A civil action under KRS § 367.976 to KRS § 367.985 may be brought in any court of competent jurisdiction within one (1) year of the date of the occurrence of any violation or within six (6) months of the time the rental-purchase agreement, together with any renewals or extensions thereof, ceases to be in effect, whichever is greater. Notwithstanding the above, a civil action under KRS § 367.976 to KRS § 367.985 may be maintained by way of recoupment or counterclaim in an action brought against the consumer by the lessor or its assignee.

  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
