  • abandoned aircraft: means an aircraft:

  • account: means an arrangement under a terms-of-service agreement in which a custodian carries, maintains, processes, receives, or stores a digital asset of the user or provides goods or services to the user. See Indiana Code 32-39-1-2
  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • aircraft: means any contrivance used or designed for navigation of or flight in the air. See Indiana Code 32-33-10.5-2
  • Allegation: something that someone says happened.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.

  • Amortization: Paying off a loan by regular installments.
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • applicable offense: refers to any of the following:

  • applicant: means an individual who applies to a landlord to enter into a lease of a dwelling unit. See Indiana Code 32-31-9-4
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • attorney in fact: includes an attorney in fact granted authority under a durable power of attorney or a nondurable power of attorney. See Indiana Code 32-39-1-3
  • auctioneer: means an auctioneer licensed under Indiana Code 32-30-10-1
  • authority: refers to the Indiana housing and community development authority created by IC 5-20-1-3. See Indiana Code 32-30-10.5-1.2
  • Autism: means a neurological condition as described in the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders of the American Psychiatric Association. See Indiana Code 1-1-4-5
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bailiff: a court officer who enforces the rules of behavior in courtrooms.
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Bequest: Property gifted by will.
  • board: refers to the board of trustees of the Indiana public retirement system established by Indiana Code 33-38-6-2
  • board: refers to the board of trustees of the Indiana public retirement system. See Indiana Code 33-38-6.9-1
  • board: refers to the board of trustees of the Indiana public retirement system established by Indiana Code 33-38-7-3

  • catalogue of electronic communications: means information that identifies each person with which a user has had an electronic communication, the time and date of the communication, and the electronic address of the person. See Indiana Code 32-39-1-5
  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • cause: means a trial, a hearing, an arraignment, a controversy, an appeal, a case, or any business performed within the official duty of a justice, judge, or prosecuting attorney. See Indiana Code 33-23-11-1
  • census: means the last preceding United States federal decennial census. See Indiana Code 33-41-2-1
  • Chambers: A judge's office.
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • chemical test: means an analysis of an individual's:

  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • city or town fund: refers to the city or town user fee fund established under section 3 of this chapter. See Indiana Code 33-37-8-1
  • city-county council: refers to the Indianapolis, Marion County city-county council. See Indiana Code 33-33-49-3
  • claim: means :

  • claimant: means an individual or entity who initiates a cause of action alleging loss or damages arising from COVID-19 in a contract, implied contract, quasi-contract, or unjust enrichment claim. See Indiana Code 34-12-5-4
  • clerk: refers to the clerk of the Marion superior court. See Indiana Code 33-33-49-4
  • clerk: means a clerk of the circuit court elected and qualified under Article 6, Sections 2 and 4 of the Constitution of the State of Indiana. See Indiana Code 33-32-1-1
  • clerk: refers to any of the following:

  • commission: means the commission on judicial qualifications described in Article 7, Section 9 of the Constitution of the State of Indiana. See Indiana Code 33-38-13-2

  • communications infrastructure: includes all wires, cable, and other similar facilities used to provide communications service. See Indiana Code 32-30-16-2
  • communications service: has the meaning set forth in Indiana Code 32-30-16-3
  • community court: means a problem solving court focused on addressing specific neighborhood or local criminal problems by:

  • compensation: means any money, thing of value, or economic benefit conferred on or received by any person in return for services rendered or for services to be rendered, whether by that person or another. See Indiana Code 33-23-11-3
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • construction machinery and equipment: includes all classes and types of machinery and equipment used in road construction, road maintenance, earth moving, and building construction work. See Indiana Code 32-33-10-1
  • content of an electronic communication: means information concerning the substance or meaning of the communication that:

  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • contractor: means a reassessment, reassessment review, or special reassessment contractor of the department of local government finance under Indiana Code 33-26-8-1
  • Conviction: A judgement of guilt against a criminal defendant.
  • cooperative housing association: means a consumer cooperative that provides dwelling units to its members. See Indiana Code 32-31-3-2
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • council: refers to the prosecuting attorneys council of Indiana established by section 2 of this chapter. See Indiana Code 33-39-8-1
  • council: refers to the public defender council of Indiana established by section 2 of this chapter. See Indiana Code 33-40-4-1
  • counsel: means the lawyer designated by the commission to:

  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.

  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Defense attorney: Represent defendants in criminal matters.
  • demonstrates: means meets the burdens of going forward with the evidence and of persuasion. See Indiana Code 34-13-9-4
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.

  • dwelling unit: means a structure or part of a structure that is used as a home, residence, or sleeping unit. See Indiana Code 32-31-5-3

  • economic interest: means substantial financial interest in investments, employment, awarding of contracts, purchases, leases, sales, or similar matters. See Indiana Code 33-23-11-4
  • electric easement: means any recorded or unrecorded easement held by an electricity supplier for the siting of electric facilities, regardless of whether the easement is for the exclusive benefit of the electricity supplier or for use in connection with other utility services, regardless of whether the electricity supplier provides the other utility services.   • electric facilities: means any product, equipment, or technology necessary or useful in the transmission, transformation, or distribution of electricity, including wires, cables, poles, transformers, anchors, guys, grounding systems, insulators, and any other related or ancillary materials.   • electricity supplier: means :

  • electronic: means relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic, or similar capabilities. See Indiana Code 32-39-1-11
  • electronic communication: has the meaning set forth in 18 U. See Indiana Code 32-39-1-12
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash.   • eligible person: refers to a person or the estate of a person that properly filed a claim with the state, in the form prescribed by the attorney general, before December 31, 2011, for physical injury or death resulting from an occurrence. See Indiana Code 34-13-8-1
  • eligible project: means a project for housing infrastructure. See Indiana Code 5-1.2-15.5-2
  • employee: includes the following:

  • employer: means the state of Indiana. See Indiana Code 33-38-6-3

  • employer: means any person from whom the judge, justice, or prosecuting attorney or the spouse of the judge, justice, or prosecuting attorney receives any nonstate income. See Indiana Code 33-23-11-5
  • En banc: In the bench or "full bench." Refers to court sessions with the entire membership of a court participating rather than the usual quorum. U.S. courts of appeals usually sit in panels of three judges, but may expand to a larger number in certain cases. They are then said to be sitting en banc.
  • end user: means a person who uses a special tool as part of the person's manufacturing process. See Indiana Code 32-33-20-2
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • executive secretary: refers to the executive secretary of the disciplinary commission. See Indiana Code 33-24-10-4
  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • Executor: A male person named in a will to carry out the decedent
  • exempt property: means personal property that is any of the following:

  • exercise of religion: includes any exercise of religion, whether or not compelled by, or central to, a system of religious belief. See Indiana Code 34-13-9-5

  • fabricator: means any individual or entity, including a tool or die maker, who:

  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.

  • farm machinery: means all types of tractors, implements, and machinery used in the operation and maintenance of farms. See Indiana Code 32-33-10-2
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C.   • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.

  • Fiduciary: A trustee, executor, or administrator.

  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • fixed-base operator: means a person that provides on the premises of a public-use airport aeronautical services, including any of the following:

  • Forbearance: A means of handling a delinquent loan. A

  • Fraud: Intentional deception resulting in injury to another.

  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • governmental body: means an agency, a board, or a commission of the legislative, executive, or judicial branch of state government. See Indiana Code 33-23-8-1
  • governmental entity: includes the whole or any part of a branch, department, agency, instrumentality, official, or other individual or entity acting under color of law of any of the following:

  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Grantor: The person who establishes a trust and places property into it.
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • guardian: means a person appointed by a court to manage the estate of a living individual. See Indiana Code 32-39-1-15
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • guest: includes a transient guest, permanent guest, tenant, lodger, or boarder. See Indiana Code 32-33-7-1
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Highway: includes county bridges and state and county roads, unless otherwise expressly provided. See Indiana Code 1-1-4-5
  • housing infrastructure: means the installation, replacement, upgrade, or improvement of public infrastructure for the support of residential housing. See Indiana Code 5-1.2-15.5-4
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • indigent: means an individual whose income is not more than one hundred twenty-five percent (125%) of the federal income poverty level as determined annually by the federal Office of Management and Budget under 42 U. See Indiana Code 33-24-12-2
  • information: means data, text, images, videos, sounds, codes, computer programs, software, databases, or the like. See Indiana Code 32-39-1-16
  • information of a confidential nature: means information that:

    Indiana Code 33-23-11-6

  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.
  • Inter vivos: Transfer of property from one living person to another living person.
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC

  • Juror: A person who is on the jury.
  • juror qualification form: means the form prescribed for use by the courts and delivered to each prospective juror. See Indiana Code 33-28-5-2
  • jury administrator: means the court administrator, the county clerk, or other clerical personnel appointed by a supervising judge to administer the jury assembly process. See Indiana Code 33-28-5-3
  • jury pay fund: refers to the jury pay fund established under section 2 of this chapter. See Indiana Code 33-37-11-1
  • jury pool: means the names or identifying numbers of prospective jurors drawn at random from the master list. See Indiana Code 33-28-5-3.5

  • problem solving court: means a court providing a process for immediate and highly structured judicial intervention for eligible individuals that incorporates the following problem solving concepts:

  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • storage facility: means any location approved by a court for storage of a tenant's personal property under section 2(e) of this chapter. See Indiana Code 32-31-4-1.5
  • Subpoena: A command to a witness to appear and give testimony.
  • successor statewide automated support enforcement system: means a statewide automated system for the collection, disbursement, and distribution of child support payments established by the department of child services. See Indiana Code 33-32-4-2
  • Summons: Another word for subpoena used by the criminal justice system.
  • supervising judge: means a judge of the courts designated to supervise the jury assembly process. See Indiana Code 33-28-5-7
  • supplemental fund: refers to the supplemental state fair relief fund established by section 9 of this chapter. See Indiana Code 34-13-8-3
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Tenancy in common: A type of property ownership in which two or more individuals have an undivided interest in property. At the death of one tenant in common, his (her) fractional percentage of ownership in the property passes to the decedent

  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • trustee: means a fiduciary with legal title to property under an agreement or declaration that creates a beneficial interest in another. See Indiana Code 32-39-1-26
  • Trustee: A person or institution holding and administering property in trust.
