Terms Used In Iowa Code 237.14A

  • Agency: means a person, as defined in section 4. See Iowa Code 237.1
  • Child: means child as defined in section 234. See Iowa Code 237.1
  • Department: means the department of human services. See Iowa Code 237.1
  • Individual: means an individual person or a married couple who provides child foster care in a single-family home environment and which does not meet the definition of an agency in subsection 2. See Iowa Code 237.1
  • Reasonable and prudent parent standard: means the standard characterized by careful and sensible parenting decisions that maintain the health, safety, and best interests of a child, while at the same time encouraging the emotional and developmental growth of a child, that a caregiver shall use when determining whether to allow a child in foster care under the placement, care, or supervision of the department to participate in extracurricular, enrichment, cultural, or social activities. See Iowa Code 237.1
 The department, or any individual, agency, or juvenile shelter care home that applies the reasonable and prudent parent standard reasonably and in good faith in regard to a child in foster care shall have immunity from civil or criminal liability which might otherwise be incurred or imposed. This section shall not remove or limit any existing liability protection afforded under any other law.
