Terms Used In Iowa Code > Chapter 579B - Commodity Production Contract Lien

  • Commodity: means livestock, raw milk, or a crop. See Iowa Code 579B.1
  • Continuous arrival: means the arrival of livestock at a contract livestock facility on a monthly basis or more frequently as provided in a production contract. See Iowa Code 579B.1
  • Contract: A legal written agreement that becomes binding when signed.
  • Contract crop field: means farmland where a crop is produced according to a production contract executed pursuant to section 579B. See Iowa Code 579B.1
  • Contract livestock facility: includes a confinement feeding operation as defined in section 459. See Iowa Code 579B.1
  • Contract operation: means a contract livestock facility or contract crop field. See Iowa Code 579B.1
  • Contract producer: means a person who owns or leases a contract operation and who produces a commodity under a production contract executed pursuant to section 579B. See Iowa Code 579B.1
  • Contractor: means a person who owns a commodity at the time that the commodity is under the authority of the contract producer as provided in section 579B. See Iowa Code 579B.1
  • Crop: means a plant used for food, animal feed, fiber, or oil, if the plant is classified as a forage or cereal plant, including but not limited to alfalfa, barley, buckwheat, corn, flax, forage, millet, oats, popcorn, rye, sorghum, soybeans, sunflowers, wheat, and grasses used for forage or silage. See Iowa Code 579B.1
  • Farmland: means agricultural land suitable for use in farming as defined in section 9H. See Iowa Code 579B.1
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Lien: means a commodity production contract lien created in section 579B. See Iowa Code 579B.1
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Livestock: means beef cattle, dairy cattle, sheep, or swine. See Iowa Code 579B.1
  • operator: means any person other than one who is tax exempt under section 501(c)(3) of the Internal Revenue Code, as defined in section 422. See Iowa Code 557B.1
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • Personal representative: means a person who is authorized by a contract producer to act on behalf of the contract producer, including by executing an agreement, managing a contract operation, filing a financing statement perfecting a lien, and enforcing a lien as provided in this chapter. See Iowa Code 579B.1
  • Production contract: means an oral or written agreement executed pursuant to section 579B. See Iowa Code 579B.1
  • property: includes personal and real property. See Iowa Code 4.1
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • year: means twelve consecutive months. See Iowa Code 4.1
