53-1-207. Authorization of inmate labor for designated construction projects — exemptions. (1) The department of corrections is authorized to use inmate labor for the purpose of construction projects at a state prison that are authorized by the legislature.

  • Contract: A legal written agreement that becomes binding when signed.
  • state prison: means :

    (1)a state penal or correctional institution whose primary function is to provide for the custody, treatment, training, and rehabilitation of adult criminal offenders;

    (2)a state penal or correctional facility portion of a Montana regional correctional facility;

    (3)a detention center, a state penal facility, or a correctional facility in another jurisdiction detaining Montana inmates pursuant to 53-30-106;

    (4)a private correctional facility or penal facility licensed by the department of corrections or a private correctional facility or penal facility portion of a Montana regional correctional facility licensed by the department of corrections; or

    (5)a combination of the facilities listed in this section. See Montana Code 53-30-101

(2)The department of administration shall provide for construction of the projects authorized by this section, which are to be built by the lowest responsible bidder, with contract specifications to allow the use of inmate labor. The percentage of inmate labor must be determined prior to the advertising for bid of the projects through negotiations among the department of corrections, the department of administration, representatives of construction industry employers, and representatives of the building trades.
