space purposes: includes (i) the preservation and maintenance of open land, scenic roadways, and pathways; (ii) the holding of real property described in clause (i), with or without public access, for the education, pleasure, and recreation of the public or for other open space values; (iii) the preservation of portions of that property in their natural condition and the development of other portions of that property; (iv) the management and use of that property in a manner and with restrictions that will leave it unimpaired for the benefit of future generations; and (v) otherwise promoting the conservation of the nature, flora and fauna, natural environment, and natural resources of the township.   • Ordinance: means an ordinance adopted and approved by the corporate authorities of a municipality. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2

  • Outlays: Outlays are payments made (generally through the issuance of checks or disbursement of cash) to liquidate obligations. Outlays during a fiscal year may be for payment of obligations incurred in prior years or in the same year.
  • Outpatient gross revenue: means , for each hospital, its total gross charges attributed to outpatient services as reported on the Medicare cost report at Worksheet C, Part I, Column 7, line 101, less the sum of lines 45, 60, 63, 64, 65, 66, 67, and 68 (and any subsets of those lines).   • own home: means that an adult with a mental disability lives alone; or that an adult with a mental disability is in full-time residence with his or her parents, legal guardian, or other relatives; or that an adult with a mental disability is in full-time residence in a setting not subject to licensure under the Nursing Home Care Act, the Specialized Mental Health Rehabilitation Act of 2013, the ID/DD Community Care Act, the MC/DD Act, or the Child Care Act of 1969, as now or hereafter amended, with 3 or fewer other adults unrelated to the adult with a mental disability who do not provide home-based services to the adult with a mental disability. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Paralegal: means a person who is qualified through education, training, or work experience and is employed by a lawyer, law office, governmental agency, or other entity to work under the direction of an attorney in a capacity that involves the performance of substantive legal work that usually requires a sufficient knowledge of legal concepts and would be performed by the attorney in the absence of the paralegal. See Illinois Compiled Statutes 5 ILCS 70/1.35
  • Parent: means the biological or adoptive parent of an adult with a mental disability, or a person licensed as a foster parent under the laws of this State who acts as a foster parent to an adult with a mental disability. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Parent: means a corporation, partnership, individual or other legal entity that directly or indirectly owns, controls, or holds with power to vote more than 50% of the outstanding voting securities of a company. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Participant: means a participating member or deferred pensioner or annuitant of a pension fund as provided in the Article of this Code under which the pension fund is established, or a beneficiary thereof. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Participant: means a minor placed into an electronic monitoring program. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Participating taxpayer: means any person subject to the revenue laws administered by the Department who enters into an engagement with a qualified practitioner for tax compliance review and who is approved by the Department under the certified audit project. See Illinois Compiled Statutes 720 ILCS 5/3-6
  • Participation commitment: means any undertaking or agreement by a lending institution to participate in the implementation of a residential housing finance plan. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Partner organization: means a nonprofit organization that meets standards set forth by Section 501(c)(3) of the Internal Revenue Code and whose mission includes supporting small, beginning, limited resource, or socially-disadvantaged farmers within municipalities. See Illinois Compiled Statutes 65 ILCS 5/11-15.4-5
  • Pension fund: means any public pension fund, annuity and benefit fund, or retirement system established under this Code. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Per stirpes: The legal means by which the children of a decedent, upon the death of an ancestor at a level above that of the decedent, receive by right of representation the share of the ancestor
  • Person: means a natural person or persons or a trust, provided that such trust is for the benefit of a natural person or members of such person's immediate family. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Person: means individual, trust, firm, joint stock company, joint venture, consortium, commercial entity, corporation (including a government corporation), partnership, association, State, municipality, commission, political subdivision of a State, or any interstate body including the United States Government and each department, agency, and instrumentality of the United States. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Person: shall mean any individual, partnership, association, corporation, society, order, firm, company, aggregation of individuals, reciprocal exchange, inter-insurer, Lloyds insurer, fraternal benefit society, and any other legal entity to which any article of this Code is applicable, or which is subject to examination, visitation or supervision by the Director under any provision of this Code or under any law of this State, or which is engaged or engaging in or proposing or attempting to engage in or is representing that it is doing an insurance or surety business in this State, or which is in process of organization for the purpose of doing such business, including agents, brokers, adjusters and solicitors. See Illinois Compiled Statutes 215 ILCS 5/422
  • person: means any political subdivision of the State, municipal corporation, individual, firm, partnership, corporation, company, limited liability company, association, joint stock association, or trust, or a receiver, executor, trustee, guardian, or other representative appointed by order of any court. See Illinois Compiled Statutes 305 ILCS 5/5A-1
  • person: means any political subdivision of the State, municipal corporation, individual, firm, partnership, corporation, company, limited liability company, association, joint stock association, or trust, or a receiver, executor, trustee, guardian, or other representative appointed by order of any court. See Illinois Compiled Statutes 305 ILCS 5/5B-1
  • person: means any political subdivision of the State, municipal corporation, individual, firm, partnership, corporation, company, limited liability company, association, joint stock association, or trust, or a receiver, executor, trustee, guardian or other representative appointed by order of any court. See Illinois Compiled Statutes 305 ILCS 5/5C-1
  • Person: means any individual, firm, partnership, association, public or private corporation, organization or business, charitable trust, or unit of local government. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Person: includes any firm, corporation, association, agency, institution or other legal entity, as well as any natural person. See Illinois Compiled Statutes 735 ILCS 5/20-101
  • person: as used in this Article means an individual, an aggregation of individuals, a partnership, or a corporation. See Illinois Compiled Statutes 215 ILCS 5/187
  • Person: means any natural person, corporation, association, partnership or other legal entity. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Person under legal disability: means a person 18 years or older who (a) because of mental deterioration or physical incapacity is not fully able to manage his or her person or estate, or (b) is a person with mental illness or is a person with developmental disabilities and who because of his or her mental illness or developmental disability is not fully able to manage his or her person or estate, or (c) because of gambling, idleness, debauchery or excessive use of intoxicants or drugs, so spends or wastes his or her estate as to expose himself or herself or his or her family to want or suffering. See Illinois Compiled Statutes 5 ILCS 70/1.06
  • Personal information: includes an individual's name and address and "medical-record information" but does not include "privileged information". See Illinois Compiled Statutes 215 ILCS 5/1003
  • Persons of low or moderate income: means a person or family (consisting of one or more persons all of whom occupy or will occupy the home) whose aggregate gross income including the gross income of any co-signer or guarantor of the promissory note made in connection with the making of a home mortgage loan does not exceed a maximum amount to be established by the corporate authorities and determined in accordance with appropriate criteria, rules and regulations, approved by the corporate authorities in connection with the implementation of a residential housing finance plan. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Physician: means an individual licensed to practice in all branches of medicine under the Medical Practice Act of 1987. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Plan of division: means a plan of division approved by a dividing company in accordance Section 35B-20. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • Plan year: means the calendar or fiscal year on which the records of a given plan are kept. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • Plea agreement: An arrangement between the prosecutor, the defense attorney, and the defendant in which the defendant agrees to plead guilty in exchange for special considerations. Source:
  • policies: means any contract or contracts of insurance providing the coverage of the Standard Fire Policy and Extended Coverage Endorsement on any residence, living unit or commercial building. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Policyholder: means any person who:
            (1) in the case of individual property or casualty
  •     
    insurance, is a present named insured;
            (2) in the case of individual life, health or
        
    disability insurance, is a present policyowner; or
            (3) in the case of group insurance which is
        
    individually underwritten, is a present group certificateholder. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Political subdivision: means a township, road district, city, village or incorporated town, as the case may be. See Illinois Compiled Statutes 235 ILCS 5/9-1
  • Pool retention fund: means a separate fund maintained for payment of first dollar claims, up to a specific amount per claim ("specific retention") and up to an aggregate amount for a 12-month period ("aggregate retention"). See Illinois Compiled Statutes 215 ILCS 5/1102
  • Precinct: means any part of a city, village or incorporated town of over 200,000 population which was a "voting precinct" or an "election precinct" for voting at the last general election. See Illinois Compiled Statutes 235 ILCS 5/9-1
  • premiums: means the gross amount charged to policyholders for the mine subsidence insurance made available under this Article. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Present value: means the amount as of a date
  •     
    certain of one or more sums payable in the future, discounted to the date certain. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Presentence report: A report prepared by a court's probation officer, after a person has been convicted of an offense, summarizing for the court the background information needed to determine the appropriate sentence. Source: U.S. Courts
  • Pretext interview: means an interview whereby a person, in an attempt to obtain information about a natural person, performs one or more of the following acts:
            (1) pretends to be someone he or she is not,
            (2) pretends to represent a person he or she is not
  •     
    in fact representing,
            (3) misrepresents the true purpose of the interview,
        
    or
            (4) refuses to identify himself or herself upon
        
    request. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Pretrial conference: A meeting of the judge and lawyers to discuss which matters should be presented to the jury, to review evidence and witnesses, to set a timetable, and to discuss the settlement of the case.
  • Pretrial services officers: Screen applicants for pretrial release and monitor convicted offenders released under court supervision.
  • prisoner: means a person held in custody. See Illinois Compiled Statutes 745 ILCS 10/4-101
  • Privately owned community water supply: means :
             (1) an investor-owned water utility, if under
  •     
    Illinois Commerce Commission regulation and operating as a separate and distinct water utility;
            (2) a not-for-profit water corporation, if operating
        
    specifically as a water utility; and
            (3) a mutually owned or cooperatively owned community
        
    water system, if operating as a separate water utility. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Privileged information: means any individually identifiable information that: (1) relates to a claim for insurance benefits or a civil or criminal proceeding involving an individual, and (2) is collected in connection with or in reasonable anticipation of a claim for insurance benefits or civil or criminal proceeding involving an individual; provided, however, information otherwise meeting the requirements of this subsection shall nevertheless be considered "personal information" under this Article if it is disclosed in violation of Section 1014 of this Article. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Pro se: A Latin term meaning "on one's own behalf"; in courts, it refers to persons who present their own cases without lawyers.

  • Property and casualty insurer: means an insurance company that has authority to transact the kinds of insurance in either or both Class 2 or Class 3 of Section 4 or a licensed insurer writing only insurance authorized under clause (c) of Class 1, but does not include monoline mortgage guaranty insurers, financial guaranty insurers, and title insurers. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • Proportionate share: means the cost of road improvements that are specifically and uniquely attributable to a new development after the consideration of the following factors: the amount of additional traffic generated by the new development, any appropriate credit or offset for contribution of money, dedication of land, construction of road improvements or traffic reduction techniques, payments reasonably anticipated to be made by or as a result of a new development in the form of user fees, debt service payments, or taxes which are dedicated for road improvements and all other available sources of funding road improvements. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Provider: means an individual or entity duly licensed or legally authorized to provide health care services. See Illinois Compiled Statutes 215 ILCS 5/370g
  • Proxy voting: The practice of allowing a legislator to cast a vote in committee for an absent legislator.
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • Public health clinic: means an outpatient program conducted by a locally based not-for-profit corporation, or by any local board of health whose health department is recognized by, and has a designation status established by, the Illinois Department of Public Health and complies with the Public Health Standing Orders Act. See Illinois Compiled Statutes 745 ILCS 10/6-101
  • public or community service: means uncompensated labor for a non-profit organization or public body whose purpose is to enhance physical or mental stability, environmental quality or the social welfare and which agrees to accept public or community service from offenders or those adjudged liable for civil violations of a local public entity and to report on the progress of the public or community service to the court. See Illinois Compiled Statutes 745 ILCS 10/6A-101
  • Public rights-of-way: means the areas on, below, or above a public roadway, highway, street, public sidewalk, alley, waterway, or utility easements dedicated for compatible uses. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Purchase: includes taking by sale, lease,
  •     
    mortgage, security interest, pledge, gift, or any other voluntary transaction creating an interest in goods. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Purchasing group: means any group which:
             (a) has as one of its purposes the purchase of
  •     
    liability insurance on a group basis;
            (b) purchases such insurance only for its group
        
    members and only to cover their similar or related liability exposure, as described in paragraph (c) of this subsection (10);
            (c) is composed of members whose businesses or
        
    activities are similar or related with respect to the liability to which members are exposed by virtue of any related, similar, or common business, trade, product, services, premises, or operations; and
            (d) is domiciled in any State. See Illinois Compiled Statutes 215 ILCS 5/123B-2
  • Pure captive insurance company: means any company that insures only risks of its parent or affiliated companies or both. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Qualified financial contract: means any commodity contract, forward contract, repurchase agreement, securities contract, swap agreement, or any similar agreement that the Director determines by regulation, resolution, or order to be a qualified financial contract for the purposes of this Act. See Illinois Compiled Statutes 215 ILCS 5/187
  • Qualified independent actuary: means a person that is either:
             (1) a member in good standing with the Casualty
  •     
    Actuarial Society; or
            (2) a member in good standing with the American
        
    Academy of Actuaries who has been approved as qualified for signing casualty loss reserve opinions by the Casualty Practice Council of the American Academy of Actuaries. See Illinois Compiled Statutes 215 ILCS 5/123C-1
  • Qualified practitioner: means a certified public accountant who is licensed to practice in Illinois and who has completed the certification program. See Illinois Compiled Statutes 720 ILCS 5/3-6
  • Qualifying farmer: means an individual or entity that meets at least one of the following:
             (1) is a small or medium sized farmer;
             (2) is a beginning farmer;
             (3) is a limited resource farmer; or
             (4) is a socially-disadvantaged farmer. See Illinois Compiled Statutes 65 ILCS 5/11-15.4-5
  • Quorum call: A call of the roll to establish whether a quorum is present. If any legislator "suggests the absence of a quorum," the presiding officer must direct the roll to be called.
  • RAI Manual: means the most recent Resident Assessment Instrument Manual, published by the Centers for Medicare and Medicaid Services. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • railroads: as used in this Division 89 does not include a railroad constituting or used as a part of a trunk line railroad system operated as a common carrier of freight and passengers. See Illinois Compiled Statutes 65 ILCS 5/11-89-3
  • RBC: means risk-based capital. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • RBC Instructions: means the RBC Report including risk-based capital instructions adopted by the NAIC as those instructions may be amended by the NAIC from time to time in accordance with the procedures adopted by the NAIC. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • RBC Plan: means a comprehensive financial plan containing the elements specified in subsection (b) of Section 35A-15. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • RBC Report: means the risk-based capital report required under Section 35A-10. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • Receiver: means a person who is licensed under Section 3c of the Motor Fuel Tax Law and who either produces, refines, blends, compounds or manufactures fuel in this State, or transports fuel into this State or receives fuel transported to him from without the State or exports fuel out of this State, or who is engaged in distribution of fuel primarily by tank car or tank truck, or both, and who operates an Illinois bulk plant that has active fuel bulk storage capacity of not less than 30,000 gallons. See Illinois Compiled Statutes 415 ILCS 125/305
  • Receivership: means conservation, rehabilitation, or liquidation under Article XIII. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • Receiving township: means a township into which a portion of the dissolving township will be merged. See Illinois Compiled Statutes 60 ILCS 1/23-5
  • recipient: means only those persons receiving aid under Article IV. See Illinois Compiled Statutes 305 ILCS 5/9A-2
  • reciprocal: shall mean the organization or group of all the subscribers. See Illinois Compiled Statutes 215 ILCS 5/61
  • Recorder: means the office of the recorder of the county where the principal office of a domestic stock company is located. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • Recycling: means the transfer of brush, wood chips, or leaves by employees of the township to a facility or place that will utilize the product without charge. See Illinois Compiled Statutes 60 ILCS 1/210-10
  • Redlining: The alleged practice of certain lending institutions of not making mortgage, home improvement, and small business loans in certain neighborhoods-usually areas that are deteriorating or considered by the lender to be poor investments. Source: OCC
  • Refuse: means (i) combustible trash, including but not limited to paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, and bedding; (ii) noncombustible trash, including but not limited to metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, and other mineral waste; and (iii) street rubbish, including but not limited to street sweepings, dirt, leaves, catch-basin dirt, and contents of litter receptacles. See Illinois Compiled Statutes 60 ILCS 1/210-10
  • Regulated substance: means any hazardous substance as defined under Section 101(14) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (P. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Release: means any spilling, leaking, emitting, discharging, escaping, leaching or disposing of petroleum from an underground storage tank into groundwater, surface water or subsurface soils. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • RELPEG: means a Licensed Professional Engineer or a Licensed Professional Geologist engaged in review and evaluation under this Title. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Remainderman: One entitled to the remainder of an estate after a particular reserved right or interest, such as a life tenancy, has expired.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Remedial action: means activities associated with compliance with the provisions of Sections 58. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Remediation costs: means reasonable costs paid for investigating and remediating regulated substances of concern consistent with the remedy selected for a site. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • reorganize: means reorganize, reincorporate, or domesticate as an Illinois insurer; "reorganization" means reorganization, reincorporation, or domestication as an Illinois insurer; "reorganized company" means any company that has availed itself of the provisions of this Article, and the reorganization of which has been effected as in this Article provided; and "similar domestic company" means, in the case of an application for reorganization as a domestic captive insurance company, a domestic captive insurance company organized under Article VIIC. See Illinois Compiled Statutes 215 ILCS 5/180
  • Residence: means a building used principally for residential purposes up to and including a four family dwelling, permanently affixed to realty located in Illinois, including appurtenant structures, driveways, sidewalks, basements, footings, foundations, septic systems and underground pipes directly servicing the dwelling or building, but does not include living units, land, trees, plants, crops or agricultural field drainage tile. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Resident: means an enrollee who is receiving personal or medical care, including, but not limited to, mental health treatment, psychiatric rehabilitation, physical rehabilitation, and assistance with activities of daily living, from a nursing home. See Illinois Compiled Statutes 305 ILCS 5/5F-15
  • Residential Coverage: means mine subsidence insurance for a residence. See Illinois Compiled Statutes 215 ILCS 5/802.1
  • Residential housing finance plan: means a program implemented under this Division by a municipality to assist persons of low or moderate income in acquiring safe, decent and sanitary housing which they can afford. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Residual market mechanism: means an association, organization or other entity described in Article XXXIII of this Act, or Section 7-501 of The Illinois Vehicle Code. See Illinois Compiled Statutes 215 ILCS 5/1003
  • Resulting company: means a domestic stock company created by a division or a dividing company that survives a division. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • Revised RBC Plan: means an RBC Plan rejected by the Director and revised by the insurer with or without the Director's recommendations. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • Revocable trust: A trust agreement that can be canceled, rescinded, revoked, or repealed by the grantor (person who establishes the trust).
  • Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan.   • Risk retention group: means any corporation or other limited liability association:
             (a) whose primary activity consists of assuming and
  •     
    spreading all, or any portion, of the liability exposure of its group members;
            (b) which is organized for the primary purpose of
        
    conducting the activity described under paragraph (a) of this subsection (11);
            (c) which:
                 (i) is organized and licensed as a liability
            
    insurance company and authorized to engage in the business of insurance under the laws of any state; or
                (ii) before January 1, 1985 was organized or
            
    licensed and authorized to engage in the business of insurance under the laws of Bermuda or the Cayman Islands and, before such date, had certified to the insurance commissioner of at least one state that it satisfied the capitalization requirements of such state, except that any such group shall be considered to be a risk retention group only if it has been engaged in business continuously since such date and only for the purposes of continuing to provide insurance to cover product liability or completed operations liability (as such terms were defined in the Product Liability Risk Retention Act of 1981 before the date of the enactment of the Risk Retention Act of 1986);
            (d) which does not exclude any person from membership
        
    in the group solely to provide for members of such a group a competitive advantage over such a person;
            (e) which:
                 (i) has as its owners (directly or indirectly)
            
    only persons who comprise the membership of the risk retention group and who are provided insurance by such group; or
                (ii) has as its sole owner (directly or
            
    indirectly) an organization which:
                    (I) has as its members only persons who
                
    comprise the membership of the risk retention group; and
                    (II) has as its owners only persons who
                
    comprise the membership of the risk retention group and who are provided insurance by such group;
            (f) whose members are engaged in businesses or
        
    activities similar or related with respect to the liability of which such members are exposed by virtue of any related, similar, or common business, trade, product, services, premises, or operations;
            (g) whose activities do not include the provision of
        
    insurance other than:
                (i) liability insurance for assuming and
            
    spreading all or any portion of the liability of its group members; and
                (ii) reinsurance with respect to the liability of
            
    any other risk retention group (or any members of such other group) which is engaged in businesses or activities so that such group or member meets the requirement described in paragraph (f) of this subsection (11) for membership in the risk retention group which provides such reinsurance; and
            (h) the name of which includes the phrase "Risk
        
    Retention Group". See Illinois Compiled Statutes 215 ILCS 5/123B-2
  • River Edge Redevelopment Zone: has the meaning set forth under the River Edge Redevelopment Zone Act. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Road improvement impact fee: means any charge or fee levied or imposed by a unit of local government as a condition to the issuance of a building permit or a certificate of occupancy in connection with a new development, when any portion of the revenues collected is intended to be used to fund any portion of the costs of road improvements. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • safety relocator: means any person or entity engaged in the business of removing damaged or disabled vehicles from public or private property by means of towing or otherwise, and thereafter relocating and storing such vehicles. See Illinois Compiled Statutes 625 ILCS 5/18d-105
  • School Year: means a regular academic year or its equivalent excluding summer school. See Illinois Compiled Statutes 110 ILCS 805/3B-1
  • Sentencing hearing: means a hearing to
  •     
    determine whether a minor should be adjudged a ward of the court, and to determine what sentence should be imposed on the minor. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Sequester: To separate. Sometimes juries are sequestered from outside influences during their deliberations.
  • Service: means the provision of cable service or video service to subscribers and the interaction of subscribers with the person or entity that has received authorization to offer or provide cable or video service from the Commission pursuant to Section 21-401 of this Act. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Service area: means one or more land areas within the boundaries of the unit of local government which has been designated by the unit of local government in the comprehensive road improvement plan. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Service provider fee: means the amount paid under Section 21-801 of this Act by the holder to a municipality, or in the case of an unincorporated service area to a county, for service areas within its territorial jurisdiction, but under no circumstances shall the service provider fee be paid to more than one local unit of government for the same portion of the holder's service area. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Severe and multiple impairments: means the manifestation of all of the following characteristics:
             (1) The evaluation determines the presence of a
  •     
    developmental disability which is expected to continue indefinitely, constitutes a substantial disability and is attributable to any of the following:
                (A) Intellectual disability, which is defined as
            
    general intellectual functioning that is 2 or more standard deviations below the mean concurrent with impairment of adaptive behavior which is 2 or more standard deviations below the mean. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Severe autism: means a lifelong developmental disability which is typically manifested before 30 months of age and is characterized by severe disturbances in reciprocal social interactions; verbal and nonverbal communication and imaginative activity; and repertoire of activities and interests. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Severe mental illness: means the manifestation of all of the following characteristics:
             (1) A primary diagnosis of one of the major mental
  •     
    disorders in the current edition of the Diagnostic and Statistical Manual of Mental Disorders listed below:
                (A) Schizophrenia disorder. See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Severe or profound intellectual disability: means a manifestation of all of the following characteristics:
             (1) A diagnosis which meets Classification in Mental
  •     
    Retardation or criteria in the current edition of the Diagnostic and Statistical Manual of Mental Disorders for severe or profound mental retardation (an IQ of 40 or below). See Illinois Compiled Statutes 405 ILCS 80/2-3
  • Sewerage system: means and includes any one or more of the following: sewerage treatment plant or plants, collecting, intercepting, and outlet sewers, lateral sewers and drains, including combined and separate storm water and sanitary drains, force mains, conduits, pumping stations, ejector stations, and all other appurtenances, extensions, and improvements necessary, useful, or convenient for the collection, treatment, and disposal in a sanitary manner of sewage and industrial wastes. See Illinois Compiled Statutes 60 ILCS 1/205-5
  • Sewerage system: means and includes any or all of the following: a sewerage treatment plant or plants, collecting, intercepting and outlet sewers, lateral sewers, and drains, including combined and separate storm water and sanitary drains, force mains, conduits, pumping stations, ejector stations and all other appurtenances, extensions and improvements necessary, useful, or convenient for the collection, treatment, and disposal in a sanitary manner of sewage and industrial wastes. See Illinois Compiled Statutes 720 ILCS 5/9-3
  • sewerage system: means and includes any or all of the following: a sewage treatment plant or plants, collecting, intercepting and outlet sewers, force mains, conduits, lateral sewers and extensions, pumping stations, ejector stations, and all other appurtenances, extensions or improvements necessary or useful and convenient for the collection, treatment, and disposal, in a sanitary manner, of sewage and industrial wastes. See Illinois Compiled Statutes 65 ILCS 5/11-141-1
  • Sex offender: means any sex offender as defined in the Sex Offender Registration Act whose offense or adjudication as a sexually dangerous person occurred on or after June 1, 1996, and whose victim was under the age of 18 at the time the offense was committed but does not include the offenses set forth in subsection (b)(1. See Illinois Compiled Statutes 730 ILCS 152/105
  • Shareholder: means the person in whose name shares are registered in the records of a corporation or the beneficial owner of shares to the extent of the rights granted by a nominee certificate on file with a corporation. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • Site: means any single location, place, tract of land or parcel of property, or portion thereof, including contiguous property separated by a public right-of-way. See Illinois Compiled Statutes 415 ILCS 5/58.2
  • Site: means a not-for-profit organization,
  •     
    public body, church, charitable organization, or individual agreeing to accept community service from offenders and to report on the progress of ordered or required public or community service to the court or to the authorized diversion program that has referred the offender for public or community service. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Site: means any single location, place, tract of land or parcel of property including contiguous property not separated by a public right-of-way. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Site investigation: means activities associated with compliance with the provisions of subsection (a) of Section 57. See Illinois Compiled Statutes 415 ILCS 5/57.2
  • Sole ownership: The type of property ownership in which one individual holds legal title to the property and has full control of it.
  • Special Service Area: means a contiguous area within a municipality or county in which special governmental services are provided in addition to those services provided generally throughout the municipality or county, the cost of the special services to be paid from revenues collected from taxes levied or imposed upon property within that area. See Illinois Compiled Statutes 35 ILCS 200/20-90
  • Special Services: means all forms of services pertaining to the government and affairs of the municipality or county, including but not limited to weather modification and improvements permissible under Article 9 of the Illinois Municipal Code, and contracts for the supply of water as described in Section 11-124-1 of the Illinois Municipal Code which may be entered into by the municipality or by the county on behalf of a county service area. See Illinois Compiled Statutes 35 ILCS 200/20-90
  • Specifically and uniquely attributable: means that a new development creates the need, or an identifiable portion of the need, for additional capacity to be provided by a road improvement. See Illinois Compiled Statutes 605 ILCS 5/5-903
  • Startup capital: has the meaning set forth in subsection (n) of Section 501 of the Internal Revenue Code. See Illinois Compiled Statutes 215 ILCS 5/123D-5
  • State: means any state of the United States or the District of Columbia. See Illinois Compiled Statutes 215 ILCS 5/123B-2
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • subscriber: shall mean the participant or policyholder. See Illinois Compiled Statutes 215 ILCS 5/61
  • Subscriber: means an insurance company which is furnished at its request with those services provided for in par. See Illinois Compiled Statutes 215 ILCS 5/123A-2
  • Supervising authority: means the Department of Juvenile Justice, probation supervisory authority, sheriff, superintendent of a juvenile detention center, or any other officer or agency charged with authorizing and supervising home detention. See Illinois Compiled Statutes 705 ILCS 405/5-7A-105
  • Supplier: means a person from whom a lessor buys
  •     
    or leases goods to be leased under a finance lease. See Illinois Compiled Statutes 810 ILCS 5/2A-103
  • Supportive living facility: means an enrolled supportive living site as described under Section 5-5. See Illinois Compiled Statutes 305 ILCS 5/5G-5
  • Surplus: means total statutory surplus less capital, calculated in accordance with the National Association of Insurance Commissioners Accounting Practices and Procedures Manual, version effective January 1, 2001, and subsequent revisions. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • System: means a waterworks system, a sewerage system, or any separate integral part of a waterworks system or a sewerage system, or a waterworks system and sewerage system in combination as authorized and provided in Section 205-10. See Illinois Compiled Statutes 60 ILCS 1/205-5
  • teachers: means and includes all members of the teaching force excluding the general superintendent and principals. See Illinois Compiled Statutes 105 ILCS 5/34-84
  • Telecommunications service area: means the area designated by the Commission as the area in which a telecommunications company was obligated to provide non-competitive local telephone service as of February 8, 1996 as incorporated into Section 13-202. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Tenancy by the entirety: A type of joint tenancy between husband and wife that is recognized in some States. Neither party can sever the joint tenancy relationship; when a spouse dies, the survivor acquires full title to the property.
  • Term: means a term within a school year. See Illinois Compiled Statutes 110 ILCS 805/3B-1
  • Testate: To die leaving a will.
  • Total adjusted capital: means the sum of (1) an insurer's statutory capital and surplus and (2) any other items that the RBC Instructions may provide. See Illinois Compiled Statutes 215 ILCS 5/35A-5
  • Transfer: includes an assignment, assumption, conveyance, sale, lease, encumbrance, including a mortgage or security interest, gift, or transfer by operation of law. See Illinois Compiled Statutes 215 ILCS 5/35B-10
  • Transfer instrument: means the legal document intended to effectuate a transfer effective on or after the transferor's death and includes, without limitation, a will, trust, transfer on death instrument, deed, form designated as payable on death, contract, or other beneficiary designation form. See Illinois Compiled Statutes 755 ILCS 5/4a-5
  • Transferee: means a legatee, a beneficiary of a trust, a grantee of a deed, or any other person designated in a transfer instrument to receive a nonprobate transfer. See Illinois Compiled Statutes 755 ILCS 5/4a-5
  • Transferor: means a testator, settlor, grantor of a deed, or a decedent whose interest is transferred pursuant to a nonprobate transfer. See Illinois Compiled Statutes 755 ILCS 5/4a-5
  • Treatment works: means treatment works, as defined in Section 212 of the Federal Water Pollution Control Act, including, but not limited to, the following: any devices and systems owned by a local government unit and used in the storage, treatment, recycling, and reclamation of sewerage or industrial wastes of a liquid nature, including intercepting sewers, outfall sewers, sewage collection systems, pumping power and other equipment, and appurtenances; extensions, improvements, remodeling, additions, and alterations thereof; elements essential to provide a reliable recycled supply, such as standby treatment units and clear well facilities; any works, including site acquisition of the land that will be an integral part of the treatment process for wastewater facilities; and any other method or system for preventing, abating, reducing, storing, treating, separating, or disposing of municipal waste, including storm water runoff, or industrial waste, including waste in combined storm water and sanitary sewer systems as those terms are defined in the Federal Water Pollution Control Act. See Illinois Compiled Statutes 415 ILCS 5/19.2
  • Trial: means a hearing to determine whether the
  •     
    allegations of a petition under Section 5-520 that a minor is delinquent are proved beyond a reasonable doubt. See Illinois Compiled Statutes 705 ILCS 405/5-105
  • Trust sponsor: means a banking association which has created a risk retention trust under this Article. See Illinois Compiled Statutes 215 ILCS 5/1102
  • Trustee: means any State or national bank or trust company, having trust powers, located within or outside the State of Illinois, which may be appointed to act in any capacity with respect to a residential housing finance plan and the issuance of bonds to finance such plan whether designated as a trustee, custodian or administrator. See Illinois Compiled Statutes 65 ILCS 5/11-74.5-2
  • Trustor: The person who makes or creates a trust. Also known as the grantor or settlor.
  • Unfunded accrued liability: means the excess of the accrued liability over the actuarial value of the assets of a plan. See Illinois Compiled Statutes 40 ILCS 5/1A-102
  • University: means and includes Chicago State University, located at Chicago, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 661/6-5
  • University: means and includes Eastern Illinois University, located at Charleston, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 666/11-5
  • University: means and includes Governors State University, located at University Park, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 671/16-5
  • University: means and includes Illinois State University, located at Normal, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 676/21-5
  • University: means and includes Northeastern Illinois University, located at Chicago, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 681/26-5
  • University: means and includes Northern Illinois University, located at DeKalb, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 686/31-5
  • University: means and includes Western Illinois University, located at Macomb, Illinois, and its branches. See Illinois Compiled Statutes 110 ILCS 691/36-5
  • Urban agricultural area: means an area defined by a municipality and entirely within that municipality's boundaries within which one or more qualifying farmers are processing, growing, raising, or otherwise producing locally-grown agricultural products. See Illinois Compiled Statutes 65 ILCS 5/11-15.4-5
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • Variable Rate: Having a "variable" rate means that the APR changes from time to time based on fluctuations in an external rate, normally the Prime Rate. This external rate is known as the "index." If the index changes, the variable rate normally changes. Also see Fixed Rate.
  • Victim advocate: work with prosecutors and assist the victims of a crime.
  • Victim Impact Statement: A written or spoken statement by the victim or his or her representative about the physical, emotional, and financial impact of a crime on the victim. The statement is given to the court before sentencing.
  • Video programming: means that term as defined in item (20) of 47 U. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Video service: means video programming and subscriber interaction, if any, that is required for the selection or use of such video programming services, and that is provided through wireline facilities located at least in part in the public rights-of-way without regard to delivery technology, including Internet protocol technology. See Illinois Compiled Statutes 220 ILCS 5/21-201
  • Voice vote: A vote in which the Presiding Officer states the question, then asks those in favor and against to say "Yea" or "Nay," respectively, and announces the result according to his or her judgment. The names or numbers of legisators voting on each side are not recorded.
  • Voir dire: The process by which judges and lawyers select a petit jury from among those eligible to serve, by questioning them to determine knowledge of the facts of the case and a willingness to decide the case only on the evidence presented in court. "Voir dire" is a phrase meaning "to speak the truth."
  • waterworks: means and includes a waterworks system in its entirety or any integral part thereof, including mains, hydrants, meters, values, standpipes, storage tanks, pump tanks, intakes, wells, impounding reservoirs, pumps, machinery, purification plants, softening apparatus, and all other elements, useful in connection with a water supply or water distribution system. See Illinois Compiled Statutes 720 ILCS 5/9-3
  • Waterworks system: means and includes a waterworks system in its entirety, or any integral part of a waterworks system, including mains, hydrants, meters, valves, standpipes, storage tanks, pumps, tanks, intakes, wells, impounding reservoirs, machinery, purification plants, softening apparatus, and all other elements useful in connection with a water supply or water distribution system. See Illinois Compiled Statutes 60 ILCS 1/205-5
  • Wills: includes codicils. See Illinois Compiled Statutes 5 ILCS 70/1.13
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
