(1) There is established the Kentucky Arts Council (hereinafter referred to as “the council”) which shall perform functions pursuant to KRS § 153.210 to KRS § 153.235.
(2) The purpose of the council shall be to develop and promote a broadly conceived state policy of support for the arts in Kentucky pursuant to KRS

(3) The Governor shall appoint members to the council. The council shall consist of not more than fifteen (15) members who have an interest in the arts and have the ability and experience to provide broad expertise in operation of the council. Members shall reflect the diverse interests of the arts community to the extent such diversity is possible. At least one (1) member shall represent each of the following areas: education, economic development, and workforce development. The Governor shall appoint three (3) members for a term to expire on November 18, 2017; five (5) members for a term to expire on November 18, 2018; four (4) members for a term to expire on November 18,
2019; and three (3) members for a term to expire on November 18, 2020. Thereafter the Governor shall make all appointments for a term of four (4) years. Members may be reappointed to one (1) additional four (4) year term.
(4) Council members shall not receive any compensation for their services, but may be reimbursed in accordance with the provisions of KRS Chapters 44 and
45 for actual and necessary expenses incurred in the performance of their duties under KRS § 153.210 to KRS § 153.235.
(5) From the council membership the Governor shall appoint a chair and a vice chair of the council who shall serve at the pleasure of the Governor. The council may elect by majority vote other officers deemed necessary. The chair shall not be represented by a proxy. Should the chair be unavailable, the vice chair shall serve in the chair’s stead.
(6) The council shall meet at the call of the chair, but not less often than three (3) times during each calendar year. A majority of the members appointed to the council shall constitute a quorum.
(7) The council shall be attached to the Tourism, Arts and Heritage Cabinet as a department within the meaning of KRS Chapter 12.
(8) The council shall be headed by an executive director appointed by the secretary of the Tourism, Arts and Heritage Cabinet and confirmed by majority vote of the council.
