Terms Used In Indiana Code > Title 16 > Article 34 - Abortion

  • abortion: has the meaning set forth in IC 16-18-2-1. See Indiana Code 16-34-6-1
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • alternative fuel: means liquefied petroleum gas, a compressed natural gas product, or a combination of liquefied petroleum gas and a compressed natural gas product, not including a biodiesel fuel or biodiesel blend, used in an internal combustion engine or a motor to propel a motor vehicle. See Indiana Code 4-4-32.3-1
  • any other disability: means any disease, defect, or disorder that is genetically inherited. See Indiana Code 16-34-4-1
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Contract: A legal written agreement that becomes binding when signed.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • division: refers to the division of historic preservation and archeology of the department of natural resources established by IC 14-9-4-1. See Indiana Code 4-4-37-1.3
  • Down syndrome: means a chromosomal disorder associated with an extra chromosome 21 or an effective trisomy for chromosome 21. See Indiana Code 16-34-4-2
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • Judgment: means all final orders, decrees, and determinations in an action and all orders upon which executions may issue. See Indiana Code 1-1-4-5
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • mandatory reporter: means any person providing health care services, including:

  • medical record: means written or printed information possessed by a provider (as defined in Ind. See Indiana Code 1-1-4-5
  • minor: means a person less than eighteen (18) years of age. See Indiana Code 1-1-4-5
  • office: refers to the Indiana office of energy development established by IC 4-3-23-3. See Indiana Code 4-4-32.3-4
  • physician: means any person licensed to practice medicine in Indiana. See Indiana Code 16-34-6-3
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • potential diagnosis: refers to the presence of some risk factors that indicate that a health problem may occur. See Indiana Code 16-34-4-3
  • preservation: means the application of measures to sustain the form, integrity, and material of:

  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • reproductive health care facility: means any office, clinic, or other physical location licensed by the state to provide surgical or medical abortions, abortion counseling, abortion referrals, contraceptives, contraceptive counseling, sex education, or gynecological services. See Indiana Code 16-34-6-4
  • sex selective abortion: means an abortion that is performed solely because of the sex of the fetus. See Indiana Code 16-34-4-4
  • unit: means a county, city, town, township, or school corporation. See Indiana Code 4-4-32.3-6
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
