Terms Used In Maine Revised Statutes > Title 27 > Chapter 13 - Archaeology

  • Artifact: means a physical entity which has been worked or modified by human action. See Maine Revised Statutes Title 27 Sec. 373-A
  • Authorized representative: means any official or group of officials employed by the permittors or other competent person authorized in writing by the permittors. See Maine Revised Statutes Title 27 Sec. 373-A
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Excavation: includes , but is not limited to, activities such as purposeful looting, material procurement, construction activities or vandalism. See Maine Revised Statutes Title 27 Sec. 373-A
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fiduciary: A trustee, executor, or administrator.
  • Financial institution: means any bank or trust company, savings bank, savings and loan association, industrial bank, national banking association, federal savings and loan association, mortgage banker, credit union or other such institution authorized to do business in the State, or a government agency which customarily provides service or otherwise aids in the financing of mortgage loans. See Maine Revised Statutes Title 30-A Sec. 4702
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Landowner: means any person, corporation, partnership, organization or other legal entity, including a municipality, county or other political subdivision of the State, an agency of the Federal Government and any quasi-governmental entity, which owns or controls a site. See Maine Revised Statutes Title 27 Sec. 373-A
  • lands: includes lands and all tenements and hereditaments connected therewith, and all rights thereto and interests therein. See Maine Revised Statutes Title 1 Sec. 72
  • Materials: means 3-dimensional items, other than artifacts and specimens, and excludes books, papers, manuscripts and archival or library material commonly included in the display or research collection of museums. See Maine Revised Statutes Title 27 Sec. 373-A

  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Municipality: includes cities, towns and plantations, except that "municipality" does not include plantations in Title 10, chapter 110, subchapter IV; or Title 30?A, Part 2. See Maine Revised Statutes Title 1 Sec. 72
  • Object: means any archaeological monument, artifact, relic or article. See Maine Revised Statutes Title 27 Sec. 373-A
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Permittors: means the Director of the Maine Historic Preservation Commission and the Director of the State Museum as well as the director of any state department administering state-controlled lands, acting in concert in the review, approval and granting of permits.   • Person: means an individual, corporation, partnership, firm, organization or other legal entity. See Maine Revised Statutes Title 30-A Sec. 2001
  • Principal investigator: means the senior scientist in charge of an archaeological excavation. See Maine Revised Statutes Title 27 Sec. 373-A
  • Protected site: means a site that is:

  • Site: means an area containing archaeological artifacts or materials or other evidence of habitation, occupation or other use by historic or prehistoric people. See Maine Revised Statutes Title 27 Sec. 373-A
  • Specimen: means any items, set of items or parts of items collected as representative samples of geological media or biological forms found within the State. See Maine Revised Statutes Title 27 Sec. 373-A
  • State-controlled land: means any land or water area owned in fee simple by the State, with the exception of those lands contained within Baxter State Park. See Maine Revised Statutes Title 27 Sec. 373-A
  • Trustee: A person or institution holding and administering property in trust.
