Terms Used In U.S. Code > Title 15 > Chapter 2 > Subchapter V

  • advertising: means any advertising or promotion program involving only fluid milk products and directed toward increasing the general demand for fluid milk products. See 14 USC 327
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • affixed: means attached to the textile fiber product in any manner. See 46 USC 53717
  • Agreement: means the Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas, adopted by the Conference of the Food and Agriculture Organization of the United Nations on November 24, 1993. See 20 USC 1226a
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Amortization: Paying off a loan by regular installments.
  • Anadromous fish: means fish of the species listed in the Annex to the Convention that migrate into the Convention area. See 20 USC 1161a
  • Anadromous stocks: means stocks of species listed in the Annex to the Convention that migrate into the Convention area. See 20 USC 1161a
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • applicable program: means any program for which the Secretary or the Department has administrative responsibility as provided by law or by delegation of authority pursuant to law. See 22 USC 2358
  • applicable statute: means --

    (A) the Act or the title, part, section, or any other subdivision of an Act, as the case may be, that authorizes the appropriation for an applicable program. See 22 USC 2358

  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • area studies: means a program of comprehensive study of the aspects of a society or societies, including study of its history, culture, economy, politics, international relations and languages. See 20 USC 1132
  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • association: when used in reference to a corporation, shall be deemed to embrace the words "successors and assigns of such company or association" in like manner as if these last-named words, or words of similar import, were expressed. See 19 USC 2295
  • Atlantic striped bass: means members of stocks or populations of the species Morone saxatilis, which ordinarily migrate seaward of the waters described in paragraph (3)(A)(i). See 20 USC 1161l–4
  • Auction market: means a market or place to which tobacco is delivered by the producers thereof, or their agents, for sale at auction through a warehouseman or commission merchant. See 10 USC 452
  • Authorized officer: means a law enforcement official authorized to enforce this chapter under section 5008(a) of this title. See 20 USC 1161a
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • beginning farmer or rancher: means such term as defined by the Secretary. See 14 USC 252
  • Bequest: Property gifted by will.
  • Board: means the Pecan Marketing Board established in section 6005(b) of this title. See 12 USC 4587
  • Board: means the Lime Board provided for under section 6204(b) of this title. See 14 USC 281
  • Board: means the United Soybean Board established under section 6304(b) of this title. See 14 USC 292
  • borrower: means any farm borrower who has outstanding obligations to the Secretary under any farmer program loan, without regard to whether the loan has been accelerated, but does not include any farm borrower all of whose loans and accounts have been foreclosed on or liquidated, voluntarily or otherwise. See 14 USC 252
  • Center: means the Filene Center in the Park. See 20 USC 1138b
  • Chambers: A judge's office.
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • coastal State: means --

    (A) Pennsylvania and each State of the United States bordering on the Atlantic Ocean north of the State of South Carolina. See 20 USC 1161l–4

  • coastal waters: means --

    (A) for each coastal State referred to in paragraph (4)(A)--

    (i) all waters, whether salt or fresh, of the coastal State shoreward of the baseline from which the territorial sea of the United States is measured. See 20 USC 1161l–4

  • Commerce: means commerce between any State, Territory, or possession, or the District of Columbia, and any place outside thereof. See 10 USC 452
  • commerce: means commerce among the several States or with foreign nations, or in any Territory of the United States or in the District of Columbia, or between any such Territory and another, or between any such Territory and any State or foreign nation or between the District of Columbia and any State or Territory or foreign nation.   • commerce: means interstate, foreign, or intrastate commerce. See 14 USC 258

  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • conflict of interest: means a situation in which a member has a direct or indirect financial interest in a corporation, partnership, sole proprietorship, joint venture, or other business entity dealing directly or indirectly with the Board. See 12 USC 4587
  • consumer information: means information and programs that will assist consumers and other persons in making evaluations and decisions regarding the purchase, preparation, and use of pecans. See 12 USC 4587
  • consumer information: means information and programs that will assist consumers and other persons in making evaluations and decisions regarding the purchase, preparation, and use of mushrooms. See 14 USC 258
  • consumer information: means any action taken to provide information to, and broaden the understanding of, the general public regarding the use, nutritional attributes, and care of limes. See 14 USC 281
  • consumer information: means information that will assist consumers and other persons in making evaluations and decisions regarding the purchase, preparation, and use of soybeans or soybean products. See 14 USC 292
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Convention: means the Convention for the Conservation of Anadromous Stocks of the North Pacific Ocean, signed in Moscow, February 11, 1992. See 20 USC 1161a
  • Convention area: means the waters of the North Pacific Ocean and its adjacent seas, north of 33 degrees North Latitude,1 beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured. See 20 USC 1161a
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Council: means the Mushroom Council established under section 6104(b) of this title. See 14 USC 258
  • county: includes a parish, or any other equivalent subdivision of a State or Territory of the United States. See 19 USC 2292
  • Credit Score: A number, roughly between 300 and 800, that measures an individual's credit worthiness. The most well-known type of credit score is the FICO score. This score represents the answer from a mathematical formula that assigns numerical values to various pieces of information in your credit report. Source: OCC
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • debt forgiveness: means reducing or terminating a farmer program loan made or guaranteed under this chapter, in a manner that results in a loss to the Secretary, through--

    (i) writing down or writing off a loan under section 2001 of this title. See 14 USC 252

  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the Department of Education. See 22 USC 2358
  • Department: means the Department of Agriculture. See 12 USC 4587
  • Department: means the Department of Agriculture. See 14 USC 258
  • Department: means the Department of Agriculture. See 14 USC 292
  • Dependent: A person dependent for support upon another.
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Devise: To gift property by will.
  • direct loan: means a loan made or insured from funds in the account created by section 1929 of this title. See 14 USC 252
  • Directed fishing: means fishing targeted at a particular species or stock of fish. See 20 USC 1161a
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • district: means a geographical area of the United States, as determined by the Board and approved by the Secretary, in which there is produced approximately one-fourth of the volume of pecans produced in the United States. See 12 USC 4587
  • Ecologically related species: means living marine species which are associated with anadromous stocks found in the Convention area, including, but not restricted to, both predators and prey of anadromous fish. See 20 USC 1161a
  • educational programs abroad: means programs of study, internships, or service learning outside the United States which are part of a foreign language or other international curriculum at the undergraduate or graduate education levels. See 20 USC 1132
  • Enforcement officer: means a law enforcement official authorized by any Party to enforce this chapter. See 20 USC 1161a
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Exclusive economic zone: means the zone established by Proclamation Numbered 5030, dated March 10, 1983. See 20 USC 1161a

  • farmer: includes a person who is engaged in, or who, with assistance afforded under this chapter, intends to engage in, fish farming. See 14 USC 252
  • farmer program loan: means a farm ownership loan (FO) under section 1923 of this title, operating loan (OL) under section 1942 of this title, soil and water loan (SW) under section 1924 of this title, emergency loan (EM) under section 1961 of this title, economic emergency loan (EE) under section 202 of the Emergency Agricultural Credit Adjustment Act (title II of Public Law 95-334), economic opportunity loan (EO) under the Economic Opportunity Act of 1961 (42 U.   • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fiduciary: A trustee, executor, or administrator.
  • first handler: means the first person who buys or takes possession of pecans from a grower for marketing. See 12 USC 4587
  • first handler: means any person, as described in an order issued under this chapter, who receives or otherwise acquires mushrooms from a producer and prepares for marketing or markets such mushrooms, or who prepares for marketing or markets mushrooms of that person's own production.   • first purchaser: means --

    (A) except as provided in subparagraph (B), any person buying or otherwise acquiring from a producer soybeans produced by such producer. See 14 USC 292

  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fish: means finfish, mollusks, crustaceans, and all other forms of marine animal and plant life other than marine mammals and birds. See 20 USC 1161a
  • Fishing: means --

    (A) the catching, taking, or harvesting of fish, or any other activity that can reasonably be expected to result in the catching, taking, or harvesting of fish. See 20 USC 1161a

  • grower-sheller: means a person who--

    (A) shells pecans, or has pecans shelled for such person, in the United States. See 12 USC 4587

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • handler: means any person in the business of handling limes. See 14 USC 281
  • high seas: means the waters beyond the territorial sea or exclusive economic zone (or the equivalent) of any nation, to the extent that such territorial sea or exclusive economic zone (or the equivalent) is recognized by the United States. See 20 USC 1226a
  • high seas fishing vessel: means any vessel of the United States or subject to the jurisdiction of the United States used or intended for use--

    (A) on the high seas. See 20 USC 1226a

  • importer: means any person who imports pecans from outside of the United States for sale in the United States. See 12 USC 4587
  • importer: means any person who imports, on average, over 500,000 pounds of mushrooms annually from outside the United States. See 14 USC 258
  • importer: means any person who imports limes into the United States. See 14 USC 281
  • Incidental taking: means catching, taking, or harvesting a species or stock of fish while conducting directed fishing for another species or stock of fish. See 20 USC 1161a
  • individual: shall include every infant member of the species homo sapiens who is born alive at any stage of development. See 19 USC 2297
  • industry information: means information and programs that will lead to the development of new markets and marketing strategies, increased efficiency, and activities to enhance the image of the pecan industry. See 12 USC 4587
  • industry information: means information and programs that are designed to lead to the development of new markets and marketing strategies, increased efficiency, and activities to enhance the image of the mushroom industry. See 14 USC 258
  • industry information: means information and programs that will lead to the development of new markets, new marketing strategies, or increased efficiency for the soybean industry, and activities to enhance the image of the soybean industry. See 14 USC 292
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Inspector: means any person employed, licensed, or authorized by the Secretary to determine and certify the type, grade, condition, or other characteristics of tobacco. See 10 USC 452
  • institution of higher education: means , in addition to institutions which meet the definition of section 1001 of this title, institutions which meet the requirements of section 1001 of this title except that (1) they are not located in the United States, and (2) they apply for assistance under this subchapter in consortia with institutions which meet the definition of section 1001 of this title. See 20 USC 1132
  • insure: as used in this chapter includes guarantee, which means to guarantee the payment of a loan originated, held, and serviced by a private financial agency or other lender approved by the Secretary. See 14 USC 252
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • international business: means profit-oriented business relationships conducted across national boundaries and includes activities such as the buying and selling of goods, investments in industries, the licensing of processes, patents and trademarks, and the supply of services. See 20 USC 1132
  • international conservation and management measures: means measures to conserve or manage one or more species of living marine resources that are adopted and applied in accordance with the relevant rules of international law, as reflected in the 1982 United Nations Convention on the Law of the Sea, and that are recognized by the United States.   • internationalization of curricula: means the incorporation of international or comparative perspectives in existing courses of study or the addition of new components to the curricula to provide an international context for American business education. See 20 USC 1132
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • lawful hunt: means the taking or harvesting (or attempted taking or harvesting) of wildlife or fish, on Federal lands, which--

    (A) is lawful under the laws applicable in the place it occurs. See 20 USC 1161t

  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • length: means --

    (A) for any high seas fishing vessel built after July 18, 1982, 96 percent of the total length on a waterline at 85 percent of the least molded depth measured from the top of the keel, or the length from the foreside of the stem to the axis of the rudder stock on that waterline, if that is greater, except that in ships designed with a rake of keel the waterline on which this length is measured shall be parallel to the designed waterline.   • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • lime: means the fruit of a citrus latifolia tree for the fresh market. See 14 USC 281
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Magnuson Act: means the Magnuson-Stevens Fishery Conservation and Management Act (16 U. See 20 USC 1161l–4
  • manufactured fiber: means any fiber derived by a process of manufacture from any substance which, at any point in the manufacturing process, is not a fiber. See 46 USC 53717
  • marketing: means the sale or other disposition of mushrooms in any channel of commerce. See 14 USC 258
  • marketing: means the sale or other disposition of limes in commerce. See 14 USC 281
  • marketing: means the sale or other disposition of soybeans or soybean products in any channel of commerce. See 14 USC 292
  • marriage: means only a legal union between one man and one woman as husband and wife, and the word "spouse" refers only to a person of the opposite sex who is a husband or a wife. See 19 USC 2296

  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.

  • moratorium period: means the period beginning on the day on which moratorium is declared under section 5154(a) of this title regarding a coastal State and ending on the day on which the Commission notifies the Secretaries that that State has taken appropriate remedial action with respect to those matters that were the case of the moratorium being declared.   • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • mushrooms: means all varieties of cultivated mushrooms grown within the United States for the fresh market, or imported into the United States for the fresh market, that are marketed, except that such term shall not include mushrooms that are commercially marinated, canned, frozen, cooked, blanched, dried, packaged in brine, or otherwise processed, as may be determined by the Secretary.   • National Credit Union Administration: The federal regulatory agency that charters and supervises federal credit unions. (NCUA also administers the National Credit Union Share Insurance Fund, which insures the deposits of federal credit unions.) Source: OCC

  • order: means a lime research, promotion, and consumer information order issued by the Secretary under section 6203(a) of this title. See 14 USC 281
  • order: means an order issued under section 6303 of this title. See 14 USC 292
  • Outlays: Outlays are payments made (generally through the issuance of checks or disbursement of cash) to liquidate obligations. Outlays during a fiscal year may be for payment of obligations incurred in prior years or in the same year.
  • Oversight: Committee review of the activities of a Federal agency or program.

  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.

  • person: means any individual, group of individuals, partnership, corporation, association, cooperative, or any other legal entity. See 14 USC 292
  • Personal property: All property that is not real property.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • plan: means a plan issued under section 6003 of this title. See 12 USC 4587

  • producer: means any person engaged in the production of mushrooms who owns or who shares the ownership and risk of loss of such mushrooms and who produces, on average, over 500,000 pounds of mushrooms per year. See 14 USC 258
  • producer: means any person who produces limes in the United States for sale in commerce. See 14 USC 281
  • producer: means any person engaged in the growing of soybeans in the United States who owns, or who shares the ownership and risk of loss of, such soybeans. See 14 USC 292
  • producer-handler: means any person who is both a producer and handler of limes. See 14 USC 281
  • promotion: means any action taken by the Board, pursuant to this chapter, to present a favorable image of pecans to the public with the express intent of improving the competitive position of pecans in the marketplace and stimulating sales of pecans, including paid advertising. See 12 USC 4587
  • promotion: means any action determined by the Secretary to enhance the image or desirability of mushrooms, including paid advertising. See 14 USC 258
  • promotion: means any action taken under this chapter (including paid advertising) to present a favorable image for limes to the general public with the express intent of improving the competitive position and stimulating the sale of limes. See 14 USC 281
  • promotion: means any action, including paid advertising, technical assistance, and trade servicing activities, to enhance the image or desirability of soybeans or soybean products in domestic and foreign markets, and any activity designed to communicate to consumers, importers, processors, wholesalers, retailers, government officials, or others information relating to the positive attributes of soybeans or soybean products or the benefits of importation, use, or distribution of soybeans and soybean products.   • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Public debt: Cumulative amounts borrowed by the Treasury Department or the Federal Financing Bank from the public or from another fund or account. The public debt does not include agency debt (amounts borrowed by other agencies of the Federal Government). The total public debt is subject to a statutory limit.
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • qualified beginning farmer or rancher: means an applicant, regardless of whether the applicant is participating in a program under section 1935 of this title--

    (A) who is eligible for assistance under this chapter. See 14 USC 252

  • qualified State soybean board: means a State soybean promotion entity that is authorized by State law. See 14 USC 292
  • Quorum: The number of legislators that must be present to do business.
  • Ranking minority member: The highest ranking (and usually longest serving) minority member of a committee or subcommittee.
  • Real Estate Settlement Procedures Act: Federal law that, among other things, requires lenders to provide "good faith" estimates of settlement costs and make other disclosures regarding the mortgage loan.   • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • research: means any type of test, study, or analysis designed to advance the image, desirability, usage, marketability, production, product development, or quality of pecans. See 12 USC 4587
  • research: means any type of study to advance the image, desirability, marketability, production, product development, quality, or nutritional value of mushrooms. See 14 USC 258
  • research: means any type of research relating to the use and nutritional value of limes and designed to advance the image, desirability, marketability, or quality of limes. See 14 USC 281
  • research: means any type of study to advance the image, desirability, marketability, production, product development, quality, or functional or nutritional value of soybeans or soybean products, including any research activity designed to identify and analyze barriers to export sales of soybeans and soybean products.   • research: means market research to support advertising and promotion efforts, including educational activities, research directed to product characteristics, product development, including new products or improved technology in production, manufacturing or processing of milk and the products of milk. See 14 USC 327
  • Roll call vote : A vote in which each legislator votes "yea" or "nay" as his or her name is called by the Clerk, so that the names of legislators voting on each side are recorded.

  • sheller: means any person who--

    (A) shells pecans or has pecans shelled for the account of such person. See 12 USC 4587

  • soybean products: means products produced in whole or in part from soybeans or soybean by-products. See 14 USC 292
  • soybeans: means all varieties of Glycine max or Glycine soya. See 14 USC 292
  • State: includes Territory, the District of Columbia, possession of the United States, and foreign nations. See 10 USC 452
  • State: shall include each of the several States, the Commonwealth of Puerto Rico, the Virgin Islands of the United States, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and, to the extent the Secretary determines it to be feasible and appropriate, the Trust Territory of the Pacific Islands.   • textile fiber: means a unit of matter which is capable of being spun into a yarn or made into a fabric by bonding or by interlacing in a variety of methods including weaving, knitting, braiding, felting, twisting, or webbing, and which is the basic structural element of textile products.   • textile fiber product: means --

    (1) any fiber, whether in the finished or unfinished state, used or intended for use in household textile articles. See 46 USC 53717

  • Tobacco: means tobacco in its unmanufactured form. See 10 USC 452
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • tribally controlled college or university: has the meaning given the term in section 1801 of title 25. See 20 USC 1132
  • Trustee: A person or institution holding and administering property in trust.

  • ultimate consumer: means a person who obtains a textile fiber product by purchase or exchange with no intent to sell or exchange such textile fiber product in any form. See 46 USC 53717
