Terms Used In Iowa Code 124.204

  • Drug: means :
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Manufacture: means the production, preparation, propagation, compounding, conversion, or processing of a controlled substance, either directly or by extraction from substances of natural origin, or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis, and includes any packaging or repackaging of the substance or labeling or relabeling of its container, except that this term does not include the preparation, compounding, packaging, or labeling of a controlled substance:
  • Opiate: means any substance having an addiction-forming or addiction-sustaining liability similar to morphine or being capable of conversion into a drug having addiction-forming or addiction-sustaining liability. See Iowa Code 124.101
  • State: when applied to a part of the United States, includes any state, district, commonwealth, territory, insular possession, and any area subject to the legal authority of the United States of America. See Iowa Code 124.101

 Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation, which contains any quantity of the following hallucinogenic substances, or which contains any of its salts, isomers, and salts of isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation (for purposes of this subsection only, the term “isomer” includes the optical, position and geometric isomers):

 a. 4-bromo-2,5-dimethoxy-amphetamine. Some trade or other names:4-bromo-2,5-dimethoxy-a-methylphenethylamine; 4-bromo-2,5-DMA.
 b. 2,5-dimethoxyamphetamine. Some trade or other names: 2,5-dimethoxy-a- methylphenethylamine; 2,5-DMA.
 c. 4-methoxyamphetamine. Some trade or other names: 4-methoxy-a- methylphenethylamine; paramethoxyamphetamine, PMA.

 j. Dimethyltryptamine. Some trade or other names: DMT.
 k. Ibogaine. Some trade or other names: 7-Ethyl-6,6B,7,8,9,10,12,13-octahydro-2-methoxy-6,9-methano-5H-pyrido [1′,2′:1,2] azepino [5,4-b] indole; Tabernanthe iboga.
 l. Lysergic acid diethylamide.
 m. Marijuana, except as otherwise provided in subsection 7.
 n. Mescaline.
 o. Parahexyl. Some trade or other names: 3-Hexyl-1-hydroxy-7,8,9,10-tetrahydro-6,6,9-trimethyl-6H-dibenzo [b,d]pyran; Synhexyl.
 p. Peyote, except as otherwise provided in subsection 8. Meaning all parts of the plant presently classified botanically as Lophophora williamsii Lemaire, whether growing or not, the seeds thereof, any extract from any part of such plant, and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or extracts.
 q. N-ethyl-3-piperidyl benzilate.
 r. N-methyl-3-piperidyl benzilate.
 s. Psilocybin.
 t. Psilocyn.
 u. (1) Tetrahydrocannabinols, meaning tetrahydrocannabinols naturally contained in a plant of the genus Cannabis (Cannabis plant) as well as synthetic equivalents of the substances contained in the Cannabis plant, or in the resinous extractives of such plant, and synthetic substances, derivatives, and their isomers with similar chemical structure and pharmacological activity to those substances contained in the plant, such as the following:

 (a) 1 cis or trans tetrahydrocannabinol, and their optical isomers.
 (b) 6 cis or trans tetrahydrocannabinol, and their optical isomers.
 (c) 3,4 cis or trans tetrahydrocannabinol, and their optical isomers. (Since nomenclature of these substances is not internationally standardized, compounds of these structures, regardless of numerical designation of atomic positions covered.)
 (2) Subparagraph (1) does not include tetrahydrocannabinol to the extent excluded in subsection 7.

 ab. N-hydroxy-3,4-methylenedioxyamphetamine (also known as N-hydroxy-alpha-methyl-3,4(methylenedioxy)phenethylamine, and N-hydroxy MDA).
 ac. 2,5-dimethoxy-4-ethylamphet-amine. Some trade or other names: DOET.
 ad. Alpha-ethyltryptamine. Some trade or other names: etryptamine; Monase; a-ethyl-1H-indole-3-ethanamine; 3-(2-aminobutyl) indole; alpha-ET; and AET.

 (2) Salvinorin A.
 (3) HU-210. [(6aR,10aR)-9-(hydroxymethyl)-6,6-dimethyl-3-(2-methyloctan-2-yl) 6a,7,10,10a-tetrahydrobenzo[c] chromen-1-ol)].
 (4) HU-211(dexanabinol, (6aS,10aS)-9-(hydroxymethyl)-6,6-dimethyl-3-(2-methyloctan-2-yl)-6a,7,10,10a-tetrahydrobenzo[c] chromen-1-ol).
 (5) Unless specifically exempted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of cannabimimetic agents, or which contains their salts, isomers, and salts of isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation.

 (a) The term “cannabimimetic agents” means any substance that is a cannabinoid receptor type 1 (CB1 receptor) agonist as demonstrated by binding studies and functional assays within any of the following structural classes:

 (i) 2-(3-hydroxycyclohexyl)phenol with substitution at the 5-position of the phenolic ring by alkyl or alkenyl, whether or not substituted on the cyclohexyl ring to any extent.
 (ii) 3-(1-naphthoyl)indole or 3-(1-naphthylmethane)indole by substitution at the nitrogen atom of the indole ring, whether or not further substituted on the indole ring to any extent, whether or not substituted on the naphthoyl or naphthyl ring to any extent.
 (iii) 3-(1-naphthoyl)pyrrole by substitution at the nitrogen atom of the pyrrole ring, whether or not further substituted in the pyrrole ring to any extent, whether or not substituted on the naphthoyl ring to any extent.
 (iv) 1-(1-naphthylmethylene)indene by substitution of the 3-position of the indene ring, whether or not further substituted in the indene ring to any extent, whether or not substituted on the naphthyl ring to any extent.
 (v) 3-phenylacetylindole or 3-benzoylindole by substitution at the nitrogen atom of the indole ring, whether or not further substituted in the indole ring to any extent, whether or not substituted on the phenyl ring to any extent.
 (b) Such terms include:

 (i) 5-(1,1-dimethylheptyl)-2-[(1R,3S)-3-hydroxycyclohexyl]-phenol (CP-47,497).

 av. Marijuana extract meaning an extract containing one or more cannabinoids that has been derived from any plant of the genus Cannabis, containing greater than 0.3 percent tetrahydrocannabinol on a dry weight basis, other than the separated resin (whether crude or purified) obtained from the plant.
 aw. Any substance, compound, mixture, or preparation which contains any quantity of any synthetic cathinone that is not approved as a pharmaceutical, including but not limited to the following:

 (1) 4-methylmethcathinone (Mephedrone).
 (2) 3,4-methylenedioxypyrovalerone (MDPV).
 (3) 4-methoxymethcathinone (methedrone; Bk-PMMA).
 (4) 3,4-methylenedioxyethcathinone (ethylone).
 (5) N,N-dimethylcathinone(metamfepramone).
 (6) Alpha-pyrrolidinopropiophenone (alpha-PPP).
 (7) 4-methoxy-alpha-pyrrolidinopropiophenone (MOPPP).
 (8) 3,4-methylenedioxy-alpha-pyrrolidinopropiophenone (MDPPP).
 (9) 6,7-dihydro-5H-indeno-(5,6-d)-1,3-dioxol-6-amine) (MDAI).
 (10) 3-fluoromethcathinone.

 a. Mecloqualone.

 c. Gamma-hydroxybutyric acid. Some trade or other names: GHB;gamma-hydroxybutyrate; 4-hydroxybutyrate; 4-hydroxybutanoic acid; sodium oxybate; sodium oxybutyrate.

 Stimulants.

 Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of the following substance having a stimulant effect on the central nervous system, including its salts, isomers, and salts of isomers:

 a. Fenethylline.
 b. N-ethylamphetamine.
 c. (+-)cis-4-methylaminorex ((+-)cis-4,5-dihydro-4-methyl-5-phenyl-2-oxazolamine).
 d. N,N-dimethylamphetamine (also known as N,N-alpha-trimethyl-benzeneethanamine;N,N-alpha-trimethylphenethylamine).
 e. Cathinone. Some trade or other names: 2-amino-1-phenyl-1-propanone, alpha- aminopropiophenone, 2-aminopropiophenone, and norephedrone.
 f. Aminorex. Some other names: aminoxaphen; 2-amino-5-phenyl-2-oxazoline;4,5-dihydro-5-phenyl-2-oxazolamine.

 Exclusions.

 This section does not apply to any of the following:

 a. Hemp as defined in section 204.2 that is or was produced in this state, or was produced in another state, in accordance with the provisions of chapter 204 with a maximum delta-9 tetrahydrocannabinol concentration that does not exceed three-tenths of one percent on a dry weight basis.
 b. A hemp product as provided in chapter 204 with a maximum tetrahydrocannabinol concentration, inclusive of any isomers, derivatives, and analogs, whether naturally occurring or synthesized, that does not exceed three-tenths of one percent on a dry weight basis.
 8.

 Peyote.

 Nothing in this chapter shall apply to peyote when used in bona fide religious ceremonies of the Native American Church; however, persons supplying the product to the church shall register, maintain appropriate records of receipts and disbursements of peyote, and otherwise comply with all applicable requirements of this chapter and rules adopted pursuant thereto.

 9.

 Other substances.

 Any material, compound, mixture, or preparation which contains any quantity of the following substances or their optical, positional, and geometric isomers, salts, and salts of isomers:

 a. 2-(ethylamino)-1-phenylhexan-1-one). Other name: N-Ethylhexedrone.
 b. Alpha-Pyrrolidinohexanophenone. Other names: alpha-PHP; alpha-pyrrolidinohexiophenone; 1-phenyl-2-(pyrrolidin-1-yl)hexan-1-one.
 c. 4-Methyl-alpha-ethylaminopentiophenone. Other names: 4-MEAP; 2-(ethylamino)-1-(4-methylphenyl)pentan-1-one.
 d. 4′-Methyl-alpha-pyrrolidinohexiophenone. Other names: MPHP; 4′-methyl-alpha-pyrrolidinohexanophenone; 1-(4-methylphenyl)-2-(pyrrolidin-1-yl)hexan-1-one.
 e. alpha-Pyrrolidinoheptaphenone. Other names:PV8; 1-phenyl-2-(pyrrolidin-1-yl)heptan-1-one.
 f. 4′-Chloro-alpha-pyrrolidinovalerophenone. Other names: 4-chloro-alpha-PVP; 4′-chloro-alpha-pyrrolidinopentiophenonoe; 1-(4-chlorphenyl)-2-(pyrrolidin-1-yl)pentan- 1-one.
 g. Fentanyl-related substances. “Fentanyl-related substance” means any substance not otherwise listed under this schedule or another schedule, and for which no exemption or approval is in effect under section 505 of the federal Food, Drug, and Cosmetic Act that is structurally related to fentanyl by one or more of the following modifications:

 (1) Replacement of the phenyl portion of the phenethyl group by any monocycle, whether or not further substituted in or on the monocycle.
 (2) Substitution in or on the phenethyl group with alkyl, alkenyl, akloxyl, hydroxyl, halo, haloalkyl, amino, or nitro groups.
 (3) Substitution in or on the piperidine ring with alkyl, alkenyl, alkoxyl, ester, ether, hydroxyl, halo, haloalkyl, amino, or nitro groups.
 (4) Replacement of the aniline ring with any aromatic monocycle whether or not further substituted in or on the aromatic monocycle.
 (5) Replacement of the N-propionyl group by another acyl group.
 h. Ethyl 2-(1-(5-fluoropentyl)-1H-indazole-3-carboxamido)-3,3-dimethylbutanoate. Othername: 5F-EDMB-PINACA.
 i. Methyl 2-(1-(5-fluoropentyl)-1H-indole-3-carboxamido)-3,3-dimethylbutanoate. Othername: 5F-MDMB-PICA.
